H e t o l d t h a t a s i g n i f i c a n t amount of H e l e n a ' s costs are those mandated by t h e l e g i s l a t u r e . They a r e r i g h t up t o t h e i r m i l l l e v i e s and have had t o l a y p e o p l e o f f because t h e y d i d n o t have enough money t o pay them.

STATE R E V E N U E SHARING L E G I S L A T I O N

We hear a l o t about revenue shar ing from s t a t e and local p o l i t i c i a n s . I t ' s

always popular p o l i t i c a l l y t o t e l l your c o n s t i t u e n t s t h a t they a r e going t o g e t

something f o r nothing. The impi ica t ion always i s t h a t someone e l s e i s going t o

pay t h e b i l l and you a r e going t o b e n e f i t . This i s a National d i s e a s e , because

s h i f t i n g the c o s t of governnlent t o the next h i she r l eve l i s a p o l i t i c i a n s d e l i g h t .

For l oca l governments t o g e t money froni s t a t e governnlents a1 1 ows 'iocal pol i t i c i a n s

t h e p l easu re of spending the money without t he agony of fac ing the vo te r s and i n c r e a s i n s

proper ty t axes . So we s e e county, c i t y and pub1 i c school l o b b y i s t s going t o t he

l e g i s l a t u r e wanting s t a t e revenue shar ing so they d o n ' t have t o f a c e the voters a t

home with increased t a x e s .

And t h a t ' s popular because i t l eaves the inlpl i c a t i o n t h a t someone e l s e i s

going t o pay t h e b i l l . So i t i s with the Montana l e g i s l a t u r e . House B i l l 125

i s an a c t t o e s t a b l i s h the Montana S t a t e Local Revenue Sharing Program t o provide

f o r t h e a l l o c a t i o n of money t o mun ic ipa l i t i e s and coun t i e s and t o l e t the Depart-

ment of Community A f f a i r s do t h e d i s t r i b u t i o n . The money would b e app ropr i a t ed

back t o coun t i e s and c i t i e s on the bas i s of populat ion without regard t o need,

wi thout regard t o t a x base and wi thout regard t o whether l oca l governments were

being run e f f i c i e n t l y o r i n e f f i c i e n t l y .

Don' t f o r g e t bas i ca l l y the same people pay the property t a x e s , income

taxes and o t h e r l e v i e s iniposed by s t a t e and loca l government. Sa when you z r e

t a l k i n g about tax ing the o the r guy, the o t h e r guy i s r e a l l y you. The c i t y govern-

ments have an ou t . If they r ea l l y need niore niorley to spend they can go to the I

voter and under present law ask the people to vote a n addit ional 5 mi l l s f o r c i t y

operat ion. B u t the c i t i e s and towns are not very in teres ted in going t h i s route .

Th2y want t o be a b l e t o tax without voter approval.

Where i s t h i s revenue sharing supposed t o corne from? The b i l l doesn ' t speak

of t h a t . I t only es tab l i shes the framework in case some ready cash comes aiong.

B u t we know froni statenients nlade by the League of C i t i e s and Towns t h a t they

would l i k e to ra id the personal inconi? tax by some $14 niillion do l l a r s a year .

I t i s apparent t h i s proposal has much more to do w i t h increasing the

expenditures of governnlent than i t does helping the taxpaying c i t i z ens of t h i s

s t a t e .

We urge the defeat of t h i s proposal.

Over t h e p a s t y c a r , t h e Department has submi t ted a number o f sug- g e s t i o n s t o t h e In t e r im Subcommittee on Subd iv i s ion Laws. The B i l l w l~ ich t h e Subcommittee has proposed f o r t h e Amendment of t h e S a n i t a t i o n i n Subdiv is ions Act, HB 81, has incorpora ted , i n p a r t , a number o f t h e s e sugges t ions .

In s t ead o f c i t i n g a11 of t h e changes which we suppor t , w e w i l l discuss o n l y t h e major clianges.

