GeneralProvisions
Article1-Inapplicationoftheprovisionsofarticle15ofthedahirn°1.01.298of23Ramadan1422 (9December2001)creatingtheinstitutionof“DiwanAlMadhalim”,theseinternalregulationsinclude:
-Administrativestructuresof“DiwanAlMadhalim”institution;
-Principlesofthefinancial and accounting organization;
-Attributionsandpowersvestedindelegates;
-Proceduresandconditions forfiling complaints, grievancesandsettlementrequests
-Finaldispositions.
Article2-Intheseinternalregulations,itshallmeantby:
-AlMadhalim:Abuse,excess,injustice
-“DiwanAlMadhalim”: Institutionvestedwiththepowertoexamineabusesandredressinjustices.
-WaliAlMadhalim:RedresserofInjustices
-VizirofChikayat:MinistryofComplaints
-Concernedadministrationorinstitution:Stateadministrations,local communes, public institutions or bodies vested withprerogativesofpublicauthority.
- Bodies vested with prerogatives of public authority: Anymoralpersonhavingcompetencetotakeadecisionlikelytobeattackedbeforeanadministrativecourt.

- Grievances and complaints: Requests submitted to WaliAlMadhalimby natural or legal personswho feel that theyhave been victim of a decision or an action taken by theadministration andwhereby they request his intervention torightawrong,correctaprejudiceanabuseoraviolationtotheruleoflawandequityprinciples.
-Requestsofsettlement:Requestsseekingaswift,amicableandequitableresolutionofaconflict opposing the administrationand the private natural or legal persons requesting thesettlement.
Article3-WaliAlMadhalimshallbethelegalrepresentativeand the mouthpiece of “Diwan Al Madhalim”. He shallrepresent the institution vis-à-vis the State and third parties.He shall act on his own behalf and can delegate, underhis responsibility, part of his powers and attributions to hisministerial and regional delegates, to ad hoc delegates aswell as to themembers of staff, placed under his authority,in particular with regard to the fields falling within theirpurviews.
Article4-TheDelegates,officials and the staff of the variousservicesof“DiwanAlMadhalim”institutionshallbeliableforprofessionalconfidence, concerning all the facts, documentsand information which they take cognizance of during theexerciseoftheirduties.
This obligation shall not apply to persons in charge of filesunder investigation, when the communication of suchinformation to the administration, complainant or to thepetitionerofsettlement,provesnecessaryinordertoreachanequitablesolutionorsettleadispute.

ChapterII
AdministrativeStructures
oftheInstitutionof“DiwanAlMadhalim”
SectionOne
CentralAdministration
Article5-InadditiontotheSecretariatGeneral,theinstitutionof“DiwanAlMadhalim”shallincludeacentraladministrationandministerialandregionaldelegations.
Article6-Thecentraladministrationof“DiwanAlMadhalim”shallinclude:
-AnadvisorycellinthesideofWaliAlMadhalim;
-Acellofcoordinationbetweendelegations;
-Administrative,financialandtechnicalservices.
I.AdvisoryCellintheside
ofWaliAlMadhalim
Article7-ItshallbesetupinthesideofWaliAlMadhalimanadvisorycell,placedunderhisdirectauthority.
Article8-Theadvisorycellischargedto:
- Give its opinion on the issues submitted to it byWaliAlMadhalim and present necessary consultations to thiseffect;

- Prepare all kindsof surveysor reports and conduct anyinvestigation task at the request ofWaliAlMadhalimaboutcertainfiles or questions having a particular character.
Article 9 - The advisory cell shall include advisors chosenamong personalities known for their competence, expertiseandexperienceinthefields in connection with the duties of“DiwanAlMadhalim”;
Thestatusandnumberofadvisorsofthecellshallbefixed by adecisionofWaliAlMadhalim.
II.CellofCoordinationbetweenDelegations
Article10-Acellofcoordinationbetweendelegationsshallbesetupatthecentraladministrationlevelandshallassurecoordination between ministerial delegations on one handand the regional delegations on the other hand; see to thestandardizationoftheirworkprocessesandprovidethemwiththenecessarybackupforthefulfillment of their missions in thebestconditions;
Article11-WaliAlMadhalimshallpresideoverandsupervisetheworkofthecoordinationcell.
Thiscellshallbecomposedofageneralcoordinatingadvisorandadvisorsinchargeofsectionatthecentraladministration.Itmay include, if deemednecessary, atWaliAlMadhalim’sinitiative,inadditiontothedelegates,oneorseveralheadsoftheinstitution’sadministrativeunits,dependingonthenatureoftheissuesontheagenda.

