Re: Resolution 30-20 – Bid Acceptance for Cosgray Ditch - Phase 1
Summary
On May 19, 2020, ten (10) bids were received, publicly opened, and read by Engineering staff for the Cosgray Ditch - Phase 1 project, also identified as the Rings Farm Stream Relocation in the 2020-2024 Capital Improvements Program. Work included in the Cosgray Ditch - Phase 1 project consists of the relocation of approximately 2,700 lineal feet of Cosgray Ditch. This project is located on a 72-acre parcel owned by the City, at 6600 Shier Rings Road. Relocation of the ditch (stream) is necessary to accommodate the relocation/realignment of Shier Rings Road (now University Boulevard - Phase 2) as part an Economic Development Agreement (EDA) with The Ohio State University (OSU) for the construction of an ambulatory care medical facility scheduled to open in 2022 along the north side of University Boulevard. Phase 2 of the ditch work will consist of the realignment of the eastern end of Cosgray Ditch along the south side of Shier Rings Road adjacent to the Dublin City School property and will be performed as part of the construction of the University Boulevard - Phase 2 project. A copy of the Cosgray Ditch - Phase 1 construction drawings and illustrative exhibits have been placed in the Council Planning Room for Council’s reference and review.
The Engineer’s estimate for this project is $1,375,000. The budgeted funds for the Cosgray Ditch - Phase 1 project in the 2020-2024 Capital Improvement Program are $1,240,000.00 in account EF181, Rings Farm Stream Relocation. Pursuant to the EDA, OSU is responsible for 32.5% of the actual cost of the Cosgray Ditch relocation.
Miller Bros. Construction, Inc. submitted the lowest and best bid of $1,027,590.20. Staff has reviewed all bids and a summary of the bids received is listed below.

Staff is currently working to obtain the necessary regulatory permits from the Ohio Environmental Protection Agency (OEPA) and the U.S. Army Corp of Engineers (USACE). On May 7, 2020, the OEPA issued the Section 401 Water Quality Certification for this project. Staff expects to receive the Section 404 Permit from the USACE in June 2020. The permits will cover both phases. In order to comply with the Section 401 permit, the project is required to install a minimum of 400 native, live and healthy woody plants per acre.
The intent of the landscaping and planting plan associated with the Cosgray Ditch work is to reestablish the riparian corridor along the relocated stream, provide a natural wildlife habitat and create erosion resistance along the banks of the restored ditch. A secondary benefit is the creation of a buffer between the residential neighborhood south of Shier Rings Road and the development along University Boulevard. While it will take some time for the tree species to mature, the variety of species included will provide various heights and produce a riparian buffer.
To increase the survival and sustainability of the plantings, the plant material selected will be native to the area and be placed in a more natural and random pattern. These native plants will enhance the riparian corridor with a native food source and provide habitat to which the local fauna are accustomed. Furthermore, the plantings initially installed will be of different sizes intended to mature at various rates helping to emphasize this as a more naturally occurring riparian zone. Overall, the designed plant palette will provide a sound and sustainable riparian waterway ecosystem.
Work is planned to be substantially complete in late September 2020 with final completion in December 2020.
Communications with Residents and Motorists
The following communication methods will be used to communicate construction information with the residents and motorists throughout the duration of this project.

Social media channels are used to communicate timely construction updates. When appropriate, portable message board signs are used for construction notification on
adjacent streets and roadways.
Recommendation
Staff has thoroughly reviewed the Miller Bros. Construction, Inc. bid. This contractor has not performed work for the City of Dublin; therefore, staff made inquiries with references of Miller Bros. Construction, Inc. and received positive feedback regarding their work. Staff recommends Council approval of Resolution No. 30-20 accepting as lowest and best the bid of Miller Bros. Construction, Inc. in the amount of $1,027,590.20 and authorizing the City Manager to enter into a contract with Miller Bros. Construction, Inc. for this project.

A RESOLUTION ACCEPTING
THE LOWEST AND BEST BID FOR THE COSGRAY DITCH - PHASE 1 PROJECT
WHEREAS, formal advertising and competitive bidding procedures have been conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the Dublin Code, for the Cosgray Ditch - Phase 1 project; and WHEREAS, Council has determined that the bid submitted by Miller Bros. Construction, Inc. constitutes the lowest and best bid. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, _______ of its elected members concurring, that: Section 1. The bid submitted by Miller Bros. Construction, Inc. in the total amount of $1,027,590.20 is hereby accepted. Section 2. That the City Manager is hereby authorized to enter into contracts with Miller Bros. Construction, Inc. for performance and completion of the Cosgray Ditch - Phase 1 project pursuant to the Advertisement, Proposal and Contract Documents for said project on file in the office of the City Engineer. Section 3. This Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all other agreements and instruments and to take any other actions as may be necessary to implement this Resolution and complete the Project. Section 4. This Resolution shall take effect upon passage in accordance with Section 4.04(a) of the Revised Charter. Passed this ________ day of __________________, 2020.