Throughout t h e Act t h e r e i s r e f e r e n c e t o "subdiv is ion c e r t i f i c a t e o f survey" i n a d d i t i o n t o "plat" . Th i s i s done t o make t h e Act ' s r e f e r e n c e t o t h e documents which we review c o n s i s t e n t w i th a l r e a d y e x i s t i n g S e c t i o n s which recognize t h a t o u r a u t h o r i t y ove r d i v i s i o n s which may be recorded on c e r t i f i c a t e s o f survey . The Depar;ment has had review a u t h o r i t y ove r a number of such d i v i s i o n s s i n c e 1975. The word "sub- d iv i s ion" was added t o " c e r t i f i c a t e o f survey" t o nake i t c l e a r t h a t our review a u t h o r i t y i s l i m i t c d only t o t h o s e c e r t i f i c a t e s o f survey which - d e f i n e a s u b d i v i s i o n and not t o a l l c e r t i f i c a t e s o f survey. For i n s t a n c e , we would not want t o review c e r t i f i c a t e s o f survey which a r e merely re t racement s o f e x i s t i n g su rveys . The proposed amendment recognizes t h a t s i t u a t i o n a s beyond t h e a u t h o r i t y of t h e Department 's review.

Admin i s t r a t i ve Enforcement (1ICA 76-4-108)

The Department has recommended changes i n t h e Act 's enforcement p rov i s ions . F i r s t , t h e Department recommended changes i n t h e adminis t ra - t i v e remedy a v a i l a b l e t o i t . As a m a t t e r o f p r a c t i c e , a d m i n i s t r a t i v e remedies a r e g e n e r a l l y des igned t o p r o v i d e a rcmedy which i s e a s i l y invoked and whose s a n c t i o n s a r c merely c o r r e c t i v e , and not p u n i t i v e . They a r e l e s s d r a s t i c and l c s s onerous t h a n remedies which r e q u i r e a p p l i c a t i o n t o d i s t r i c t c o u r t e i t h e r f o r p e n a l t i e s o r i n j u n c t i o n . The p r c s e n t a d m i n i s t r a t i v e remedy, r c q u i r e s a schedul ing , a t t h e o u t s e t , o f a fu l lb lown con te s t ed c a s e h c a r i n g p r i o r t o t h e i s suance o f any o rde r . Thc problem w i t h t h i s procedure is t h a t , f o r minor v i o l a t i o n s which might r e a d i l y be cured, t h e s c a l e of t h e enforcement i s so c o s t l y and t imc consuming a s t o be p r o h i b i r i v e . E f f e c t i v e l y , t h e p r e s e n t rcmedy, f a r from be ing one which a l lows f o r r e l a t i v e l y exped i t i ous remedy of minor v i o l a t i o n s , i t c r e a t e s a mechanism which makes p u r s u i t o f minor v i o l a t i o n s s o cumbersome and t imc consuming a s t o be p r o h i b i t i v e .

In response t o t h i s problem, t h e Subcommittee h a s proposed an amend- ment which a l lows t h e Department t o d c s c r i h e t h e a l l e g c d v i o l a t i o n with which i t i s concerncd and t o p r c s c r i b e t h e c o r r c c t i v e a c t i o n which nceds

t o be taken. If t h e a l l e g c d v i o l a t o r f e l t t h e Department's p o s i t i o n i s . i n c o r r e c t h c may r e q u e s t a hca r ing b e f o r e t h e Eoard o f i i ea l th and Environmental Sc iences t o p l ead h i s ca se . Thus, t h e v i o l a t o r ' s p rocedura l r i g h t s a r e f u l l y p r o t e c t e d , should h e wish t o c o n t e s t t h e Department 's a c t i o n s , b u t t h c way i s l c f t open f o r a much more e x p e d i t i o u s r e s o l u t i o n of t h e problem should t h e a l l e g c d v i o l a t o r wish t o merely c o r r e c t t h e problem.