III.Administrative,
financial and technical services
Article12-Theadministrative,financial and technical servicesof“DiwanAlMadhalim”institutionshallincludethefollowingsections:
- Section of Human Resources and Administrative andFinancialAffairs;
-SectionofStudies,AnalysesandFollow-up;
-SectionofDataProcessing,StatisticsandDocumentation;
-SectionofCommunication,CooperationandTraining.
SectionofHumanResourcesandAdministrativeandFinancialAffairs
Article13-ThesectionofHumanResourcesandAdministrativeandFinancialAffairsshallbeassignedto:
-Managehumanresourcesatthedifferentservicesof“DiwanAlMadhalim”andseetotherationalizationoftheiruse;
-Elaborateandimplementthebudgetoftheinstitution,keepitsaccountingsandseetothegoodexploitationofitsmaterialandequipment.
Article 14 - The section of Human Resources andAdministrativeandFinancialAffairsshallbecomposedofthefollowingunits:

Article 15 -The Sectionof Studies,Analyses and Follow-upshallbeassignedto:
-Conductstudiesandresearchesrelatingtothescopeofactionoftheinstitutionortheissuessubmittedtoitandanalyzetherelateddata;
- Ensure the follow up of the grievances and complaints inwhichWaliAlMadhaliminterveneswithadministrations;
-Preparethedraftannualreport,submittedbyWaliAlMadhalimtoHisMajesty theKingaswell the reportspresented to thePrimeministerandthehumanrightsadvisorycouncilasperChapterVoftheseinternalregulations.
- Prepare periodical annual and special reports on itsactivities
Article16-SectionofStudies,AnalysesandFollow-upshallincludethefollowingunits:
-UnitofStudiesandResearch;
-UnitofAnalysisandFollow-up;
-UnitofReportsandSynthesizedStudies.

SectionofDataProcessing,
StatisticsandDocumentation
Article 17 - Data Processing, Statistics and DocumentationSectionshallbeassignedto:
- Supervise the setting up of the databases, programs andapplicationsandthenetworkingofthedifferentservicesoftheinstitutioninaccordancewithacomputermasterplan;
- Ensure the computer technical support to the above statedservices;
- Collect data and information relating to the activities oftheinstitutions,countandclassifythemandputthematthedisposaloftheconcernedsectionswithaviewtotheiranalysisandevaluation;
-Keepthearchivesanddocumentsoftheinstitution.
Article 18 - Data Processing, Statistics and DocumentationSectionshallbecomposedofthefollowingunits:
-UnitofDataProcessing,SoftwareandApplications;
-UnitofStatisticsandDatabases;
-UnitofArchivesandDocumentsManagement.

SectionofCommunication,
CooperationandTraining
Article19-TheSectionofCommunication,CooperationandTrainingshallhavethefollowingtasks:- Promote internal communication between the institution’sservices;-Developtrainingprogramsandadvancedcoursesinfavoroftheinstitution’sstaff;- Elaborate all types of documents, advertising the scope ofactionoftheinstitution;- Set down the operational mechanisms likely to promotecommunicationbetweentheadministrationanditspatrons;- Reinforce coordination relations with the human rightsadvisory council and establish cooperation relations withsimilar institutions and other bodies seeking the sameobjectives;-Coordinaterelationswithpublicandprivatemassmedia;- Ensure the translation of documents produced by theinstitutionandfacilitatecommunicationinlocaldialectsandlanguages.
Article20-TheSectionofCommunication,CooperationandTrainingshallbecomposedofthefollowingunits:
-UnitofCommunicationPromotion,TrainingandPublications;
-UnitinchargeoftheRelationswithCCDH;
-UnitofCooperationandPublicRelations;
-UnitofReceptionandMailRegistration.
Article21-Ageneralcoordinator,chosenamongtheadvisorsinchargeofoneofthesectionsstatedinarticle12above,by

adecisionofWaliAlMadhalim,shallcoordinatetheworksoftheadministrative,financial and technical services, ensure thefollow-upoftheseworksandseetotheimplementationoftheinstructions addressedbyWaliAlMadhalim to thedifferentservices.
Article 22 -The attributions of the units falling under eachsectionshallbesetdownbyadecisionofWaliAlMadhalim.
SectionII
MinisterialandRegionalDelegations
Article23-ShallbecreatedinthesideofWaliAlMadhalimministerialdelegationsatthelevelofeveryministryofgroupofministriesaswellasregionaldelegationsatthelevelofeveryprovinceorprefecture,seatofaregion.
Article24-EveryministerialdelegationshallbeheadedbyaministerialdelegateofWaliAlMadhalimandeveryregionaldelegationisplacedundertheauthorityofaregionaldelegateofWaliAlMadhalim
Article25-Theministerialandregionaldelegatesshallcarryout theirdutiesunder theauthorityofWaliAlMadhalim, inaccordance with the provisions of the dahir n° 1.01.298statedaboveandundertheattributions,termsandconditions,providedforintheseinternalregulations.
Article 26 - Every ministerial or regional delegation shallincludethefollowingunits:
-UnitofReceptionandMailRegistration

