Authority) is a fully owned Government of Kerala company set up in 2007 for
providing services to the various health care institutions under the
Department of Family Welfare and Health. One of the key objectives of the
KMSCL is to act as the central procurement agency for all essential drugs and
equipments for all health care institutions (hereinafter referred to as user
institutions) under the department. The corporation has also been entrusted
with the setting up and running of all kinds of modern Medical and
Paramedical or medical based ancillary facilities such as hospitals,
pathological labs, diagnostic centers, x-ray / scanning facilities, tele radiology
services, power laundry services, setting up of IVF/ICSI centers etc.
1.2. The Government has entrusted KMSCL as the managing agency for ‘108’
emergency ambulance service which is called as “Kerala Emergency Medical “Kerala Emergency Medical “Kerala Emergency Medical “Kerala Emergency Medical
services Project” (KEMP)services Project” (KEMP)services Project” (KEMP)services Project” (KEMP). The KEMP project was initially launched as a pilot
study in the district of Thiruvananthapuram on 19th May 2010 with 25
Advanced Life Support Ambulances (ALS), and expanded to Alappuzha
district on 21st April 2012 with 18 ALS ambulances, which has so far
attended more than 95,000 emergencies. The current agreement for
operating KEMP services at the two districts will expire on 15th October 2013
at 11.59 PM. Hence it is decided to invite tender for continuing the
Emergency ambulance service to the districts Thiruvananthapuram and
Alappuzha of Kerala under the existing toll free no.‘108’.
1.3. Tender is invited from the firms who are willing to operate 24x7 pre-hospital
emergency ambulance services in the districts of Thiruvananthapuram and
Alappuzha of Kerala State with the existing 43 Advanced Life Support (ALS)
ambulances. The present control room at Techno Park, Thiruvananthapuram
and the available ambulances will be handed over to the successful bidder for

2.1.1. The bidder will be required to operate 24x7 pre-hospital emergency medical
service under KEMP and assist in any disaster situations for the districts of
Thiruvananthapuram and Alappuzha of the Kerala State with the existing 43
ALS ambulances and the centralized control room having one single toll free
number ‘108’.
2.1.2. Tender is invited for operating 43 Advanced Life Support ambulances under
KEMP for a period of six months from 00:00 hours on 16th October 2013
which may be extended with mutual consent.
2.1.3. The successful bidder has to occupy the existing control room, recruit human
resources at his cost and effectively operate the ambulance service with
minimum 99.5% uptime. At any given instance only a maximum 5% of the
ambulances should be withdrawn from the field for routine maintenance etc.
2.1.4. Detailed description of the objectives, scope of services, deliverables and
other requirements for the operation of 108 Emergency ambulance services
(KEMP) in the districts of Thiruvananthapuram and Alappuzha with the
existing 43 ALS Ambulances are specified in this tender. The manner in
which the tender is required to be submitted, evaluated and accepted is
explained in this document.
2.1.5. The selection of the operating agency (service provider) shall be on the basis
of evaluation criteria specified in this tender document.

4.1.1 Overall Objective of this tender is to engage agencies having sufficient and
proven expertise and experience of operating a network of emergency
medical ambulance services to continue the 24x7 pre hospital emergency
medical ambulance services for the districts of Thiruvananthapuram and
Alappuzha, by operating the existing 43 Advanced Life Support (ALS)
Ambulances under a toll free number ‘108’. This will facilitate an
integrated and comprehensive emergency health care management in
these districts of the state by providing high-end ambulatory
transportation from the doorstep of the emergency victim to appropriate
care in a hospital.
4.1.2 To provide transport to quality emergency care within the shortest
possible time in an emergency. Ensure delivery of quality emergency care
across the chain of services with a proper emergency management
system. To ensure that the system is efficient and effective as possible by
providing first class management service quality and monitoring systems
to run the ambulance service. And the key objectives are;-
4.1.2.1 To continue the present service of KEMP by operating 43 ALS
ambulances, located in the districts of Thiruvananthapuram and
Alappuzha, from the existing control room under the toll free ‘108’
4.1.2.2 To provide comprehensive Emergency Medical Response Services
(EMRS) to the people in the districts of Thiruvananthapuram and
Alappuzha.

