    _ Administration.—Letters of administra-tion were granted in the estates of RichardTurvey, John Richards, Edgar Spooner,GeorgeKeough, Rika Paka te Amo.

    Leave to Sell Estate.— the matterof. Mary Ann Macfarlane (deceased), Mr.Hcsketh moved for leave to sell certainreal estate. The estate was a small one,and it was desired to wind it up. Theorder was granted. In the matter of DavidFindlay (deceased), Mr. Thome moved forpower to sell real estate. Tho beneficiariesall consented. The sworn value of theproperty was £250, and tho order wasgranted.

    Deep-Level Cross Gold Mining Com-pany (in Liquidation). — Mr. Buddiemoved, under tho Company's Act, 1882,that the Registrar's certificate be approved.It was that the final accounts of the liquida-tor be passed. Tho report was approved,arid an order made for tho final dissolutionof the company ; tho books to be depositedwith. the Registrar of tho Supreme Courtfor disposal.

    Maxvvet.t. v. Rf.xd and Others.—Mr.Hesketh moved on summons for a Commis-sion to examine witnesses out of the colony.The witnesses required resided in SanFrancisco, - and the question was whoshould be appointed. Mr. Hosketh saidhe had seen the American Consul, who hadgiven tho right title of the presiding Judgeof the Superior Court, of San Francisco,and he suggested that the Commission besent to the Judge, leaving it to him to ap-point a person to take the evidence. HisHonor coincided in this view, and Mr.Myers, who appeared for the defendants,consented. The order for the Commissionwas granted accordingly, the costs to bocosts in the cause.

    Lunatics' Act, 18S2.—In the matter ofthis Act. and of Ralph Green Fenwick (alunatic), Mr. Mahony moved for an inquiryas to whether Ralph Green Fenwick is ofunsound mind, and incapable of manag-ing himself or his affairs. This matter hadbeen before the Court prior to His Honorgoing South, and was postponed. Mr.Brookfield, who appeared for the publictrustee, consented to this step. His Honorsaid that this matter had been before theCourt, prior to his being appointed a Judge.Mr. Mahony said at that time ho appearedfor the friends of the lunatic who weredesirous of getting him sent home. Butthey no longer wished that, and what wasnow wanted was to inquire into his sanityprior to having an application made toappoint a committee to manage his estate.It was the wife of the lunatic who nowmade the application, and it was for herMr. Mahony appeared. His Honor fixedthe date of the inquiry for the '23rd ofJune at the Asylum at half-past two p.m.

    Registration of an' Order.ln thematter of the Land Transfer Act 1885, andthe Native Land Court Act ISS(S, and of anorder for 2011 acres in Block Maunjjatau-tnri No. 2, in favour of tho New ZealandLoan and Mercantile Agency Company.Mr. Buddie moved on summons to theDistrict Land Registrar toshow cause whyhe should not register an order of theNative Land Court. At therequest of Mr.Buddie, this motion was allowed to standover till next chamber sittings.

    Hutchison v. Powell.—Mr. Heskethmoved on summons to remove affidavit ofGeorge Hutchison, sworn on 10th August,1891, from the file. Mr. Theo. Cooper ap-peared to oppose. His Honor said a preli-minary objection had been taken by Mr.Cooper as to whether thero was power toremove tho affidavit, and ho reserved hisdecision till lie had an opportunity of con-sulting the other Judges. Ho had dono so,and now dismissed the summons on thepreliminary objection.

    Divorce Case.—Thomas Teasdale, peti-tioner, and Catherine Bushe respondent.Mr. Button moved for directions as totrial. Mr. Burton appeared for the peti-tioner, and stated that Mr. S. Heskoth,who was to appear for the respondent, wasunable to attend, and asked that it mightbe allowed to stand over. His Honor saidif it was to be hoard at the ensuing civilsittings, it must be set down by Wednes-day. Ho would, if convenient to theparties, tako the application in tho after-noon.

    James Rae v. 11. R. Clayton.—Claim£16 15s, on a judgment) summons. Mr.Cotter for the judgment creditor and Mr.Button for the debtor. Mr. Button saidthe total amount owing by the defendantto all his creditors was £113 17s, apartfrom & debt of £60 secured by defen-dant's furniture. Five of his credi-tors, whose claims amounted to £70 7s,had agreed to a proposal he submitted,but the other three, amongst them Mr.Rae, whose claims aggregated £44 10s,

    declined to accept the proposal. Mr.Rao had offered the same terms as hegave to bank and insurance clerks—namely,Is per £ per month, which amounted to 60

    j per cent. The debtor recognised that bysuch a system ho would never be able toget clear. Consequently he proposed topay £4 4s 9d per month towards the pay-ment of all his debts, which would beequivalent to a dividend of 9d in the £ permonth to each creditor. By this arrange-ment he would pay off all he owed in some-thing over two years. Mr. Cotter said thestatement made by Mr. Button was in themain correct, and he would not, therefore,put the. debtor in the box. Ho pointed outthat Mr. Rae was the only creditor who hadtaken out a judgment summons against thedefendant, and said he would like HisWorship's ruling as to whether he (Rae)should not, therefore, be entitled to anorder irrospectivoof the others'claim3. If theCourt would establish the precedent of mak-ing an order for payments in proportion towhat the defendant could pay to all his credi- ]tors, ho (Mr. Cotter) could offer no objec-tion. Mr. Rae was willing to accept £1 permonth, thus allowing sixteen months, with-out interest, to pay off the amount of theclaim. His Worship said the question wasone which hadoften occurred tohim, whetherit would be right to recogni.-e an arrange-ment with the body of the creditors, and,instead of insisting upon a judgmentcreditor who asked for an order coming inwith the others, to give him the prece-dence ; or whether the debtor should onlybe required to pay to him an amount whichhe would be able to pay to all by way ofdividends? The true solution seemed tohim to be that, whero the arrangementproposed was reasonable and bona fidp., andnot impugned in any way, the Courtshould recognise should, in short, takeinto consideration the circumstances of thedebtor. If, on the other hand, it hassought to impugn the statement byalleging extravagant living, fraud, orany of the other things mentionedin the Imprisonment for Debt Aboli-tion Act, such grounds of objectionought to be set up and proved, but whenthe only ground was that the debtor hadhad the means to pay since the date of thejudgment, it was only fair that the wholeof his circumstances should be taken intoaccount. For these reasons His Worshipthought the ordor should be for an amountequal to the dividend the debtor could payto each of his creditors. The statementmade to Mr. Button having been admittedby the other side to be correct, that amoundwould be 12s per month, and an order

    BOARD OF EDUCATION.

    A meeting of the Executive Committee ofthe Auckland Board of Education was heldyesterday afternoon. Present; — Messrs.Luke (chairman), Udy, Muir, Buckhurst,Grant, and Cooper.

    School Committee Elections. —The cor-respondence connected with the disputedSchool Committee elections was read, objec-tions having been lodged that certain in-formalities had taken place, and it wa3decided to ask the chairman of the house-holders' meeting to forwardthe ballot papersto the Board to be recounted. Considerationof objections to elections in other districtswas deferred pending receipt of furtherinformation. The Raglan Committee wascompleted by the appointment of Messrs. A.Bay, J. Campbell, and E. Frissell. In regardto the Rangiriri, where the householdersalso failed to return a full committee, it wasresolved to ask Mr. Kensington to suggestthe names of four gentlemen for appoint-ment.