-UnitofReceptionofComplaints,GrievancesandSettlementRequests
-UnitofInquiryandInvestigation
-UnitofStudiesandReports
-UnitofAdministrativeAffairs
Article27 -Theattributionsand internalorganizationof thedelegations units shall be set down by a decision ofWaliAlMadhalim.
Article 28 -Theministerial and regional delegates shall beassisted in their duties by executives in charge of studiesas well as administrative and technical staff members, thenumberofwhichshallbefixed in every case, by a decision ofWaliAlMadhalim.
ChapterIII
AttributionsandPowersVestedontheMinisterialandRegionalDelegates
SectionI
ScopeofAttributions
Article29-TheministerialandregionaldelegatesshallassistWaliAlMadhaliminthedischargeofthemandatevestedinhimbythedahirn°1.01.298statedabove,inaccordancewiththeprovisionsoftheseinternalregulations.

Article 30 - The ministerial and regional delegates shallperformtheirdutiesatthelevelofministriesandpublicbodies,fallingundertheircontrolandbodieshavingtheprerogativesofpowerauthorityatcentrallevel.
The stated departments, institutions and bodies shall bedecidedupon foreachministerialdelegatebyadecisionofWaliAlMadhalim.
Each regional delegate shall fulfill his duties at the level oflocalcommunesaswellasall external servicesof theStateadministrations, public establishments and bodies havingtheprerogativesofpublicpower,basedwithin the territorialjurisdictionoftheregionofappointment.
ThestatedcommunesandservicesshallbedecideduponforeachregionaldelegatebyadecisionofWaliAlMadhalim.
SectionII
DutiesandPowersofthe
MinisterialandRegionalDelegates
Article31-Theministerialandregionaldelegatesshall,underthe authority of Wali Al Madhalim, endeavor to enhancecommunication between the administration and citizens,receivegrievances,complaintsandrequestsforsettlement,inaccordancewiththeconditionsandproceduresstipulatedintheseinternalregulations.
Furthermore,theymaypresenttoWaliAlMadhalimproposalsand recommendations likely to improve the operation oftheadministrativemachineandovercome theobstacles thatconfrontcitizensintheirrelationwiththeadministration.

To this end, theministerial and regional delegates shall beassignedto:
-RepresentWaliAlMadhalimvis-à-vistheadministrationandserveasachainlinkbetween“DiwanAlMadhalim”andtheconcernedadministrationsandinstitutions;
- Familiarize the patrons of administrative facilities with“DiwanAl Madhalim” and prompt these facilities to advise,orientcitizensandimprovetheirwaysofcommunication;
- Propose to Wali Al Madhalim measures and proceduresconducive to improving reception and communicationstructuresinpublicadministrations,withaviewtoconveyingthemtotheconcernedadministrationsandauthorities;
- Propose any appropriate measure likely to help simplifyadministrativeproceduresandenablecitizenstobenefit fromadministrativeservicesinthebestconditionspossible;
-Receive grievances, complaints and requests for settlementsubmitted by citizens, individually or collectively, to WaliAl Madhalim, and process them within the limits of theirattributions and in accordance with the conditions andproceduresstipulatedintheseinternalregulations,exceptforissueshavinganationalcharacteror thatmayrequire thataprovisionalpositionbetaken;
- Conduct investigations into the grievances and complaintssubmitted,ifsuchinvestigationsaredeemednecessary;
- Follow-uponall correspondenceexchangedbetweenWaliAl Madhalim and the administration, ensure respect of thedeadlinesset inthiscorrespondence,andfollowupontheirprogressincoordinationwiththeinstitution’scentralservices;
- Keep a register for the grievances and complaints andanother register for requestsofsettlement.Thespecificationsandconditionsforkeepingsuchregistersshallbeoutlinedina

decisionofWaliAlMadhalim;
- Keep the registers for orally presented grievances andcomplaints and transcribe these complaints and grievancesaccordingtothetermsandspecifications set by a decision ofWaliAlMadhalim;
- Address to the concerned authorities or to the competentdelegates, the grievances, complaints and requests forsettlement that reach them but which fall outside theirpurview;
- Submit quarterly reports to Wali Al Madhalim on theiractivities.Thesereportsshallcontainthefollowing:
• Number and nature of grievances, complaints andrequests for settlement deposited at their offices or sent tothem;
• Number of grievances and complaints settledby the administration following the intervention of WaliAlMadhalim;
•Numberandnatureof thegrievancesandcomplaintsforwhichno solutionwas reached, and the reasonsbehindthisfailure,
• Number of grievances and complaints to which theadministrationdidnotrespondbecauseitsinitialpositionwaswellgroundedandcompliedwiththeruleoflawandequityprinciples;
•Numberandnatureofsettlementrequestsforwhichfairsolutionswerereached,
•Numberandnatureofsettlementrequestsforwhichnosolutionwasfound,andthereasonsbehindthisfailure.
Each report shall contain the observationsmade on theadministration’s dysfunctions, as well as recommendations