4.1.2.3 To leverage health services to all stakeholders by a comprehensive range
of services extending through pre hospital emergency medical services
and a point of first contact for Police and Fire Departments.

knowledge and best practices in the Ambulance Care Services.

4.2.1 KEMP is the 108 Emergency ambulance service started in
Thiruvananthapuram district with 25 ALS ambulances on 19th May 2010.
The project was extended to Alappuzha district with 18 ALS ambulances
on 21st April 2012.
4.2.2 The project is operated under Public-Private-Partnership (PPP). The
Emergency Response center (control room) is established at Techno Park,
Thiruvananthapuram comprising more than 2000 sq feet. The call center
is 24 seated and has a lecture hall for providing trainings and to conduct
meetings.
4.2.3 KEMP has so far provided services to more than 95,000 citizens.
4.2.4 It is proposed to continue the KEMP operations at the districts of
Thiruvananthapuram and Alappuzha with the existing 43 ALS (Advanced
Life Support) ambulances from 00:00 hours on 16th October 2013.

4.3.1 The successful bidder has to provide 24x7 pre-hospital emergency
ambulance services in the districts of Thiruvananthapuram and Alappuzha
by operating the existing 43 Advanced Life Support (ALS)ambulances
through the calls obtained in one single toll free number ‘108’.

4.3.2 At present KEMP ‘108’ ambulance service is operated in the district of
Thiruvananthapuram with 25 ALS ambulances and Alappuzha with 18
ALS ambulances under Public Private Partnership.
4.3.3 The existing 43 ALS ambulances will be handed over to the successful
tenderer and have to be operated from the various health institutions of
the districts of Thiruvananthapuram and Alappuzha, as being done now.
The detailed technical specifications and other facilities of the existing
ALS ambulances are provided in Annexure VI & VII.
4.3.4 The present control room (Emergency Response Center) of KEMP
located at Techno park, Thiruvananthapuram will be transferred to the
successful bidder. This control room shall be occupied by the successful
bidder to provide services to the districts of Thiruvananthapuram and
Alappuzha. The details regarding the Infrastructure and other facilities
available in the present control room are provided in Annexure VIII.
4.3.5 The rental charges of the present control will be paid by the Tender
Inviting Authority. The control room with the entire hardware and other
existing facilities will be handed over to the successful tenderer.
4.3.6 Capital expense (CAPEX): Since the tender is invited to continue the
KEMP operations with the existing 43 ALS ambulances and with the
existing infrastructure except manpower, no further expenses for the
capital cost shall be paid by the Tender Inviting Authority.
4.3.7 Operating expense: (OPEX) Shall be met by the bidder which includes
the following

4.3.7.11 Any other unforeseen expenses.
4.3.8 The ALS ambulances will be handed over to the bidder by the tender
inviting Authority and all formalities related with the maintenance of the
ambulances as per the rules in force has to be done by the successful
bidder during the contract period.
4.3.9 The operating expense shall be quoted for the operation of each
ambulance for a maximum kilometer of 3000 km per ambulance per
month and additional kilometer will be reimbursed at the rate of Rs. 15/-

per month for all the 43 vehicles combined. Additional kilometers
payment will be reimbursed only if the total kilometers travelled by all the
43 ambulances deployed in the districts of Thiruvananthapuram and
Alappuzha, crosses the 1,29,000 (3000 x 43) kilometer mark for any
given month.
4.3.10 The distance travelled by the ambulance other than patient transport (to
& fro) shall not be claimed for reimbursement.

