Govemment of Punjab, Department of Industries and Commetce has
examined \
the report of Expert Group and approved its recommendations. A
notification under section 11 of
"The Right ~o Fair Compensation and Transparency in Land
Acquisition Rehabilitation and
Resettlement Act 2013" vide notification no Lac/Acq/Cycle
Valley-2/198/Ldh/\2061-A, dated
02.12.2019 was published in Official Gazette on dated
12.12.2019.
According to this notification 4.1438 acres of land in village
Sehbana Hadbast No
237, 10.225 _Acres in Ramgarh Hadbast no. 236 and 0.35 acre of land
in village Jandiyali
Hadbast No. 225 totaling of 14.7188 acres has been proposed for
acquisition. The substance of
the notification was published in two daily newspapers, "The
Tribune" on dated 06 .12.2019 in
English language and Newspaper "Rozana Ajit" on dated 06.12.2019 in
Puijahi Language. In
this regard the rapat is noted in "Rapat Roznama" of "Patwari
Halka" of Village Sehbana vide
Ragat No. 245 dated 20.01.2020 and "Patwari Halka" of Village
Ramgarh and Jandiyali vide
Rapat No. 152 dated 03 .01.2020 No written objection U/s 15(1) has

According to the report of field staff, the availability of
Jamabandi of Village
Ramgarh is of year 2013-14, Village Sehbana is of year 2009-10 and
Village\ Jandiyali is of the
year 20lS-l6 The type of total land of the village is frivate and
compensation is given on same
rate. Therefore the compensation amount has been decided under
section 26 of the Right to Fair
Compensation and Transparency in Land Acquisiti~n Rehabilitation
and Resettlement Act 2013· Th~ survey report of number of
structures present in acquired land was sent to concerned
departments for the valuation of structures and their reports have
been received.
Individual notices were issued to land owner under section 21 of
"The Right to
Fair Compensation and Transparency in Land Acquisition
Rehabilitation and Resettlement Act
2013", to get their views on measurement ofland and price of their
land were issued. The claims
were heard on 11.08.2020 in the concerned Villages. At the time of
hearing of claims, land • •
owners of village Ramgarh (1) Sh. Kamaljeet Singh and Sh. Harpinder
Si,ngh S/o's Sh. Didar
Singh, (2) Sh. Amarjeet Singh S/o J>uran Singh, Smt. Sarabjeet
Kaur W/o Sh. Sarabjeet Singh,
Sh. Surinderpal Singh and Sh. Manjit Singh S/o'S Paramjeet Singh,
(3) Sh. S~tpal Singh-Jaspal
Singh - Balbir Kaur Wd/o and S/o's Sh. Harji'!ider Singh, (4) Sh.
Raghbir Singh S/o Sh. Hardit
Singh (5) Smt. Charanjeet Kaur D/o Sh. Nachattar Singh and (6) Sh.
Tejinder Singh S/o Malkeet
Singh gave their objection and demanded the compensation ranging
from 3 Crore to 5 Crore to
per acres. However, land owners did not produce any proof of sale
deeds of such amounts in the
area hence the claims are not on the basis of any document, but
simply oral which cannot be
relied upon. Besides,Sh. Kamaljeet Singh and Sh. Harpinder Singh
have requested for re-
allotment of plot in PUDA/GLADA colony in lieu o(their land which
was rejected after
consideration and it was decided that all land owners will be given
compensation in lieu of their
land.The compensation of their land is to be calculated on market
rate as per section 26 of "The

DETERMINATION OF MARKET RATE

The Collector shall adopt the following criteria in assessing and

(a) The market value,' if any, specified in the Indian Stamp Act,
1899 for the ,egistration of sc1le
deeds or agreements to sell, as the case may be, in the area, where
the land is situuted; or (b) The average sale price for similar

into consideration.
Explanation 4 - While determining the market value unde~ this
section and the average sale price referred to in Explanation I or
Explanation 2, any price paid, which in the opinion of ihe
Collector is not indicative of actual prevailing market value may
be discounted for the purposes
of calculating market value. •

The following rates are proposed for approval. • 1. From the above
table it is ascertained that circle rate of Sehbana is Rs.
1657750/- per acre
and average of 50% of higher registry rate is Rs. 1929320/- per

registry is higher than Circle rate which is.recommended for
approval. \ 2. From the above table it is ascertained that circle
rate of Ramgarh is Rs. 1656990/- per acre
and average of 50% of higher registry rate is Rs. 1711530 /- per
acre. Tims average of 50 %
registry is higher than Circle rate which is recommended for
approval. 3. From the above table it is ascertained that circl~
rate of Jandiyali is Rs. 2072140/- per acre
and average of 50% of higher registry rate is Rs. 2578133/- per
acre. Thus average of 50%
registry is higher than Circle rate which is recommended for
approval.
4. However, it is decided that average of higher 50% registry rate
which is higher than circle
rate shall be considered as market rate.

Process of payment of comQensation:-
The land owner will get the compensation as per Intekaal in
Jamabandi and verified lntekaal-v-
Fard etc. the land owner will get the compensation as per their
share of land. If the.re is any loan
on the acquired land the compensation amount will be paid to land
owner after de.ducting the
Joan amount. If there is any dispute against the.compensation of
acquired land then the case will
be send to Rehabilitation and Resettlement Authority for settlement
of dispute under section 76
of the Right to Fair Compensation and Transparency in Land
Acquisition Rehabilitation and
Resettlement Act 2013. Any unpaid compensation amount will be
deposifd in the account of
reference court under section 77 (2) of the Right to fair
compensation and tl-ansparency in Land
Acquisition Rehabilitation and Resettlement act 2013 and no
interest will be paid on above said
amount.

The award of Rehabi litation and Resettlement had also been
announced with the
award of compensation of land under section 31 of the Right to fair
~ompensation and
transparency in Land Acquisition Rehabilitation and Resettlement
Act 2013. As per the scheme
the land owners will get the benefit of one time subsistence
allowance to the affected families.
This amount will only paid to the land owners covered under section
31 of the Right to fair compensation and transparency in Land
Acquisition Rehabilitation and Resettlement Act 2013 . The details
are already mentioned in para 3 under Notification of section 19 of

and order to take the possession of the land notified in the
declaration under section 19 read with
section 24 of the act. From today onwards the ownership of the land
free from all encumbrances