andproposalstobringreforms.
- Prepare special reports on some grievances or complaints,directlysubmittedtothem,whichhaveanexceptionalaspector thoseconveyed to themforconsiderationbyvirtueofanorderofWaliAlMadhalim.
ChapterIVProcedureandConditionsforFilingComplaints,
GrievancesandSettlementRequests
Article32-TherecoursetoWaliAlMadhalimorhisdelegatesto file complaints and grievances as well as requests ofsettlement shall be free of charge and shall not require thepaymentofanytax.
Article 33 - The complaints, grievances and requests ofsettlement shall be addressed toWali Al Madhalim or hisdelegate,eitherbyordinaryorregisteredmailorbyanyothercommunicationmeans.Theymayalsobedepositeddirectlyathisoffice.
SectionIConditionsandProcedureforFiling
ComplaintsandGrievances
I.FilingComplaintsandGrievances
Article34-Everynaturalpersonorprivatesectorlegalentity,

cleavingtoalegitimateinterest,shallbeentitledtosubmitacomplaint or grievancedirectly toWaliAlMadhalimor hisdelegate.Article35-Inapplicationofarticle7ofthedahirNo1.01.298statedabove,theacceptanceofacomplaintorgrievanceshallbeconditionaluponthefollowing:-Beinawrittenfrom;-Contain complete data on the identity of the complainant:first and last names and address. If the complainant is a legalentity,thecomplaintshouldshowitscorporatename,nature,home office and the name of the legal representative. Thecomplaintsfromanonymousoriginshallnotaccepted;-Includethenameorinstitutionagainstthedecisionoractionofwhichthecomplaintisbeingfiled;Thecomplaintsinvolvingdisputesbetweenadministrationsarenotaccepted;-Includeabriefstatementofthecomplaintgrounds;- List all the measures, provided for by the law, which thecomplainant has undertaken to retrieve his rights from theconcernedadministrationorinstitution;- Contain an affidavit executed by the complainant statingthatthecase,subjectofthecomplaintisnotcurrentlybeingexaminedbyacourtandthatnojudgmenthasbeenrenderedthereupon;- Bear the signature of the complainant or his proxy, ifapplicable,providingthatadulynotarizedpowerofattorneyisproduced;-Beaccompaniedbyjustifyingdocumentsifnecessary.Thedraftingofacomplaintoragrievanceshouldrefrainfromusinganyinsultingordefamatorytexttowardanyconcernedpersonorbody.

Article36-Shouldthecomplaintorthegrievancebefiled byagroupsharingonesameinterest,itshallhavetocontain,inaddition towhat preceded, the identity of all complainants,theirsignaturesandthedesignatedproxy.
Article 37 - If the complaint cannot be filed in writing, thecomplainant is entitled to submit it orally to the competentdelegateoroneofhisassistantswhowillwriteitdowninaspecialreporttobesignedbythecomplainant.
Thesaidreportmustcontainallthedataanddetails,providedforinarticles35and36,backedwithallnecessarysupportingdocumentsandevidence.
Article38-Writtenororalcomplaintsandgrievancesshallberecordedatthemailregistrationoffice of Wali Al Madhalim orhisdelegateinaspecialregister,dedicatedtothiseffectandbegivennumbers.
Article 39 - A receipt, bearing the date and the numberof registration, shall immediately be given or sent to thecomplainant.
II.PreliminaryStudyofGrievancesandComplaints
Article40-ThepreliminarystudyofgrievancesandcomplaintsshallbeconductedbyWaliAlMadhalimorhisdelegate toverifyhisjurisdictionoverthecasesandwhethertheysatisfyalltherequirements,providedforinarticles35and36above.

Article41 - If the study reveals that thecomplaintdoesnotfallunderthejurisdictionofWaliAlMadhalimorthatitdoesnot satisfy the conditions of form,WaliAlMadhalimor hisdelegateshallissueagroundeddecreeindicating,dependingonthecaseeitheritsrejectionorthatitdoesnotfallunderhiscompetence.Suchdecreeshallimmediatelybenotified to thecomplainant.
WaliAlMadhalimorhisdelegatecanreferthecomplainanttothecompetentauthority,exceptinthecaseofhumanrightsbreaches,whichWaliAlMadhalimshall forwarddirectly tothe human rights advisory council, in compliance with theprovisionsofthe1stparagraphofthearticle6ofthedahirNo1.01.298statedabove.
III.ProcedureofInquiryandInvestigation
Article42-WaliAlMadhalimorhisdelegateshallevaluatewhether the complaint has sufficient grounds justifying theconductofaninquiryorinvestigation.Ifnojustifyingelementsarefound,WaliAlMadhalimshallclosethefile by virtue of amotivateddecreeandadvisethecomplainantbyletter.
Article 43 -WaliAlMadhalim or his delegatemay ask thepartiestoprovidecomplementarydata,clarifications as wellasalladditionaldocumentation,deemednecessary,todecideuponthegrievanceorcomplaintsubmittedtohim.
Article44-Subjecttoarticle31,andpriortoanyinquiryorinvestigation,WaliAlMadhalimandhisdelegatemayurgethe