4.4.1 The existing emergency ambulance service and the system shall be
implemented in coordination with other agencies/ department like; Police,
Fire, medical, road transport, etc and to continue the smooth efficient
service without legal and operational complications.
4.4.2 Provide technological, leadership, administrative and managerial support
as the Partner in an open and transparent manner to produce mutually
agreed outcomes.
4.4.3 Maintain a suitable integrated solution including Computer Technology
Integration, Voice logger system, Geographic Information systems (GIS),
Geographical positioning systems (GPS), Automatic Vehicle Location &
Tracking (AVLT) Computer Aided Dispatch (CAD) and mobile
communication systems, by utilizing the existing Infrastructure.
4.4.4 In addition to above specific activities the bidder shall develop and
implement appropriate control mechanism to ensure;
(i) Optimal use of the infrastructure
(ii) Proper selection and training of human resources
(iii) Continuous performance monitoring and evaluation
4.4.5 Continue to Operate the Emergency Response Center (control room) for
24 hours through the dedicated toll free telephone number “108”. Shall
provide sufficient number of parallel lines with hunting facilities and
enhance upon the increase in number of calls receiving during the
contract period. Emergency Response Center may receive emergency call
of the nature of medical, police and fire fighting service.
4.4.6 Provide the required Application Software for the project. The successful

bidder shall also update the software periodically as per requirement.
4.4.7 Serve as a vital emergency management information and assistance
resource and raise societal awareness of, and capability in, Emergency
Management and Response mechanisms and thus save lives and reduce
the economic impact to the citizens, firms and the government through
appropriate awareness, education and capacity building programs.
4.4.8 Operate the existing ALS ambulances and ensure that ambulance services
are available on 24 hours per day to the general public of the two districts
Trivandrum and Alappuzha, without any charges being levied from the
public opting Government hospitals / healthcare institutions. Shall
maintain an average response time of 10 minutes for urban areas, 20
minutes for semi urban and 30 minutes for rural and difficult areas which
shall be a key performance parameter.
4.4.9 Provide Un-interrupted power supply facility to the Emergency Response
Center to provide un-interrupted services.
4.4.10 Currently the 25 ALS ambulances in Thiruvananthapuram district have
GPS/GPRS device on it. The GPS/GPRS device for the 18 ALS
ambulances in Alappuzha district has to be provided by the successful
bidder. The maintenance of the devices shall be the responsibility of the
successful bidder. The Emergency Response Center shall communicate
with all the ambulances by means of voice as well data. The data includes
the destination name, landmark and other relevant information shall flash
on the GPS/GPRS device monitor kept on each of the ambulance. The
device should also have facilities to log the status of emergency calls
attended by the ambulances to the control room for the purpose of
monitoring and evaluation.
4.4.11 In the event of multiple causality or major accident more than one

ambulance shall be deployed depending upon the condition within a
short time span.
4.4.12 Recruit, train and position the required man power, including Pilots
(drivers) and Emergency Medical Technicians [EMT] who will be present
in the ambulance while shifting an emergency case to a hospital. The
recruitment and training as per Annexure IX has to be completed prior to
the functioning of the project in these two districts without creating any
additional expense to Tender Inviting Authority.
4.4.13 Ensure that every ambulance shall have at least one Pilot and one EMT
present at any given point of time to provide patient-stabilization, first-aid
and other pre-hospital care. All the break-down and maintenance
problems of the Ambulance vehicles along with the renewal of Fitness
certificates are to be done by bidder at his cost.
4.4.14 Bidder shall replace at its cost all the missing tools or equipments from
these 43 ALS ambulances with tools and equipments of same
specification from the supplier of the ambulance equipments and tools in
the contract period at his cost.
4.4.15 Bidder shall meet all expenses towards insurance, Annual Fitness
certification, Maintenance, Minor & Major repairs, replacement of tyres,
batteries, other spare parts and consumables etc. of the 43 ALS
Ambulance vehicles during the contract period at his cost.
4.4.16 Provide daily (operational), monthly (administrative and financial)
reports and quarterly (fund utilization) statements of the operation to the
Tender Inviting Authority. Reports of any format as per the request of
Tender Inviting Authority shall be given by the bidder.
4.4.17 Attend periodical review meetings held by the Government or Tender
Inviting Authority (physically or virtually) for the assessment of the

4.4.21 Strive for continuous improvement in emergency management through
strategic partnerships, innovative programs, and collaborative policies.
4.4.22 Prepare the Standard Operating Procedure Framework (SOPF) for
Emergency Response Center in consultation with Tender Inviting
Authority.

4.5.1 The period of contract shall be for a period of six months and shall be
extendable on mutually agreed terms.
4.5.2 The KEMP service in Thiruvananthapuram and Alappuzha district shall be
taken over from the existing operating agency with effect from 00:00 hours
on 16th October 2013 after executing an agreement with the Tender Inviting
Authority.

