Witnesses

Lisa, a student who saw Jason drinking, reported Jason`s drinking to Coach Wilson.

Coach Wilson questioned Jason but he denies drinking. Coach decides not enough evidence to punish Jason.

School Policy:

Rayburn High School has an Alcohol, Tobacco, and Drug Policy. The relevant part of the policy reads that “during the calendar year, regardless of quantity, a student shall not: Use or consume, or have in possession a beverage containing alcohol”. The policy further outlines penalties for breaking the policy. This policy is consistent with state laws that set the minimum drinking age at 21 years. It`s illegal for anyone under 21 to drink alcohol. The only exception is if someone under 21 drinks alcohol at the home of his/her parents or guardians with their permission.

Facts:

Saturday before the homecoming game Jason attended a party at Carrie Eden`s house.

Carrie smelled alcohol on Jason`s breath and he was acting “rowdy”.

Later that evening, around 10:00 pm, Jason`s cousin, Ron, arrived and Jason got into Ron`s car and was witnessed drinking beer by Lisa Kent, another Rayburn High School student.

Facts:

Lisa left the party and after arriving home discussed Jason`s drinking with her mother.

Monday morning Lisa reported to Coach James Wilson that she saw Jason drinking before some games during football season.

Later that day Coach Wilson called Jason into his office and asked him if he drank in a car at the party on Saturday.

Jason denied drinking.

Facts:

Wednesday during football practice Coach Wilson thought he smelled alcohol on Jason`s breath but Jason played without seeming intoxicated.

On Friday, during the homecoming game Jason tried running the ball instead of passing it and was injured on a tackle.

He likely had ligament damage in his knee.

Facts:

Coach Wilson and an assistant coach smelled alcohol on Jason`s breath.

A blood alcohol level was obtained at the hospital and was 0.05.

While he consumed the can of beer with his “older” cousin this would not be considered an exception to the law as the cousin is not Jason`s legal guardian.

His parents are living and he lives with his parents.

School Violation Policies

1st offense: student lose eligibility for next 2 consecutive contests or 2 weeks.

2nd offense: lose eligibility for next 6 contests of 3 weeks. Student must show evidence in writing that he sought or received counseling.

3rd offense: lose eligibility for next 12 contests or 4 weeks. Student must complete rehab to be reinstated.

Solution 1

Mr. Wilson is sued due to his lack of negligence that resulted in Jason Hunt being injured. Mr. Wilson broke the school policy which stated if a teacher has any clues or suspicions about a student would be suspended for two weeks from sports Mr. Wilson was confronted by Miss Kent who told Mr. Wilson of Jason Hunt’s drinking and under the school code Mr. Wilson should have reported Mr. Hunt but failed to do so.

Solution 2

Mr. Wilson is not sued under the fact that there was no proper evidence of the incident being Mr. Wilson’s fault. Mr. Wilson confronted Jason Hunt after being confronted Miss Kent where he was told by Mr. Hunt that no such incident occurred , Mr. Wilson had no prior reason to suspect Mr. Hunt of drinking so he let it slide.

Opinion 2:

I think Coach Wilson should be sued because if a student says they saw one of your players drinking at a party then that should be enough evidence and you need to hold them accountable. I think he should have sued also because if you think you smell alcohol on their breath then that is also evidence and also because he drank before the game that Friday, and that was proven at the hospital when they took his blood alcohol level when he tore up his knee during the game.