partiestoresorttoallamicablemeanstosettlethedispute,ifthecasecircumstancesallowit.Hemayalsomediatebetweentheparties to thisend,usingallconciliatorygoodoffices toreachequitablesolutions.
Article45-Shouldthegoodoffices fail to reach a solution andshouldWaliAlMadhalimorhisdelegatefind in the complaintsany element justifying the conduct of an investigationthereupon, he shall undertake all possible and necessaryinquiriestoverifytheveracityoftheinformationandfactsthatcametohisknowledgeandrecordhisfindings.
Article46-WaliAlMadhalimorhisdelegateshallsendthecomplaintsubmitted tohim,or itscontent to theconcernedadministrationor institution,andask forexplanations to thefactsindicatedtherein.Theadministrationshallberequestedtosubmitareportaboutitsstandconcerningthegrievanceorcomplaint,within aperiodof onemonth atmaximum, thatcanbeextendedifnecessary.
Article47-WaliAlMadhalimorhisdelegatemayresorttoallmeans,deemedusefulandnecessary, toconductsoundandobjectiveinvestigationsorinquiries,particularlyseekaccesstonecessarydocuments.WaliAlMadhalimorhisdelegatemay,ifnecessary,setadeadlinetotheconcernedadministrationtoproducethesaiddocuments.
Article48-Ifitturnsoutduringthereviewofthegrievanceorcomplaintthattheyrelatetoaconflict already entered beforeacourt,WaliAlMadhalimorhisdelegateshallissueadecreetointerrupttheinvestigation,ifalreadystarted,andadvisethe

complainantthereupon.
IV.InvestigationoftheGrievances
andComplaints
Article49-If,aftertheconductofresearchandinvestigationregarding the complaint at hand,Wali Al Madhalim or hisdelegatereachestheconvictionthatthefactsarewellgroundedandthattheprejudiceexists,heshallsettlethecomplaintorthegrievancesubmittedinfullimpartialityandindependence,on thebasisof the ruleof lawandequityprinciples in theserviceofjustice.
To this end, he shall send his recommendations, proposalsand remarks to the concerned administration or institution,askingittotake,withinonemonthatmaximum,allnecessarymeasurestosettlethematterssubmittedtoitandreportbacktohiminwritingaboutallthedecisionstakeninthisrespect.
Article50 - If theresearchand investigationreveals that thegrievanceorcomplaintresultsfromapersonalerrororbehaviorofacivilservantoragent,WaliAlMadhalimorhisdelegateshallsendhisremarksandfindings in this connection to theheadoftheconcernedadministrationfornecessaryactionandaskhimtoadvise“DiwanAlMadhalim”aboutthedecisionstakeninthisrespect.
Article 51 - In accordance with article 12 of the dahir No1.01.298,settingupDiwanAlMadhalim,WaliAlMadhalimshall address a special report should an administration orinstitutionactsinsuchawayastoimpedehimfromdischarginghisduties,especiallyinthefollowinginstances:

1- Any impediment of whatever form to the investigationsconducted by Wali Al Madhalim or his delegate or anyoppositiontosuchinvestigationsbyanofficial, a civil servantoranypersonintheserviceoftheconcernedadministrationsorinstitutions.
2-Anyneglectorpassivenessofanadministrativeofficial inrespondingtothecontentofthecomplaintaddressedtohimafter the expiration of the deadline, specified in article 46above.
3- Any neglect or passiveness of an administrative officialin providing the necessary support to the conduct of theinvestigations according to the procedures and conditions,specified in the dahir No 1.01.298 and in the internalregulationsofDiwanAlMadhalim.
4-Anyneglectorpassivenessofanadministrativeofficial inrespondingtotheremarksaddressedtohimafterexpirationofthedeadline,specified in article 46 above.
Article52-ShouldWaliAlMadhalimreachestheconvictionduringtheinvestigationthatthestrictenforcementofalegalrule is likely to cause an injustice or prejudice to citizens,hemay propose to the Primeminister to take all necessarymeasuresoreffortstoprovoketheiramendment.