4.6.3 The breakdown of ambulance while carrying patient shall be maintained
as far as possible to the minimum.
4.6.4 The GPS/GPRS device fixed in each ambulance should have 99% uptime
in a year.

of double the operating expense applicable for that time of the contract
for the entire fleet for the non-performing period will be deducted.
4.7.3 If the uptime of ambulances is not maintained as per clause 4.6.2, a
penalty of amount equal to double the operating expense applicable for
the time of the contract for the non performing ambulances for that period
will be deducted.
4.7.4 If the uptime of GPS/GPRS is not maintained as per clause 4.6.4, a
penalty of amount equal to the operating expense applicable for the time
of the contract for the non performing period above the uptime specified
will be deducted.
4.7.5 If the non-performance is less than 24 hours the deductions imposed will

4.7.6 In case of other defaults in services necessary action under terms of the
agreement will be initiated in addition to imposition of penalty considering
seriousness of the default. The fault shall be determined with reference to
the outputs and the State Level Committee set-up for overall supervision
and monitoring of KEMP will determine penalty.
4.7.7 The amount of penalty shall be recovered from the claims submitted by
the service provider. In the absence of any claim, it can be recovered from
the performance security deposit.

4.8.1 Service and Performance Standards to be maintained for Ambulances (to
be made as a part of the contract) – By successful bidder
4.8.1.1 All trips made by the 108 services are without user fee.
4.8.1.2 The Emergency response call center would link all the ALS ambulances,
emergency medical centers, police and fire departments in these districts.
4.8.1.3 Driver and EMT to Ambulance ratio to be at least 2.5::::1. i.e. 2.5 drivers
and 2.5 EMT per Ambulance.
4.8.2 Bidder shall maintain separate log books for vehicle and patient, stock
register and status register in all these 43 ALS ambulance with relevant
details in consultation with Tender Inviting Authority. Bidder shall also
implement any system which Tender Inviting Authority intends to
introduce.
4.8.2.1 Daily Ambulance maintenance protocol sheet filled could be noticed with
supervisor checking the sheet at least one in 15 days. (The Maintenance
sheet will include: Vehicle maintenance parameters like the
condition/level of engine oil, brake fluid and coolant level, clutch fluid,
condition of air filter, tyre pressure, oxygen level, fuel level, proper

working of siren, lights, charging of rechargeable equipments, and
availability of Drugs, Consumables and Equipment check sheet).
4.8.2.2 Drugs, consumable and equipment would be available in vehicle as per a
list specified by the Tender Inviting Authority. Standard emergency care
protocols would also be available.
4.8.2.3 Successful bidder should maintain record of all calls received, and those
who were responded to, the time to dispatch the ambulance, the time to
pick up and the time to reach the site of emergency care and provisional
diagnosis made, care provided en route and hospital where patient
dropped, as well as accredited hospitals who did not accept the patient.
4.8.2.4 Successful bidder should provide information to Tender Inviting Authority
as and when required.
4.8.2.5 Compliance to statutory requirements: Vehicle Registration, Pollution
Control, Driver License, payment of applicable tax, etc.
4.8.3 The ambulance has to reach the site of requirement within the response
time as specified under clause 4.4.8 of receiving such call at the
Emergency Response Center in 80% of the cases. It is clarified that non-
response to hoax calls, repeat calls, crank calls or calls that did not provide
an address for the Patient will not be taken into account while determining
adherence to Response Time standards by the Operator. Response Time
standards shall apply to all emergency ambulance requests requiring a
response as determined by the Emergency Response Center (ERC) using
call screening and dispatch protocols approved by the Tender Inviting
Authority and only such calls shall be used for the purposes of
determining response time compliance calculations.

