APPENDIX REFERRED TO IN THE GENERAL CONDITIONS
1. Defects liability period 1 year

GENERAL CONDITIONS
1. Sealed tenders should be addressed to Circle Head, Punjab National Bank, CircleOffice, 1 – 2 Raghunath Nagar, Opposite Sanjay Place, M. G. Road, Agra andsuperscribed Interior Furnishing, Civil Works and associated Electrical Works atOff- Site ATM at AATS, Fatehpur Sikari Road, under BO: Shahganj, Agra
2. No tender will be received after 03.00 PM on 30.07.2014 And the tenders willbe opened on the same day at 03.30 PM unless otherwise informed.
3. The tenders will remain valid for a period of 2 months from the date of openingof tenders. Bank reserves the right to accept or reject any or all the tenderswithout assigning any reason to do so.
4. At the time of submission, every tender must be accompanied by a FDR/DemandDraft of Rs 2000.00 (Two Thousand only) In favour of Punjab National Bank,Circle Office, Agra as earnest money. No interest will be paid on earnestmoney. Any tender which is not accompanied by the earnest money shall besummarily rejected.
5. The tenderers should quote the rates in figures as well as in words.
6. All erasures and alterations made while filling the tender must be attested byinitials of tenderer. Overwriting of the figures is not permitted.
7. The earnest money deposit of unsuccessful tenderers will be returned after thetender is decided or on expiry of validity period.
8. The earnest money of the successful tender shall be adjusted in the securitydeposit.
9. The Bank reserves the right to reject any or all the tenders, accept part of any
tender or entrust the entire work to any contractor or divide the work to morethan one contractor (itemwise) without assigning any reason or giving anyexplanation. The rates quoted by the contractor will hold good for thisbifurcation and no compensation will be paid on this account.
10. Joint tenders shall not be considered.

11. On receipt of intimation from the Bank of the acceptance of his tender, thetenderer should immediately submit his acceptance of the work order. If thesuccessful tenderer fails to undertake the work, the earnest money deposited byhim will be forfeited and the acceptance of his tender may be withdrawn.
12. The rates quoted in the tender shall include all charges of scaffolding, lift, anytools and plants, railway freight, labour conditions, wastage and fluctuations inthe rates, excise duty, all taxes including sales tax, octroi, VAT etc. and any othercharges or expenditure for carrying out the work.
13. The contractor will arrange water and electricity for completing the work.
14. No escalations in rates will be allowed under any circumstances.
15. The successful tenderer is bound to carry out entire work within the periodstipulated in the appendix. The tenderer will have to pay liquidated damages for
non completion of job within stipulated period at the rate of Rs 1% of theestimated amount shown in the tender Per week after expiry of period ofcompletion subject to maximum of 10% of the contract value.
16. The liquidated damages as mentioned above may not be enforced if theContractor applies for extension of time mentioning the reasons for extension.Extension of time in days will be granted by the Bank if it is proved thatContractor is not at fault for extending the work beyond stipulated date ofcompletion.
17. The successful tenderer is bound to carry out items of work necessary for
completion of job even though the same are not included in the schedule ofquantity. Rates of extra items will be derived from the tender. In case the ratesdo not exist in the tender and extra item is not similar to tender item, then therates will be worked out on the prevailing market cost of material and labourincluding wastage plus 15% towards all taxes and Contractor‟s profit.
18. The Contractor must co-operate with other contractors (i.e. CCTV,Smoke Alarm, Security Alarm, AC etc.) appointed by the bank so thatentire work shall proceed smoothly with least possible delay and to thesatisfaction of the bank.
19. The Contractor shall remove all malba etc., wash and clean the floors at his owncost and handover the site in proper manner on the completion of work.
20. The tenderer shall acquaint himself with the site conditions, making his ownarrangement for storing of material at site, lift, cartage etc.
21. Eight percent of the value of work done shall be deducted as security depositfrom the running bills of the Contractor and will be retained for defects liability