SectionIIConditionsandProcedurefor
theSettlementRequests
Article53 - Inapplicationofparagraph2ofarticle6of thedahirN° 1.01.298,stated above, the request for a swift andfairsettlementshallbesubmittedtoWaliAlMadhalimorhisdelegatesaccordingtotheprocedureprovidedforinarticle34,35,36,38and39oftheinternalregulations.
Theparty requesting the settlement can submit proposals tosettletheirdispute.
Article54-WaliAlMadhalimorhisdelegateshallconveyacopyoftherequesttotheotherpartyandaskittosubmititsviewpointregardingtherequestwithinaperiodnotexceedingonemonth,thatcanexceptionallybeextendedifnecessary.
Article55-Iftheconcernedadministrationacceptstherequestofamicablesettlement,WaliAlMadhalimorhisdelegateshallhaveimmediately to take thenecessarymeasuresandarrangementsto establish contact between the administration and the partyrequestingsettlement,exploretheirpointsofviewandproposeamicable solutions to settle their dispute. The administrationshall have to designate in its answer its representative in theconciliatory efforts to reach a possible settlement who shallcommitonitsbehalftoabidebyitsoutcome.
Areportshallbedraftedconcerningthesettlementagreement,which contains a summary of the dispute, the proposals ofeachpartyandthesolutionsagreedupon.Suchreportshall

besignedbytheconcernedpartiesandWaliAlMadhalimorhisdelegate.Acopyofthereportshallbegiventotheparties.
ChapterVReportsPreparedbyWaliAlMadhalim
Article56-Inconformitywiththeprovisionsofthedahir n°1.01.298 stated above, inparticular its articles6, 12, 13and14,WaliAlMadhalimshallpreparethefollowingreports:
-AnannualreportsubmittedtoHisMajestytheKing;
-ReportspresentedtothePrimeminister;
- An annual report presented to the human rights advisorycouncil.
Article57-TheannualreportsubmittedbyWaliAlMadhalimtoHisMajestytheKingshallincludethenumberandnatureofgrievances,complaintsandrequestsofsettlementsubmittedtohim,datarelatingtogrievances,complaintsandrequeststhatdidnothaveapositiveoutcomebecauseoftheirinadmissibility,incompetencegroundsorarefusal;thenumberofgrievancesthattriggeredaninquiryorinvestigationandthefindings, aswellas thepropositionsandrecommendations that receiveda favorable response by the concerned administrations andestablishments.
It shall also include the short and medium-term programof activity, a report on the financial situation of “DiwanAlMadhalim”inaccordancewiththeprovisionsofChapterVIIoftheseinternalregulations.
Suchannualreportshallbepublished,totalityorpartly,inthe«Official Gazette» under order of His Majesty the King.

Article58-BesidesthesuggestionsofgeneralnaturethatWaliAlMadhalim shall present, regarding themeasures likely torenderjusticeinthegrievancessubmittedtohim,thereportspresented to the Primeminister shall include, if applicable,the cases of refusal by certain administration to enforcecourt decisions pronounced against them, his observationsconcerningdysfunctionsoftheadministration,casesofrefusalbycertainadministrationstorespondfavorablytotheproposedsolutions,accompaniedwithhissuggestionsandpropositionsonthemeasuresthatheseesnecessaryandlikelytoimprovetheperformanceoftheadministrativemachineandtoreformtherelatedregulation.
Article59-ThereportpresentedbyWaliAlMadhalimtothehumanrightsadvisorycouncil shall includeanoverviewontheissuesrelatedtothepromotionofhumanrightswithinthelimitofhispurview, the legalandinstitutional frameworkofthese issues, the progress achieved and the cases of breachreportedaswellashisfindings.
HeshallpresentthisreporttothesaidCouncilforinformation,inaccordancewiththearticle13ofthedahirn°1.01.298of23Ramadan1422(9December2001)settinguptheinstitutionof«DiwanAlMadhalim»,andarticle2ofthedahirN°1.00.350of15Moharram1422(10April2001)onthereorganizationofthehumanrightsadvisoryCouncil.

Staff
Article60-WaliAlMadhalimshallbeassistedinthedischargeofhismandatebycontractstaffmembersorbycivilservantssecondedbyStateadministrations,localcommunesorpublicestablishments, as well as by civil servants and employeesplacedathisdisposal.
Article 61 - The personnel of the institution of “DiwanAlMadhalim”shallbecomposedofthefollowingbodies:
- The body of delegates that shall include the followingcategories:
•Ministerialdelegates;
•Regionaldelegates.
-Advisors;
-Official representatives;
-Officials in charge of studies;
- Administrative and technical executives including thefollowingcategories:
•Interdepartmentaladministrativeexecutives;
•Engineers;
•Computerspecialists;
•Informationspecialists;