Th i s amendment i s modeled a f t e r a s i m i l a r p r o v i s i o n i n t h e Montana Water P o l l u t i o n Cont ro l Act which has been used wi th considera1)le succes s i n d e a l i n g wi th widespread minor v i o l a t i o n s . The u s e o f t h i s kind of p r o v i s i o n should s c a l e down t h e c o s t o f bo th enforccrnent and compliance t o a l e v e l c o n s i s t e n t wi th t h e s c v c r i t y o f t h e v i o l a t i o n .

P c n a l t i e s (biCA 76-4-108)

The second major change which t h e Department has proposed i s i n t h e a r e a of p e n a l t i e s . C u r r e n t l y , t h e Act i n d i c a t e s t h a t any body v i o l a t i n g t h e Act nay bc g u i l t y of an o f f e n s e and s u b j e c t t o a f i n e . F ines can only be sought by c o u n t y . a t t o r n e y s . The d i f f i c u l t y wi th t h i s p a r t i c u l a r p c n a l t y s e c t i o n i s t h a t , very o f t e n , county a t t o r n e y s , because of t h e i r d i v e r s e and sometimes heavy work loads , p l a c e a low p r i o r i t y on v i o l a t i o n s of t h e S a n i t a t i o n i n Subd iv i s ions Act. Also , ve ry o f t e n , i f a v i o l a t o r h a s succeeded i n g e t t i n g t h e c l e r k and r e c o r d e r t o f i l e a c e r t i f i c a t e of su rvey improperly t h e c l e r k and r e c o r d e r ' s a c t i o n , however u n w i t t i n g l y , is a l s o unlawful . As a r e s u l t i t makes it v e r y d i f f i c u l t f o r a county a t t o r n e y ' s o f f i c e t o go a f t e r c r imina l p e n a l t i e s . Also, people a r e l o a t h e t o a t t a c h t h e s t igma of c r i m i n a l i t y t o v i o l a t i o n s of t h e S a n i t a t i o n i n Subd iv i s ions Act .

Accordingly, t h e Subcommittee, a t t h e Department 's u rg ing , proposes a c i v i l p e h a l t y s e c t i o n , aga in modeled l a r g e l y upon t h e Clean A i r Act and t h e Wafer P o l l u t i o n Cont ro l Act. The purpose of t h e C i v i l Pena l ty S e c t i o n isito prov ide some p o s i t i v e inducement t o t h o s e who nay consider v i o l a t i n g t h e Acts . Right now, t h e r e i s l i t t l e danger of s u f f e r i n g any k ind o f monetary p e n a l t y . The on ly a c t i o n which t h e Department is a u t h o r i z e d t o b r i n g a t t h i s t ime i s an a c t i o n f o r i n j u n c t i v e r e l i e f compell ing compliance wi th t h c law. Thus, i f a person w i s l ~ e s t o v i o l a t e t h e Act a t t h i s t i n e , he may do s o w i t h t h e knowledge t h a t probably t h e worse s a n c t i o n he f a c e s i s an a c t i o n f o r i n j u n c t i v e r e l i e f t e l l i n g him t o comply w i t 1 1 t i le law. Thus, upon r e c e i v i n g a complaint f o r i n j u n c t i v e r e l i e f he need merely come i n and a g r e e t o comply r e g a r d l e s s of enormity of h i s v i o l a t i o n . Thus, t h e Departnent must spcnd c o n s i d e r a b l e t ime and money i n p r e p a r a t i o n o f a s u i t a g a i n s t a v i o l a t o r , and t h e v i o l a t o r has no inducement t o comply wi th t h e law s i n c e , t h e on ly p e n a l t y , should he be caught , would b e compliance wi th t h e law. Accordingly, t h e Department suppor t s t h e amendment f o r a c i v i l p e n a l t y f o r which t h e Department could seek an a c t i o n . Under t h e c i v i l p e n a l t y s e c t i o n t h e Department cou ld , . i n a d d i t i o n t o seeking i n j u n c t i v e r e l i e f t o compel compliance wi th t h e law, a l s o ask t h a t t h e c o u r t l evy a c i v i l p e n a l t y . T h i s provides

