NOTICE OF INTENTION TO CIRCULATE A RECALL PETITION

To the Honorable James F. Penman, City Attorney, City of San Bernardino: Pursuant to theCalifornia Constitution, the Charter of the City of San Bernardino includingArticle VII, Sec. 122 thereof,and Californiaelection laws, the undersigned registered qualifiedvoter ofthe City of San Bernardino, inthe Stateof California, does herebygive noticethat I am a proponentof a recall petitionand intend to seekyour recall andremoval from the office of CityAttorney of the City of SanBernardino, California, andtodemand election ofa successor in that office.

The groundsfor the recall are as follows: Mr. Penmanis the duly elected City Attorney, and assuch is accountable for the actions of that office and of his subordinates. Mr. Penman has been derelict inhis official duties by failing to properly enforce the law regarding personal use of public property bymembers ofthe Common Council. In addition, Mr. Penman's office's selective enforcement of Citycodes and his failure to timely update and codify city codes, ordinances, and other matters lawfully passedby the City Council has createdconfusion and insecurity in the City's residentsand businessesregardingaccuracy of the City's published law.

Pursuant to Article VII, Section 122 ofCharter ofthe City of San Bernardino, a copy of this noticeand proofof service will be filed with the City Clerk of the City of San Bernardino. Within seven (7) daysafter this Notice is filed the officer sought to be recalled may file with the City Clerk an answer, in notmore than 500 words, to the statement of the proponents. If an answer is filed, a copy of it must be servedon one of the proponents, personally or by certified mail, within the same seven (7) day period, and if it isto be published, at the same time shall file with the City Clerk a statement declaring his/her intent that theanswer be published. The answer shall have printed name, signature, and residence address of the officerto be recalled.
