Sir,

This is to bring to your kind notice that Hindustan Copper Limited has submitted a proposal for Environmental Clearance for enhancement of production from 0.39 Mtpa to 0.9 Mtpa of Copper Ore (ROM) for Surda Mining Lease, District- East Singhbhum, Jharkhand.

The proposal was listed for presentation at the 81h meeting of the Reconstituted Expert Appraisal

Committee at Agenda No. 3.1 on 22.07.2016 and Hon'ble committee has recommended the proposal for Environmental Clearance vide minutes of the 8th meeting of the Reconstituted Expert Appraisal Committee subject to forest clearance of the project.

The company has further made presentation before the Hon'ble committee at the 1 01h meeting

of the Reconstituted Expert Appraisal Committee at Agenda No. 2.33 on 20.09.2016 and submitted documents regarding forest clearance of Surda project. However the Hon'ble Expert Appraisal Committee has recommended for EC for Expansion of Surda Copper Mine from 0.39 million TPA (ROM) in lease area of 270.72 ha (i.e 239.65 ha of Non-Forest Land + 31.07 ha of Forest land for which diversion of Forest land already granted).

In this regard following is submitted for kind perusal:

1. Hindustan Copper Limited is operating Surda Copper Mine in East Singhbhum District in

the State of Jharkhand and The Surda Mining Lease is a Part of erstwhile Mosaboni

Mining Lease held by the company and four (4) nos. of mines namely Mosaboni, Surda,

Pathargora and Dhobani were operative under the Mosaboni Mining Lease since 1924.

The mining lease being operated by utilizing 189.7 4 Ha of forest area which has been

diverted in favour of the company vide Letter No. F.No.8-64/93-FC from Ministry of

Environment of Forests and Forests, Government of India (FC Division) dated

15.05.1998. (Copy enclosed as Annexure 1).

2. Before enactment of F. C. Act 1980, the company was utilizing 203.62 hect. of forest land

for mining and allied activities over Mosaboni Mining Lease with due approval of the

state forest department as per prevailing rules.

3. Subsequent to enactment of F.C Act, as per directives of MoEF, the company applied for

regularization and renewal of aforesaid 203.62 hect. of forest area under the provisions

of the Act. (The application submitted by the company is enclosed as Annexure-11). After

field scrutiny, it was revealed that 13.88 hect of forest land within the lease remains

unbroken and unutilized. Accordingly, the State forest department recommended 189.74

hect. of forest land within Mosaboni Mining Lease for renewal and diversion. The

recommendations of State forest department are enclosed at Annexure Ill, IV and V

respectively.

4. The mine wise forest area recommend for diversion by the state forest department are as under:-

5. The total lease area under Surda Mining Lease is 388.68 hect. Out of this 149.03 hect is forest land and as per the above table diverted forest area under Surda mining Lease is 83.51 hect. (Forest area broken and utilized on surface is 31.07 hect and Forest area utilized for underground mining operation is 52.44 hect.).

6. The details of forest area utilized for underground mining operation under different mines is also mentioned in the site inspection report where area diverted for underground mining operation is 142.25 hect. in total and under Surda Mine, the area is 52.44 hect. (copy enclosed as Annexure VI).

7. But Hon'ble Expert Appraisal Committee has recommended for EC of Surd a Copper Mine in lease area of 270.72 ha (i.e 239.65 ha of Non-Forest Land + 31 .07 ha of Forest land for which diversion of Forest land already granted) and did not include 52.44 hect of forest land for which diversion is granted for underground mining operation

Under the explained circumstances Hindustan Copper Limited requests to consider for grant of Environmental Clearance for 323. 16 hect of lease area i.e 239.65 ha of Non-Forest Land + 83.51 hect of Forest Land for which diversion of Forest land already granted diverted (31 .07 ha of Forest area broken and utilized on surface and 52.44 hect of Forest area utilized for underground mining operation) the project.