some d e t e r r e n t t o t h e would-be v i o l a t o r who would o t h e r w i s e want t o gamble on g e t t i n g c a u g h t , w i t h o u t add ing t h e stign;; of c r i m i n a l i t y t o t h e enforcement a c t i t s e l f . I t would be an a l t e r n a t i v e t o t h e c r i d n a l p e n a i t y .

F i n a l l y , t h e Department w i s h e s t o e x p r e s s i t s o p p o s i t i o n t o t h e proposed l a n g u a g e on page 8 , l i n e s 7-12. T h i s s e c t i o n p roposes t o award a t t o r n e y s f e e s t o anyone who p r e v a i l s i n an a c t i o n f o r i n j u n c t i v e r e l i e f . C u r r e n t l y , t h e r e is n o t h i n g i n S a n i t a t i o n i n S u b d i v i s i o n Act o r anywhere e l s e i n t h e MCA whicn a u t h o r i z e s t h e award o f a t t o r n e y s f e e s . L o g i c a l l y , i f a p a r t y b r i n g s an a c t i o n i n good f a i t h and l o s e s , h e s h o u l d n o t b e s u b j e c t t o a t t o r n e y s f e e s . T h i s s a n c t i o n makes i t d i f f i c u l t , i f n o t i m p o s s i b l e , f o r a bureau c h i e f t o p l a n a b u d g e t , s i n c e i t i s i m p o s s i b l e t o a b s o l u t e l y p r e d i c t such an award. Thus, i t s e r v e s a s a d e t e r r e n t t o t h e v i g o r o u s enforcement which is l a c k i n g i n t h e Act now. Accord ing ly , w h i l e i t might be a rgued t h a t t h e Department would b e d e t e r r e d from t h e i n d i s c r i m i n a n t f i l i n g o f s u i t s by t h i s s e c t i o n , t h e E e p a r t m e n t ' s

, h i s t o r y o f l i t i g a t i o n does n o t s u p p o r t any s u g g e s t i o n . By t h e v e r y n a t u r e o f i t s l i m i t e d s t a f f and heavy work l o a d , t h e Departrrent must choose i t s c a s e s c a r e f u l l y . Thus, a p o s i t i v e inducement t o c a r e f u l and w e l l - c o n s i d e r e d f i l i n g o f c a s e s a l r e a d y e x i s c s . Accordingly , t h e Department a s k s t h a t t h i s s e c t i o n b e s t r i c k e n .

Review A u t h o r i t y t o Local Governments (MCA 76-4-128)

- s e c t i o n 12 h a s c o m p l e t e l y r e o r g a n i z e d t h e D e p a r t n e n t ' s d e l e g a t i o n o f r e v i g w a u t h o r i t y t o l o c a l governments. Those s u b d i v i s i o n s which t h e l o c a l govern ing body can r e v i e w havebeen expanded t o i n c l u d e n o t o n l y s u b d i v i s i o n s c o n t a i n i n g f i v e o r f e w e r p a r c e l s w i t h i n d i v i d u a l w a t e r and sewer , b u t a l s o s u b d i v i s i o n s c o n t a i n i n g p a r c e l s t e n a c r e s o r l a r g e r i n s i z e when e a c h p a r c e l has i n d i v i d u a l w a t e r and sewer .

