To advise Councillors of Council’s processes, status and recent actions in relation to issues of health and safety.
Staff Recommendation
It is recommended that the report be received.
Report Discussion
Regulations WorkSafe has produced guidance documents around asbestos and new protocols have come into force. Also available are interpretive guidelines on the General Risk and Workplace Management regulations. Compliance Every 12 months Council’s water treatment plants are inspected by an independent HSNO compliance specialist. All sites have complied and been issued with Location Certificates. Quotes have been received and work is due to commence at the three Otorohanga stormwater pump stations (Huiputea, Mair, Otewa). Work includes installation of safety railing around the pumps, fencing around the site, signage. Auditing
Council staff continue to audit contractors and internal events to ensure safety compliance. Job Safety Analysis A generic process has been introduced and is being following by all staff working on job sites. This form encompasses the “tool box” meeting pre-job, assessment of hazards on site and visitor induction.

Work Related Accidents and Incidents During this six month period August 2016 to February 2017 the following accidents/incidents have been reported:

Staff Wellness No wellness events have been held. Staff are participating in the “Stay Connected” events. Emergency Evacuation Exercise An emergency response exercise was undertaken at the Otorohanga Water Treatment Plant on 7 February. Fleet The annual fire extinguisher checks were carried out in September. Minor tyre damage occurred when a vehicle scraped the edge while parking – no repair required. Health & Safety Representative Meetings Staff elections have been held to get a fair representation of the work groups within Council. A meeting was held in October, but due to resignations and elections, the next meeting was held on 1 March (outside this reporting period).

Asbestos update Waikato-BOP Health & Safety Forum – 22 February 2017 This event was hosted here in Otorohanga:
WorkSafe inspector in attendance to answer questions;
Lone Workers – presentation on the Spot Gen3 Lone Worker Device Local Authority Shared Services (LASS) Health & Safety Working Party – 6 October 2016 and 27 January 2017. This group of Health & Safety Advisors from the Waikato are meeting every second month. They are working on a number of shared projects across the Waikato Councils, including: training; health and safety computer programme; researching Councils’ liabilities regarding community events; consistent KPIs; auditing; and policies. They are also working collaboratively with the LASS BOP Working Party. LASS Project – Contractor Health & Safety Pre-Qualification This project has been rolled out across the Waikato/BOP Councils that wish to utilise it. ITEM 46 APPOINTMENT OF THE INDEPENDENT COMMISSIONER - OSTERN QUARRIES LIMITED

Executive Summary
Ostern Quarries Ltd has lodged a land use consent application to operate and expand their exiting quarry on Otorohanga Road, State Highway 3 south of the Te Kawa Crossroads. The applicant has also lodged consent applications with Waikato Regional Council for seven consents related to this activity. A combined hearing will be held in Otorohanga to consider these matters. Dr Phil Mitchell has been selected as the independent commissioner by both Councils to hear and decide the consent applications. He will be a member of a joint hearing panel that includes two other commissioners appointed by the Waikato Regional Council and Waikato River Authority to hear the seven consent applications for earthworks, air and water discharges.
Staff Recommendation
It is recommended that:
Pursuant to Section 34A of the Resource Management Act 1991 independent commissioner Phil Mitchell be appointed as the Hearing Commissioner for the purposes of hearing and making a decision on the resource consent application for Ostern Quarries Ltd as detailed below. This delegation includes hearing and considering the submissions lodged on the resource consent application and dealing with any procedural issues prior to delivering the decision on the resource consent.
Report Discussion
The application from Ostern Quarries Ltd is described in brief as ‘the continuation and expansion of existing quarry activities involving the excavation, sorting, processing and deposition / stockpiling of rock and overburden, and subsequent transport of saleable product from the site and associated activities including the provision of staff facilities and operation of plant and machinery’.
Dr Mitchell is a principal in the Resource Management and planning consultancy firm Mitchell Daysh. His selection as Commissioner is due to his extensive experience in resource management issues which has seen him appointed to serve on the Government’s Resource Management Act Technical Advisory Group. His CV includes an extensive list of projects that he has heard in his role as an independent commissioner. This work covers all of New Zealand and includes the following recent work in the Waikato region;