4.8.4 Any delay in adhering to the Response Time and Patient Transport Time
standards shall be recorded and reported by the Operator to the Tender
Inviting Authority
4.8.5 Response Time calculations shall be calculated from the time a call is
received at the call centre,
(a) till the time Operator's ambulance arrives on the scene
(b) or is cancelled by the Emergency Response Centre (ERC).
(i) Time of Call Received- shall be defined as the time at which the
ERC has received a call through telephone or any other source (fire
service, police etc.).
(ii) Time of Arrival on Scene – shall mean the time at which an
ambulance crew (the driver) notifies the ERC that the ambulance has
reached the place of Patient.
(iii) In case of multiple response i.e. more than one vehicle arriving at
the scene, the response time shall be recorded for the first vehicle
arriving on scene.
(iv) Response time standards may be suspended in case of a multi
casualty incident or disaster in Kerala in case Tender Inviting Authority
calls on the vehicles to aid.
(v) Exceptions to Response Time Standards: It is the responsibility of
the Operator to apply for exceptions on a daily basis to the Tender
Inviting Authority. Exceptions shall be permitted in the following cases,
only it the Operator applies in time for exception on account of;

4.9.1 At least 80% of the calls that need an ambulance would have a response
time less than the response time standards mentioned in clause 4.4.8.
4.9.2 The Emergency Response center shall have on-line vehicle tracking which
refreshes the position of ambulance every 5 seconds.
4.9.3 All patients shifted on the KEMP should have received care as per
standard operating guidelines prepared for this purpose.
4.9.4 On receiving call of medical emergency, Emergency Response Center
should be able to track at least five nearest ambulances (which is ready to
take a patient) and shall communicate with the nearest ambulance and
the caller, and arrange to take the patient to the most appropriate and
nearest hospital for that type of emergency based on the list of facilities
with assured services. (If there are more than one appropriate site within
comparable distances, the patient or their attender would indicate their
choice, and the ambulance service could take them there).

4.9.5 On best effort basis, the concerned hospital should be informed in
advance. Any call requiring assistance from police or fire fighting
authorities shall be transferred accordingly.
4.9.6 All Calls should be picked up by the third ring and ambulances where
needed dispatched within 120 seconds.

4.10.1 A State level committee with Secretary (H&FWD) as Chairman will review
the performance.
4.10.2 A district level committee with District Collector as Chairman will review
the district level operation once in three months and submit the minutes
of the meeting to the State Level committee.
4.10.3 The services and records of the service shall be subject to inspection by
designated officer(s) of the Tender Inviting Authority. The set of records
submitted by the successful bidder would be verified by state level steering
committee.
4.10.4 The successful bidder will provide information on a limited set of
indicators stated by the State Level Committee as and when required.

4.11.1 The Tender Inviting Authority may, by a notice in writing suspend the
agreement if the successful tenderer fails to perform any of his obligations
including carrying out the services, provided that such notice of

4.11.1.2 Shall request remedy of such failure within a period not exceeding 10
days after the receipt of such notice.
4.11.2 The Tender Inviting Authority after giving 15 days clear notice in writing
expressing the intension of termination by stating the ground/grounds on
the happening of any of the events (4.11.2.1) to (4.11.2.4), may
terminate the agreement after giving reasonable opportunity of being
heard to the successful bidder.
4.11.2.1 If the successful bidder do not remedy a failure in the performance of his
obligations within 10 days of receipt of notice or within such further
period as the Tender Inviting Authority have subsequently approve in
writing.
4.11.2.2 If the successful bidder becomes insolvent or bankrupt.
4.11.2.3 If, as a result of force majeure, successful bidder is unable to perform a
material portion of the services for a period of not less than 30 days: or
4.11.2.4 If, in the judgment of the Tender Inviting Authority, the successful bidder
is engaged in corrupt or fraudulent practices in competing for or in
implementation of the project.
4.11.3 In the event of premature termination of the contract by the Tender
Inviting Authority on the instances other than non-fulfillment/ non-
performance of the contractual obligation by the successful bidder, the
balance remaining un-paid amount on account of operational
expenditure as on the day of termination shall be released within six
months from the date of such termination.

the decision of the Tender Inviting Authority is final.

