In order to assist you with the NotificationStage, Council has enclosed a list of Consultants whoare familiar with the procedures involved in undertaking the Statutory Advertising Process. Shouldyou not be familiar with the process, Council encouragesyou to engage one of these Consultants forthe purposes of compliancewith the SustainablePlanning Act 2009 (SPA).
Also, to assist with the process, Council has enclosed the adjoining property owner's postaldetails that must be notified of the proposed development in accordance with Section 297 of theSPA
2 NOTIFICATIONPERIOD FOR APPLICATIONS
The notification period for the applicationmust be at least-

(a) 30 business days starting on the day after the last action under section 297(1) of SPA iscarried out, if any of the following apply for the application -a. There are 3 or more concurrence agencies;
b. All or part of the development-i. Is assessableunder a planning scheme; andii. Is prescribedunder a regulationfor this subparagraph;
c. All or part of the development is the subject of an application for a PreliminaryApproval mentioned in section 242 of SPA; OR
If paragraph (a) above does not apply - 15 business days starting the day after the last actionunder section 297(1) is carried out.
The notificationperiod must not include any businessday from 20 December in a particularyear to 5January in the following year, both days inclusive.
3 REQUIREMENTS FOR PARTICULAR NOTICES
The Notice mentioned in section 297(1) of the SPA must be in the approved form.
The Notice placed on the land must remain on the land for all of the notification period.
All actions mentioned in section 297(1) of the SPA must be completed within 5 business days afterthe first of the actions is carried out.
4 REQUIREMENTSTO GIVE THE ASSESSMENTMANAGERNOTICE
The person who carries out notification (Applicant / Consultant) must, within 5 business days afterthe day the last of the actions mentioned in section 297(1) is carried out, give the AssessmentManagerwritten notice of the day the last of the actions is carried out.
Please note: Somerset Regional Council requires the date the applicant or Consultantintendsto commenceand finalise the notification period, inclusive of the newspapernameand date. This advice will enable Council Officers to prepare the Scrutiny Files required foreach of the Council Offices - Esk Administration Office; Kilcoy Administration Office andLowood Library Office.
5 NOTICEOF COMPLIANCETO BE GIVEN TO ASSESSMENTMANAGER
Pursuant to section 301 of the SPA, the applicant or Consultantmust within 20 business days afterthe notification period ends give the Assessment Manager written notice that the applicant /Consultant has complied with the requirementsof Division 2 - Public Notificationof the SustainablePlanningAct 1009.
6 APPLICATIONLAPSES
Pursuant to section 302 of the SPA, an application to which the NotificationStage applies lapses if -(a) The last action under section 297(1) of SPA is not carried out before the end of 20 businessdays after the applicant was entitled to start the notification stage or the further periodagreed between the assessment managerand the applicant; OR
(b) The applicanthas not compliedwith section 301 within the period stated in the section or thefurther period agreed between the assessmentmanagerand the applicant.
REVIVAL PERIOD
Pursuant to section 303(1) of the SPA an application may be revived within 5 business days, afterthe application would otherwise have lapsed, by the applicant giving the assessment managerwritten notice that the applicantseeks to revive the application.
If the application is revived and section 302(1)(a) of the SPA applies to the application, the applicantmust within 10 businessdays after giving the revival notice or the further period agreed between theassessmentmanagerand the applicant, carry out the actions under section 297(1) of SPA.
If the application is revived and section 302(1)(b) of the SPA applies to the application,the applicantmust within 5 business days after giving the revival notice or the further period agreed between theassessment managerand the applicant, comply with section 301 of SPA.