period (as mentioned in the Appendix) and shall be released after the defectsliability period, provided no defects are noticed during the period. The securitydeposit includes earnest money deposited by the Contractor with the tender.
22. The contractor will attend to all defects noticed during defect liability period. If
the contractor fails to attend the defects, these defects will be rectified by theBank and the expenditure incurred on this account will be recovered fromsecurity deposit.
23. The contractor shall make adequate arrangement for watch and ward of hismaterial and shall ensure the safety, breakage and any theft of material fixed orunfixed by him or other sub-contractors.
24. The work executed should be got approved by the Bank and contractor shallrectify any bad workmanship pointed out at any stage and remove from site allthe rejected materials immediately.
25. The contractor shall be responsible for application of labour laws, compensationfor injury and accident to person, whether employed by him or by his sub-contractor.
26. The contractor will take necessary precautions for carrying out the work avoidingany damage to structures/decorative parts of the property. The contractor willrectify any damage done at his cost.
27. The contractor shall ensure that workmen employed by him for execution ofwork are suitably covered against Workmen‟s Compensation Act and that all
liabilities arising out of Workmen‟s Compensation Act, ESIC and other legislativeenactments applicable to such works and workmen shall be to the contractor‟saccount.
28. Civil, Electrical and Sanitary works will be carried out as per bank‟s standarddrawings/specifications and to the entire satisfaction of the Bank.
29. The contractor shall give due notice to the bank to check measurements of anywork which is likely to be hidden before covering the same.
30. The contractor will submit running bills for the value of work done not less than
interim payment (as mentioned in the Appendix) mentioning full nomenclaturesof items, rates, amount, measurements sheets, reasons for part rates claimed, ifany.
31. In case of non-completion or delay in completion of work or removal of defectsin time, the bank shall be free to appoint another agency to get the job done atcontractor‟s risk and cost.

32. For fixed as well as loose furniture, rates quoted by the contractor will beinclusive of all taxes, including sales tax, octroi, VAT, transportation etc. and noextra amount will be paid on this account.
33. Income-tax, Work Contract Tax and any other tax as applicable will be deducted
at source from the contractor‟s bill and will be deposited with the I.T.O./Sales Tax Department as per rules.
34. The bank may delay the progress of work without, in any way, vitiating thecontract and grant such extension of time for the commencement/ completion ofthe contract as it may think proper and sufficient in consequence of such delayand the contractor shall not make claim for compensation or damage in relation
thereof.
35. The contractor will not execute any extra item without Bank‟s permission inwriting.
36. The quantities mentioned in the schedule of quantities are approximate.Payment will be made on actual work done by the contractor. However, thecontractor should not deviate the quantity without Bank‟s permission.
37. Conditional tenders quoted by the tenderer is liable to be rejected.
38. The bank has a right to alter the nature of work and to add or omit any item ofwork or to have the option of the same carried out departmentally or otherwiseand such alterations or variations shall be carried out without prejudice to thiscontract.
39. The Bank has right to terminate the contract, if the contractor abandons thework, or fails to commence and complete the work in time, or fails to abide bythe contract conditions.
40. Variation/Deviation : The price of all such additional items/non-tendered itemswill be worked out on the basis of rates quoted for similar items in the contractwherever existing or on engineering rate analysis based on prevalent fair price oflabour, material and other components as required. The tender rates, shall holdgood for any increase or decrease in the tendered quantities upto variation of25%. For variation beyond 25%, the rate for the respective item will be arrived
based on the market rate.
41. Substitution : Should the contractor desire to substitute any materials andworkmanship, he/they must obtain the approval of the Employer/ Architects inwriting for any such substitution well in advance. Materials designated in thisspecification indefinitely by such term as “Equal” or “Other approved” etc.specific approval of the Employer/Architects has to be obtained in writing.

42. Concealed Work : The contractor shall give due notice to the Employer wheneverany work is to be buried in the earth, concrete or in the bodies of walls orotherwise, becoming inaccessible later on, in order that the work may beinspected and correct dimensions taken before such burial, in default whereofthe same shall, at the opinion of the Employer be either opened up for
measurement at the contractor‟s expense or no payment may be made for suchmaterials, should any dispute or difference arise after the execution of any workas to measurements etc. or other matters which cannot be conveniently testedor checked, the notes of the employer shall be accepted as correct and bindingon the contractor.
43. Advance Payment and secured advance :
43.1 Advance payment for works actually executed but not measured and billedfor, should not be made generally. Payment should only be made after thedetailed measurements of the work are taken and recorded and the
contractor's bill for the same is approved by the Competent Authority.
However, advance payments on the running bills to the extent of 75 % ofthe Architect certified amount may be made wherever found necessary. Insuch cases, it shall be ensured that the test checking of themeasurements & scrutiny of bills are completed before payment of thenext running bill.
43.2 Secured advances against the security of materials brought to site may bemade to the contractors whose contract is for finished work. In such
cases, the Competent Authority may sanction advances upto an amountnot exceeding 75 % of the value (invoiced/assessed value) of suchmaterials, provided that they are of a durable/non-fragile nature and thatan Indemnity Bond is drawn up with the, contractor under which the Banksecures a lien on the materials and is safeguarded against losses due tothe contractor postponing the execution of the work or to the shortage ormisuse of the materials, and against the expense entailed, if any, for theirproper watch and safe custody. Recoveries of advances so made shouldnot be postponed until the whole of the work entrusted to the contractoris completed. They should be made from his bills for works done as thematerials are used, the necessary deductions being made whenever the
item of work in which they are used are billed for. Secured advancesagainst the security of material brought to site will be made for workshaving value more than Rs.10 lac and the stipulated time of completion ismore than one month.
44. Arbitration : In case of any dispute between Bank and Contractor, the
decision taken by the Arbitrator who will be appointed by the bank will befinal.