•Technicians;
•Publicagents.
Article62-TheministerialdelegatesandtheregionaldelegatesshallbeappointedbyWaliAlMadhalim,uponauthorizationofHisMajestytheKinginaccordancewiththeprovisionsofarticle4of theaforementioneddahirN°1.01.298,amongstseniorexecutivesoftheState,publicestablishmentsorprivatesector, justifying a high level of education, a professionalexperience in the legal, judiciary,administrativeorfinancialfields, and recognized for their integrity, competence andexpertise, aswell as amongst personalities having the sameabilities.
Article63-TheadministrativesituationandtheremunerationsystemoftheministerialandregionaldelegatesshallbefixedbyadecisionofWaliAlMadhalim.
Article64-Theadvisorsshallbeappointedamong:
- Candidates belonging to the higher administrative andtechnical categories, classified at least at the remunerationscaleNo11or assimilated categorieswhohave at least 10years of effective service in a public administration in thiscapacity;
- University researchers having at least 5 years of effectiveservice.
Article 65 - The official representatives shall be appointedamongcandidatesbelongingtothehigheradministrativeandtechnical categories, classified at least at the remunerationscaleN°11orassimilatedcategorieswhohaveatleast5years

ofeffectiveserviceinapublicadministrationinthiscapacity.
Article66-Theofficials in charge of studies shall be chosenamong:
- Candidates holding a higher education degree allowingaccess to a position, classified at least at the remunerationscaleN°11ortoanassimilatedcategory;
-Candidatesbelongingtothepublicadministrationcategories,classified at least at the remuneration scale N° 11 and havingatleast2yearsofeffectiveserviceinapublicadministration.
Article67-TheadministrativeandtechnicalexecutivesshallbeappointedamongcandidatessatisfyingthesamerequirementsasthosehavingsimilarrankintheStateadministrations.
Heads of sections and chiefs of units shall be designatedrespectively among advisors and official representatives,referredtoaboveinarticles64and65.
Article 68 - Subject to the provisions of these internalregulations,thestaffoftheinstitutionaswellascivilservantsin secondment shall be subjected to the same provisionsapplicabletocivilservantsandagentsofStateadministrationsbelongingtosimilarcategories.
Article 69 - The contract staff shall benefit from the sameadministrativesituationasthatofsimilartenuredstaffofStateadministrations,takingaccount,ifthecasearises,ofdegreesheldandseniorityintheadministration.
Thecivilservantstemporarilyassignedintheinstitutionshall

benefit from the same administrative situation as the one theywereenjoyingintheiradministrationoforigin.
Article70-Thesalaryandindemnitiesservedtothecontractstaff and seconded civil servants, appointed as heads ofsectionsorchiefsofunitsorasofficials in charge of studies,orasadministrativeortechnicalexecutivesshallbefixed by adecisionofWaliAlMadhalim.
ChapterVIIPrinciplesofFinancial
andAccountingOrganization
Article71-Thebudgetof“DiwanAlMadhalim”shallincludeworkingandequipmentcredits,withinthelimitofthefundsearmarkedfortheinstitutionbythebudgetoftheRoyalCourt.
Article72-WaliAlMadhalimshallelaboratethedraftbudgetof the institution, oversee its execution in accordance withthe rules and procedures provided for in the financial andaccountingorganization regulations of “DiwanAlMadhalim”andtothelistoftheaccountingplanof“DiwanAlMadhalim”.
Article73 -WaliAlMadhalimshallbe thepayingauthorityof theinstitution.Hemaydesignate,underhisresponsibility,deputypayersfromthestaffoftheinstitution.
Article 74 - A service in charge of expenditure shall be

createdwithin«DiwanAlMadhalim».Thenatureandceilingofexpensesorderedbytheserviceshallbefixed by a decisionofWaliAlMadhalim.
Article75-Theaccountingsoftheinstitutionshallbekeptinaccordancewiththemanualoforganizationandaccountingprocedurefixed by a decision of Wali Al Madhalim.
Article 76 - The regulation relative to the financial andaccounting organization of “Diwan Al Madhalim” shall befixed by a decision of Wali Al Madhalim.
Article77-AnaccountingagentshallbedesignatedbyWaliAl Madhalim. He shall have to oversee the respect of thefinancial and accounting rules and procedures, provided for inthefinancial and accounting organization regulations and intheorganizationandaccountingproceduremanual.
Article78-Theaccountsof«DiwanAlMadhalim»institutionshallbesubjectedeveryyeartoaverification by a committeeofexpertsdesignatedbyWaliAlMadhalimandcomposedof:
-Acertified accountant;
-Anexpertinthefinancial and accounting field;
This committee shall be assigned to give observations onthe conditions of the budget implementation, formulaterecommendations and propositions likely to improve themanagementoftheinstitution.
Theworks of this committee shall be the object of a reportaddressedtoWaliAlMadhalimandasummaryofitshallbeincludedintheannualreportsubmittedtotheappreciationofHisMajestytheKing,relatingtoactivitiesoftheinstitutionand

itsprogramofaction.
ChapterVIII
FinalProvisions
Article 79 - Wali Al Madhalim may designate one of hisdelegatesorthegeneralcoordinatorofadministrativeservicestoreplacehimincaseofabsenceorimpediment.
Article 80 -These internal regulations shall enter into forceprogressivelyasfromthedateoftheirapprovalbyHisMajestytheKing.
Article81 -Theseinternalregulationsshallbemodified andcompleteduponproposalofWaliAlMadhalimandapproval.

