  What is the penalty for copyright infringement?

Can be sued and have to pay legal attorney fees

The court system can award you to pay up to $150,000 if they believe it was willful infringement.

What does the term “fair use” mean and who is included in the fair use clause?

According to University of Maryland library, “fair use is better described as a shadowy territory whose boundaries are disputed, more so now that it includes cyberspace than ever before. In a way, it's like a no-man's land. Enter at your own risk.”

Allows limited use of copyrighted material without requiring permission from the rights holders, such as for commentary, criticism, news reporting, research, teaching or scholarship, and etc… As long as it follows the fair use guidelines

   

What are the conditions for deciding fair use?

According to the U.S copyright office:▪ The purpose and character of the use,

including whether such use is of a commercial nature or is for nonprofit educational purposes;▪ The nature of the copyrighted work;▪ The amount and substantiality of the portion

used in relation to the copyrighted work as a whole; and▪ The effect of the use upon the potential

market for or value of the copyrighted work.

Guidelines for using media in your classroom

Motion media Up to 10 percent of the total or three

minutes, whichever is less. Music, lyrics, and music video:

up to 10 percent of the work but no more than 30 seconds of the music or lyrics from an individual musical work.

Illustrations or photographs:▪ no more than five images from one artist or

photographer. ▪ no more than 10% or 15 images, whichever is

less, from a collection. Numerical data sets: ▪ up to 10 percent or 2,500 fields or cell

entries, whichever is less, from a copyrighted database or data table.

Copying of a multimedia project: ▪ no more than two copies may be made of a

project.

Guidelines for using media in your classroom

TEXT MATERIALS 10 percent of the total or 1,000 words,

whichever is less. An entire poem of less than 250 words may

be used, but no more than three poems by one poet or five poems by different authors in an anthology. For poems exceeding 250 words, 250 words should be used but no more than three excerpts from one poet or five excerpts from different poets in the same work

What are the conditions for using someone else’s words?

As long as you give credit to that person’s words its not a problem