4.13.1 Minimum experience of two years with in the period of last five years in
operating emergency ambulance services of any State Government in
India for the entire State or part of the State with a fleet of at least 25
ambulances supported by a centralised control room.
4.13.2 Should have experience in computer telephony integration with the ability
to log calls combined with geographical information system and GPRS
integrated system to facilitate quick dispatch of vehicles.
4.13.3 Should have comprehensive training system for service and supervisor
personnel in the implementation of the emergency response system.
4.13.4 Bidders who submit the requisite cost of the tender document and also
the EMD as DD or Bank Guarantee in the prescribed format/Bankers
cheque.
4.13.5 Bidders who have been blacklisted/ debarred by Tender Inviting Authority
or blacklisted / debarred by any State Government or Central Government
department/Organization should not participate in the tender during the
period of blacklisting.
4.13.6 Bidders should not be involved in any litigation that might have an impact
of affecting or compromising the delivery of services as required under this
tender.
4.13.7 Firm / company who have withdrawn after participating in any of the
previous tenders of KMSCL are not eligible to participate in this tender.

accepted as bid security and bid cost. Bid cost in the form of bank
guarantee shall also be not accepted.
4.16.5 Bid security of unsuccessful bidders will be discharged/returned as
promptly as possible as but not later than 30 days after opening of the
price bids by the Tender Inviting Authority.
4.16.6 The successful bidder's bid security will be discharged upon the bidder
signing the contract and furnishing the performance security. The bid
security of the successful bidder if furnished as DD can be adjusted
towards the security deposit payable.
4.16.7 No interest will be paid for the bid security amount submitted....

4.17.1 There will be a performance security deposit amounting to 5% of the
total value for 3000 kilometers per month for 43 ambulances for six
months which shall be submitted by the successful bidder to the Tender
Inviting Authority along with signing the agreement.
4.17.2 The performance security shall be in the form of Bank guarantee /
Demand Draft from any nationalized / scheduled bank in favour of “The “The “The “The

the agreement in Kerala stamp paper worth `100 and submit the
required performance security forthwith.
4.17.4 Failure of the successful bidder in providing performance security
and/or in returning contract copy duly signed in time shall make the
bidder liable for forfeiture of its bid security.
4.17.5 The Performance security shall be denominated in Indian Rupees or in
the currency of the contract as detailed below:
4.17.5.1 It shall be in any one of the forms namely Account Payee Demand
Draft or Bank Guarantee issued by a Scheduled bank in India, in the

emergency ambulances through a centralized control room with

years with in the period of last five years in operating emergency
ambulance services of any State Government in India for the entire State

geographical information system and GPRS integrated system to facilitate
quick dispatch of vehicles.

5.7.2 In the event of the specified date for submission of Tender being declared
holiday, the Tender shall be received up to the appointed time on the
next working day.
5.7.3 If the Tender is sent by Registered post or by Courier, it shall reach the
above office on or before the time and date stipulated for the receipt of
Tender documents. The Corporation shall not be held liable for the delay
in transit where the Tender documents are sent by post or courier.
5.7.4 The Corporation may, at its discretion, extend the deadline for submission
of Tender by amending the Tender Document, in which case, all rights

5.14.2. The successful bidder, upon receipt of the work order, shall furnish the
required performance security and submit an agreement which shall be
finalized after award of contract with the successful bidder, failing which
the bid security will be forfeited and the award will be cancelled.

5.15.1. The successful bidder shall execute an agreement which can be finalized

5.16.1. The contract shall be governed by and interpreted in accordance with
the laws of India for the time being in force.

previous bids floated by the Corporation and given a declaration of
acceptance but have subsequently violated any of the said Terms and
Conditions and for which no other penalty is specified in the Tender
Terms and Conditions will be deemed to have indulged in
unacceptable/unfair tender practices. The Corporation will not consider
bids offered by such concerns for a period upto two years from the date
of the breach/violation of the aforesaid conditions. Any bidder
aggrieved by any decision of the Corporation holding them guilty of
unacceptable/ unfair tendering practices can file an Appeal against the
said decision to the Secretary to Government, Health Department,
Govt. of Kerala who will consider and pass Orders on the Appeal after
giving a reasonable opportunity of hearing to both sides. The decision
of the Secretary to Government on the Appeal will be final and binding.