Justification for retaining 1850 Hectares forest land uhder Mosaboni mining lease area 6923 hectares

singhbbum Clopper belt is one of the .richest oopper deposit .in the country. The boundary of the mining le~se over an area

6923 hectares in the copper belt has been decided .. on the basis "t geological investigation of the area. Mining was started in this

area around 1924 by underground mining method. :rorest land

61.37 hectares has been used mainly for establishing .infra•

structure facilities reqUired for underground minJ.ng. OUr e~erience

in undergrouril mining in hard rock for the last seventy years we '

have not abserv.ed any SUbsideDCS>r adverse ·effects on surface environnent within the mining lease area. I.n this connection

Mining lease area has vast potentials of copper deposit, estimated ore reserve is about 38.74 million M.T. I.t is necessary in the national interest of minetal development that renewal of.

the mining lease over 6923 hectares inclUding 1860 hectares of

forest land should be granted in favour of Hirxlustan COpper Limited

which is a central Govt. enterprise.

Mosaboni group of minea.were leased to Hioduatan Copper Ltd

in 1924. Out of total mining lease area of 6923 hectares, an extent ~ 1.860 ha. were the forest land. The lease expired on 15-06-1984 ~nd \ • ' i)

renewed by De~uty Commiasioner,singhtbum District for further period of 20 years from 16-06-1984 without obtaining ap~roval under Forest

conse"rvation Act. Though the renewal of the Deputy Commissioner was

accorded on 02-01-1990. yet the company has been continuing their underground mining operations uninterrupted. Both the author! ties of J.

the Company as well as ~orest oeptt have maintained that the under­ground mining h-1.:: been continued only in the area wh.ich were broken prior to 1980.

There are 4 under~round mines in this lease1 1. Dhobani Mines where the work has been presently stopped.

2. Mosaboni Mines

3. Pathargora Mines 4. surda Mines.

In spite of Ministry's direction vide letter No.e-64/93-FC db. 27-08-93 addressed to secretary(Fore ts), Bihar, the mining wor~ has not been stopped. During personal inquiry with the local officera.

I have been ~old that no •ll•IJiclixldalU:tiiJilxlll:fXblxRB~%lmriU responsibility has been fixed on any erring officials for the alleged

violation of Forest Conservation ACt. · As per the details supplied by ·11 l

th(lompany. 61.37 ha of forest land have P8en occupied by the . cofp ny on the surfac.e {24.13 ha in Moaaboni Mines and 37.28 ha in su~d Mines. The break up of the balance 142.25 ha underground mi~ibg in difCer.ent mines are li~ted as below. It is· to be clearly un ~ stood that 142.35 ha does not include underground miningsbelow th ; rea occupied dm the surface. . . . . .

It is, thus, cleAr that excluding the area occupied on t::'

surface i.e. 61.37 ha. 97.272 ha is broken prior to 1980. Th~

proposal includes fresh underground mining of 94.978 ha.

Status of Forest~a The forest area is chssifh··J· as Reserved and Protected forests.

There 1s no vegetat1~n in the nrea occupied on the surface, whereas,

there are moderate to c_;~ood sal forests in certain patches of remaininr

area where underground mining is in progress.

DiscrepAnciP.s noticP.d~ As alre~dy narr~tad, thP- proposal is not exhaustive regardino the

forest areas used for underqroun:j rnining prior to 1980 as well as tt­

area required for future mining. The state Porest Deptt ha~ also to

depend upon Hindustan Copper Limited for the break up of the area in

some Mines. During the visit to these mines on 18-12-1993, I have

found it very difficult to dete~mine the extent of underground mining prior to 1980, as there is no proof for the same. We had only to rely on the figures furnished by HCL. EnviroiTI'tent and \'lildlife:

In view of the a60resaid d.iocussion, I recommend to regula rise the mining by HCL.

The R&K extent of for?st lRnd mentioned in Ministry's letter No,

s-64/93-Fc dt.27-09-1993 where the mining was not done in the past and is also no~ under,fresh proposal is mentioned as 1756.38 ha. This figure is not correct as the total lease area of forest land is 186C ha and the proposal on hand is for .203. 62 ha, thus-leaving a balancr

of 1656.38 ha. The D! O,Dha!bhum Division stated that other regUlar forestry operations are beinQ cax.ried out in these areas.
