The ROC encourages both the complainant and the respondent to make a good faith effort to resolve this complaint. Respondent: • A complete copy of the complaint is enclosed for the respondent. • If you do not resolve this complaint within ten (10) calendar days from the date of this letter, a formal citation may

be issued against your license. • If you receive a formal citation, you should read it carefully and respond in writing within fifteen (15) days. If you

do not respond in writing, you will lose your opportunity to defend yourself at an administrative hearing. Complainant: • If the respondent does not resolve your complaint within ten (10) calendar days from the date of this letter, you may

request in writing a citation be issued against the respondent’s license. This may result in an administrative hearing. • In the request for a citation you must list those items in the complaint that have not been resolved. This will assist

the ROC in filing the correct charges. If a hearing results, you will be responsible to prove the violation(s). • If you do not request a citation within twenty (20) calendar days from the date of this letter, the ROC will assume

Respondent’s written answer, pursuant to A.R.S. § 32-1155, should also show cause, if any,

why the license should not be suspended or revoked.

Respondent is advised and notified that in the event of any findings of a charged violation, your

prior disciplinary record or final agency orders may be considered in mitigation or in aggravation

when determining an appropriate disposition on the matter.

Respondent is advised and notified that the specific provisions of the State’s contracting laws

which are charged in the Citation as possibly having been violated by you are as follows:

A.R.S. § 32-1154A

11. Failure by a licensee or agent or official of a licensee to pay monies in excess of seven hundred

fifty dollars when due for materials or services rendered in connection with the licensee`s operations

as a contractor when the licensee has the capacity to pay or, if the licensee lacks the capacity to pay,

when the licensee has received sufficient monies as payment for the particular construction work

project or operation for which the services or materials were rendered or purchased.