S u b s e c t i o n 2 a d d r e s s e s t h e i n f l u e n c e o f t h e Montana Environmental P o l i ~ y A c t , w i t h i t s r e q u i r e m e n t s o f p r e l i m i n a r y env i ronmenta l review o r e n v i r o n m e n t a l impact s t a t e m e n t s , upon the s u b d i v i s i o n r e v i e w p r o c e s s . I f a - s u b d i v i s i o n is go ing t o i n c l u d e t e n o r more p a r c e l s t h e l o c a l govern ing body w i l l n o t i f y t h e Department i n c a s e t h e r e is t h e n e c e s s i t y o f do ing an env i ronmenta l i m p a c t s t a t e m e n t . S u b s e c t i o n 3 r e c o g n i z e s t h a t i f t h e l o c a l govern ing body does n o t take c o c g l e t e r e v i e w a u t h o r i t y o v e r from t h e Department t h e n i t must a d v i s e t h e Department o f i t s recommendation f o r a p p r o v a l o r d i s a p p r o v a l . T h i s p r o v i s i o n i s l a r g e l y t h e same as what i s i n t h e e x i s t i n g law. S u b s e c t i o n 4 a l l o w s t h e govern ing body t h e o p t i o n o f t a k i n g f u l l r ev iew a u t h o r i t y f o r t h e s u b d i v i s i o n s d e s c r i b e d i n t h i s s e c t i o n . I t r e q u i r e s , however, t h a t i f t h e l o c a l govern ing body assumes t h a t a u t h o r i t y t h a t i t would a l s o a c c e p t l e g a l r e s p o n s i b i l i t y f o r t h e d e c i s i o n s t h a t i t makes u n d e r t h a t a u t h o r i t y .

Fees f o r t h e Review o f S u b d i v i s i o n s i n Mzster-Plan Areas

,The House h a s d e l e t e d p r o v i s i o n s page 6 , l i n e 21, which r e f e r t o t h e d i s t r i b u t i o n o f l o t f e e s f o r s u b d i v i s i o n s i n master-planned a r e a s . T h i s s e c t i o n h a s g e n e r a l l y been r e c o g n i z e d as c o n f e r r i n g t h e Department

w i t h t h e a u t h o r i t y t o c o l l e c t l o t f e e s i n master-planned a r e a s . m e Department h a s proposed an amendment f o r page 5 , l i n e 21 which would r e i n s t a t e t h a t a u t h o r i t y .

Master-plan s u b d i v i s i o n s r e c e i v e much t h e same review a s any o t h e r s u b d i v i s i o n o f i t s w a t e r , s e w e r , and s o l i d w a s t e f a c i l i t i e s . I n f a c t , t h e Department, even i n mas te r -p lan s u b d i v i s i o n s , i s s t i l l o b l i g a t e d t o conduc t t h i s review. The p r imary d i f f e r e n c e between t h e Depar tment ' s r ev iew of mas t e r - p l a n s u b d i v i s i o n s and o t h e r s u b d i v i s i o n s i s t h a t , i n mas te r -p lan s u b d i v i s i o n s , t h e Department c o n d u c t s i t s review a f t e r t h e p l a t has been f i l e d .

Thus, t o exempt c e r t a i n p e o p l e from payment of f e e s f o r r e v i e w , and t o r e q u i r e payment o f o t h e r s where t h e rev iew i s l a r g e l y t h e same r a i s e s s e r i o u s q u e s t i o n s o f e q u a l p r o t e c t i o n and f a i r n e s s under t h e l a w . I n mas te r -p lan s u b d i v i s i o n s , t h e t a x p a y e r would be s u b s i d i z i n g the d e v e l o p e r s review. Thus, t h e Department u rges t h a t t h e S e n a t e r e i n s t a t e i t s a u t h o r i t y t o c o l l e c t review f e e s f o r mas te r -p lan s u b d i v i s i o n s .

These conments encompass t h e major changes proposed by t h e I n t e r i m S u b c o m a i t t e e on S i l b d i v i s i o n s . The Department would b e most w i l l i n g t o answer any o t h e r e n q u i r i e s which t h e Committee might have.
