Inthe80’stheCouncilofEuropewasapioneerinstitution in the protection of personal data,with the adoption of the 108 Convention forthe protection of individuals with regard toautomatic processing of personal data, on 28January 1981. In the specific area of criminalinvestigations the Council of Europe adoptedthe Recommendation R(87) on regulating theuseofpersonaldatainthepolicesector.

TheEuropeanUnionhasalsopaidattentiontothedataprotection issues incriminalmatters.The Schengen Convention and later Europoland Eurojust establish their own systems forprocessing and exchanging criminal data andintroduced appropriate rules on dataprotection. The FD 2008/977/JAI on dataprotection in criminal matters and the FD2009/315/JAI on criminal records will be

applicable for the exchange of informationbetween the EU Member States wheninvestigating and prosecuting transnationalcriminaloffences.Inthefightagainstterrorismandorganised transnational crime, judges andprosecutors should also apply domesticlegislation governing data protection incriminalmatters.

Mostofthejuristsdoesnothavethenecessaryknowledge of the principles, guarantees andrightsondataprotectionincriminalmatters.

TheDPiCPProjectaimstopromotethedebatebetween judges,prosecutorsandexperts fromtheMinistriesofJusticeand InternalAffairs inthis specific field. It includes also theelaboration of adequate training materials forjudicialschoolsandjudicialtrainingcentres.
