Biographical / HistoricalPotter Stewart was born on January 23, 1915, in Jackson, Michigan, but grew up in Cincinnati, Ohio. Hereceived his undergraduate degree from Yale University in 1937. He was awarded a Henry Fellowship tostudy at Cambridge University for the 1937-1938 academic year. Stewart then entered Yale Law School,where he became an editor of the Yale Law Journal and graduated in 1941. He worked as a law clerk in theNew York firm of Debevoise, Stevenson, Plimpton, and Page from September 1941 to April 1942, resigningto enter the United States Navy. After completing his military service, he rejoined the firm as an associatefrom October 1945 until July 1946. In 1947, Stewart returned to Cincinnati and joined the firm of Dinsmore,Shohl, Sawyer, and Dinsmore. In addition to his practice, Stewart served two terms on the Cincinnati CityCouncil.
In 1954, President Dwight D. Eisenhower nominated Stewart to fill a seat on the United States Court ofAppeals for the Sixth Circuit. Three years later, Steward received a recess appointment from Eisenhowerto the United States Supreme Court to replace fellow Ohioan Harold Hitz Burton. He was confirmed by theSenate in 1958. Stewart served on the Supreme Court until July 3, 1981, when he assumed senior status andtook designated assignments until his death.
During Stewart's tenure on the Supreme Court, he was often asked whether or not he would label himselfas a liberal or a conservative. Stewart would reply that he did not think of himself as either one or as aswing justice. At the news conference announcing his retirement in 1981, Stewart elaborated: "I've thoughtof myself as deciding every case correctly, and I've never thought of myself in terms of putting a label onmyself except trying to be a good lawyer and looking at every case under the Constitution and the law,even though I might think it an unwise law. I think it's the first duty of a Justice to remove from his judicial

work his own moral, philosophical, political or religious beliefs and not think of himself as being here assome great big philosopher king. It's not a hierarchical organization. Your boss is only the Constitution andthe law."
Throughout his service on the Supreme Court, Stewart maintained his pragmatic approach of decidingcases based upon their specific facts. Stewart is perhaps most widely know to the general public for theportion of his concurring opinion in the case of Jacobellis v. Ohio. He stated that, in attempting to definewhat constituted hard core pornography, "I know it when I see it."
After his retirement from the Supreme Court, Stewart was appointed in July 1983 as a member of PresidentReagan's Commission on Organized Crime. He died on December 7, 1985, in Hanover, New Hampshire andwas survived by his wife, Mary Ann Bertles, and their three children, Harriet S. Virkstis, Potter Stewart, Jr.,and David Bertles Stewart.
Scope and ContentsThe Potter Stewart Papers consist of United States Supreme Court case files and supportingdocumentation, Appellate Court case files and supporting documentation, subject files, correspondence,writings, newspaper clippings, photographs, and audiovisual material that document Stewart's career asan associate justice of the Supreme Court and as a judge on the Sixth Circuit Court of Appeals. The papersprovide a comprehensive overview of Stewart's career from his appointment to the Sixth Circuit Court ofAppeals in 1954 to his retirement from the Supreme Court in 1981. The material regarding Stewart's timeon the Supreme Court from 1958 to 1981 is particularly extensive, as each case that came before the courtduring that time period is represented in the papers. Substantive correspondence between justices is fairlyrare and the correspondence in general is largely routine. The extensive photographs are a good source ofinformation about Stewart's life away from the courtroom.
The Potter Stewart Papers were processed as a collaborative eort between Manuscripts and Archivesand the Yale Law School to document the careers and accomplishments of Law School faculty and alumni.