5.16.3. Any and all disputes arising out of this tender will be subject only to the
jurisdiction of courts of law / tribunals situated in Thiruvananthapuram
City or normally having territorial jurisdiction over
Thiruvananthapuram City only, or the High Court of Kerala as
applicable. It is possible that jurisdiction to file disputes may be
available before courts of law, including High Courts, or tribunals
situated elsewhere. However, considering the limited resources of the
Corporation, the bidders should specifically agree and covenant not to
file any legal proceedings before any such courts of law/tribunals and
should undertake and bind themselves to initiate and carry on legal
proceedings in respect of this Tender exclusively before the courts of
law/tribunals situated in or normally having territorial jurisdiction over
Thiruvananthapuram City, or the High Court of Kerala as applicable.
Any bidder who violates these conditions will be held to have indulged
in an unacceptable/unfair tendering practice and will be deemed
ineligible to participate in any of the bids of the Corporation for a
period of three years from the date of the breach/violation of the
aforesaid conditions....

5.17.1 For purposes of this clause, Force Majeure means an event beyond the
control of the successful tenderer and not involving the successful
tenderer’s fault or negligence and which is not foreseeable and not
brought about at the instance of , the party claiming to be affected by
such event and which has caused the non – performance or delay in
performance. Such events may include, but are not restricted to, acts of
the Tender Inviting Authority/User Institution either in its sovereign or
contractual capacity, wars or revolutions, hostility, acts of public enemy,
civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine
restrictions, strikes excluding by its employees , lockouts excluding by its
management, and freight embargoes.
5.17.2 If a Force Majeure situation arises, the successful tenderer shall promptly
notify the Tender Inviting Authority/User Institution in writing of such
conditions and the cause thereof within twenty one days of occurrence of
such event. Unless otherwise directed by the Tender Inviting
Authority/User Institution in writing, the successful tenderer shall continue
to perform its obligations under the contract as far as reasonably practical,

and shall seek all reasonable alternative means for performance not
prevented by the Force Majeure event.
5.17.3 If the performance in whole or in part or any obligation under this
contract is prevented or delayed by any reason of Force Majeure for a
period exceeding sixty days, either party may at its option terminate the
contract without any financial repercussion on either side.
5.17.4 In case due to a Force Majeure event the Tender Inviting Authority/User
Institution is unable to fulfill its contractual commitment and responsibility,
the Tender Inviting Authority/User Institution will notify the successful
tenderer accordingly and subsequent actions taken on similar lines
described in above sub-paragraphs.

a. Patient’s cabin ergonomically designed and fabricated with FRP ( Fiber Reinforced Plastic ) and having a 3 layered section consisting of FRP, PUF, thermocol to have a noise free atmosphere and maintain the internal temperature. The panels are fire retardant, fully washable, have highest tensile stress to weight ratio. Made of medical lgrade which withstand corrosion caused by fumigation chemicals.
b. Designed to provide adequate comfort, space and safety for patient and patient’s attendant. Seat belts and restrains provided for every seat.
c. Overhead racks provided for storage of stocks with hydraulic doors which ensure that during fast movement, the doors of the cabinet do not open out.
d. The ambulance interiors designed with care to avoid injuries by fall of equipment or cylinder on persons inside the ambulance in case of turmoil due to bad road conditions.
e. Adequate space provided for storing medicines necessary for one week consumption in racks made of plywood coated with cold rolled non corrosive chemical resistant steel finish for easy cleaning and elegant look in addition to maintaining sterile condition.
f. Waste disposal done with the help of 2 steel dustbins demarcated into bio hazardous and non bio hazardous.
g. There is provision of wash basin with foot operated control for hygienic washing of hands without touching of tap.
h. Direct and diffused lighting for optimal patient’s comfort and provided with spot and focused lighting and special examination lights for the clinician to undertake “procedures” during transport.
i. The A/c power supply from the inverter which is fed by the high powered alternator of 90 amps which runs on engine power or solar power. An additional battery is provided for a back up of 4-5 hours which is continuously charged by this inverter while the vehicle is in motion and when not in motion the battery is powered by solar panel. Adequate power supply for medical equipment and other electronic equipments is provided with both 12 Volts DC and 220 Volts A/c. Anti Static flooring should be provided for safety.
j. Provision of hooks for hanging IV bottles on the roof. k. Syringe destroyer for disposal of Sharp wastes and needles. All equipments placed