- Receive and gather reports established by the ministerialand regional delegates relating to their activity progressand ensure the standardization of the methods of theirpreparation;
- Followtheactivitiesofalltheservicesundertheinstitution,receiveinformationanddataconcerningthemandestablishperiodicreportsthereupon;
- Conductsynthesizedstudiesrelatingtotheaffairssubmittedtotheinstitution,classifyingthemaccordingtotheirobject,originandtheadministrationconcerned,andpresentthefindings;
- Prepare the drafts of the reports, presented by Wali AlMadhalim to thePrimeMinisterabout theadministrationsrefusingtoexecutecourtdecisionsrenderedagainst them,aswellasthosecontainingtheremarksoftheWalirelatingto certain dysfunctions that hinder the good operation ofadministration and the cases of certain administrationsrejecting the proposed solutions, accompanied with hisrecommendations and proposal of measures deemednecessary and likely to improve the performance ofadministrationandreformthelegislationinquestion;
- PreparethedraftoftheannualreportthatWaliAlMadhalimsubmits to the high consideration of His Majesty the Kingontheactivityoftheinstitutionanditsprogramofaction,inconsultationwithallotherconcernedservices.

- Collectdataandinformationconcerninggrievances,complaintsand requests of settlement, received by the institution, theresolvedones,thosebeingsettledandthosepending;
- Conduct censuses relating to the institution’s action andachievementstobringoutusefulindicators;
- Supervisethestatisticaldatabasesandputthematthedisposaloftheconcernedservices.
Article3.TheUnitofArchivesandDocumentsManagementshallbeassignedto:
- Hold, classify and index all the institution’s archives anddocuments using computer processing and see to theirmaintenance;
- Managetheinstitutions’libraryanditsdocuments,andseetothemaintenanceanddevelopmentthereof;

- Propose appropriate measures in order to develop receptionstructures and communication of public administrations andpromptstheconcernedadministrationstogeneralizethemtoalltheirservices;
- Suggestsuitablemeansallowingtheadministrationtoadvertiseitsservices,proceduresanddeadlinesinforce,andpromptittoconformtothem’s;
- Facilitatecommunicationindialectsandlocallanguages,notablyAmazigh;
- Assurethetranslationofdocumentsproducedbytheinstitutionattherequestoftheconcernedservices.
Article 2.TheUnit inchargeof the relationswithCCDHshall beassignedto:
- Transmit for consideration to the Human Rights AdvisoryCouncilgrievancesandcomplaintsreceivedbytheinstitution,concerningviolationsofhumanrights;
- Receivegrievancesandcomplaintsaddressedtothepresidentof the said council and convey them to the concernedministerialandregionaldelegates;
- ElaboratedraftsofthereportssubmittedbyWaliAlMadhalimtotheHumanRightsAdvisoryCouncilconcerningthequestionsrelatingtothepromotionofhumanrightsandinvolvingtherelationbetweentheadministrationandcitizens.

Article3.TheUnitofCooperationandPublicRelationsshallbeassignedto:
- Reinforcerelationsofcooperationandscientific, professional andtechnical exchanges between the institution and similar foreigninstitutions;
- Strengthen coordination relations between the institutionand other national and foreign bodies having the sameobjectivewithintheframeworkofexchangesofexperiencesandexpertise;
- Organize, in consultation with scientific institutions andconcernedadministrations,allscientific activities related to theinstitution’sfields of interest, and particularly the promotionofcommunicationbetweentheadministrationandcitizens;
- Coordinatesrelationswithpublicandprivatemassmedia.
Article 4.The Unit of Reception and Mail Registration shall beassignedto:
- Keep a central general register of grievances, complaintsandrequestsofsettlementreceivedbytheinstitution;
- Receivegrievances,complaintsandrequestsofsettlement,received by the central administration and refer them totheconcernedministerialorregionaldelegatesforaction,including those sent directly by the Moroccan nationalsresidingabroad,inaccordancewiththeinstructionsofWaliAlMadhalim;
- Reorient toward the concerned authorities grievances,complaintsandrequestsofsettlement,receivedbyWaliAlMadhalim,notfallingwithinhispurview;
- Seetotheregistrationofthecorrespondencereceiveddirectlyofconveyedbythecentraladministrationoftheinstitution,
andsupervisetheircomputerprocessing.