Collection ContentsSeries I. Supreme Court, 1958-1980The series includes case files and other materials collected or created by Potter Stewart relating to hisservice as an associate justice of the United States Supreme Court between 1958 and 1981. The case filesare divided into two groups: cases in which Potter Stewart authored an opinion and cases in which hedid not. The case files are arranged chronologically by October Term, then alphabetically by case name.Although Stewart's oce generally used the truncated form of the case name to alphabetize the files,there are some instances in which the case name assigned by Stewart's oce is not intuitive. For example,the case "Named Individual Members of the San Antonio Conservation Society v. The Texas HighwayDepartment and the U. S. Department of Transportation" (OT 1970) is filed under "Conservation" asopposed to "Named" or "San Antonio."
The case files document the evolution of a case in the Supreme Court from its acceptance to thepublication proofs of the decision. Although the materials in each case file are unique and vary significantly,they generally contain drafts of opinions, correspondence with other justices relating to the drafts, anda printed proof copy of the final decision. They may also include lengthy 'memoranda to the conference'from individual justices outlining their positions on a particular issue, drafts of other justices' opinions,correspondence between Stewart and his law clerks and other justices, and Stewart's handwrittenannotations. In some instances, the files contain a series of drafts which document the process of opinionwriting in which Stewart circulated a draft opinion to other justices, received criticisms and suggestions,and made alterations to his draft sucient to create a consensus opinion. Some files do contain earlyhandwritten drafts of an opinion, though notation in Stewart's hand is uncommon. The case files reflect theCourt's internal deliberations and provide a glimpse into the individual justice's thoughts about importantsocial topics such as race, school desegregation, obscenity, criminal justice, the Vietnam conflict, and theWatergate scandal.
Supporting documentation, which includes all court materials not included in case files, follows the casefiles. The documentation is arranged chronologically by October Term, then alphabetically by type. Thedocumentation includes a wide range of materials pertaining to the general workings of the Court andthe progress of specific cases. Both the administrative matters that constitute the day-to-day workingsof the Court and the weekly conferences in which cases were discussed are doumented. The types ofdocumentation kept by Stewart and the way in which they were filed changed over time. The researchershould particularly be aware that Stewart's oce discarded petitions for certiorari and associatedmaterials prior to the 1973 October Term.
The most voluminous type of supporting documentation is court calendars, called docket books. Atthe beginning of Justice Stewart's tenure on the Court, the docket books were divided into three sets -appellate, miscellaneous, and original. In 1973, the miscellaneous docket book was divided and an additionalseparate docket book for in forma pauperis cases ('in the form of a poor person,' that is, not liable for thecosts of the court) was created.
The docket books consist of a case by case listing, in the order of their assigned docket number, of eachmatter that came before the Court. Each case was given a page on which was printed the docket numberand the full name of the case. Of more interest to the researcher is the voting grid on the bottom of thepage. Beside each justice's name, there are a series of Boxes which were used to record each justice's voteon the relevant questions before the Court, including the most crucial issue of whether to allow the matterto be argued before the Court, that is, whether to grant the writ of certiorari. Space is also reserved in thegrid for matters relating to jurisdiction, the merits of the case, and other relevant issues. Stewart's notationin the docket books is generally limited to the recording of each justice's vote of whether to grant or denythe writ for certiorari, though he does occasionally make more extensive comments.
Another important set of related materials are the certiorari memoranda which are found in the filesdenoted 'Appeals, applications, and petitions for writ of certiorari '. These memoranda, by Justice Stewart'slaw clerks, were prepared to assist the justice with the evaluation of the very large number of appellatecases oered for the Court's review each term. It was the clerk's task to provide a concise introduction

to the facts of the case, together with other relevant matters, and then to make a recommendation asto whether the justice should deny or accept the matter for review. Each memorandum concludes withthe initials of the clerk who authored the document. These memoranda were generally not circulated toother justices, rather they were for Stewart's use in determining his vote on the threshold question ofwhether or not to grant the writ of certiorari. If certiorari were granted, then the case would be one of asmall percentage of cases accepted for review by the Court each term. Although most memoranda werewritten by Stewart's clerks, some were prepared by other justices' clerks.