45. Special Conditions of Contract :
45.1 Intending tenders shall visit the site and get acquainted with site
conditions and activities during the working hours before quoting therates.
45.2 All measurements shall be made as per CPWD norms.
45.3 Site should be cleaned every day and all the unusable material / malbashall be removed from the site and usable material shall be stackedproperly so that there is no hindrance for staff and public failing whichbank will remove the same at their level and suitable amount shall berecovered.
45.4 The contractor should shift office furniture / cabinets etc. required duringexecution of work and rearrange the same in the desired position aftercompletion of the work as per the direction of the bank.
45.5 The work should be carried out as per latest CPWD specification and asper the standard engineering practice.
45.6 The contractor will take all necessary precautions for carrying out thework avoiding any damage to the structure, partition, panelling etc. beforeexecution of job. If any damage is occurred during the execution, the
contractor will rectify the damages done at his cost.
45.7 The contractor shall employ competent supervisor for the work who shallbe available (by turn) throughout the working hours to receive andcomply with instruction of the employer.
45.8 The work permit shall be issued for 24 hours, however, being therestricted / controlled area most of the work is to be carried out afterworking hours and holidays for completion of work within the stipulatedtime. If the contractor works during office hours the contractor shouldensure that no hindrance or inconvenience to the Bank.
46. Preamble to Bill of Quantities
46.1 Rates quoted shall be for the items completed in all respect at allfloors/heights/levels including all taxes, octroi, VAT etc. and the cost of allmaterials, fittings, fixtures, all labours and for all the operations asdetailed in the specifications and contract conditions. Apart from other

factors mentioned in the specifications and contract conditions, ratesquoted for the items in this schedule shall also include the following :
46.1.1 Whether mentioned or not in the Bill of Quantities, all works are to be
carried out as per the drawings, designs, catalogues and or instructions ofthe Bank. Nothing extra shall be paid over the quoted rates for notunderstanding the designs etc. before hand.
46.1.2 Sample of all works/items shall be got approved from the Bank beforetaking the mass production in hand and nothing shall be paid for the costof samples.
46.1.3 Any incidental work required to complete the item and not specificallycovered in the item as mentioned in Bill of Quantities shall be completedat no extra cost.
46.1.4 Unless otherwise specified all exposed surfaces of wood/wooden moldingsand plywood of loose furniture/items tops shall be finished in at least two
coats of melamine polish, including staining to match the shades oflaminates etc.
46.1.5 Unless otherwise specified, all inner surfaces, sides and under sides offurniture items, drawers/cabinets shall be polished/Painted flat oil paintedas directed by Bank.
46.1.6 All exposed edges of plywood/block boards /particle board shall befinished with teak wood lippings of 5 mm thick of profile as per detail and
Melamine polished unless otherwise specified and no extra cost shall bepaid.
46.1.7 All furniture items shall be delivered at site packed in polythene sheets.46.1.8 All finished work must be truly vertical and horizontal or in any other
plane as shown and required true to lines and levels. The tenderers mustinspect the various existing surfaces and areas on which they have workon and take whatever measures necessary to achieve the objective andinclude the cost of the same in his rate as no extra will be payable for thispurpose.
46.1.9 The contractor shall be required to produce the manufacturer‟s certif icatefor the material supplied by them if asked by the bank. Notwithstandingthe manufacturer‟s certificate, employer can ask for testing of materials in
the approved test laboratories. The result shall satisfy the requirement ofthe relevant IS standards.
46.2 Wood Works:
46.2.1 Wherever ply is mentioned it will mean water proof & termite proof plywood.
46.2.2 All teak wood will mean C.P. teak.

46.3. Hardware:
46.3.1 Necessary handles, tower bolts, ball catchers, stoppers, hinges, brass/GIscrews, nails, locks, sliding rails, nut and bolts etc. shall be provided by
the Contractor which shall be out of the approved make of these materialsannexed in the technical specifications/approved by Bank.
46.4 Painting and Polishing:
46.4.1 All finishes, shade of colors, texture of fabrics including all surfaces offinishes like POP, painting, lamination, paneling, stitching joints inupholstery, all polishing shall be as per the satisfaction of the Bank.
46.4.2 Thoroughly brushing the surface to be finished, free from mortar droppingand other foreign matter including preparing the surface and sandpapering to give an even surface.
46.4.3 For painting and polishing items – on all kinds of wood and wood basedsurfaces.
46.4.4 All painting work to be completed with at least one coat of the primeralong with two coats of the paint as per the Technical Specification,Manufacturer‟s specification and to the satisfaction of the Bank.
46.4.5 All the polishing works to be completed with at least two coats of thepolish of the approved make as per the list of approved manufacturersand to the full satisfaction of the Bank.
46.5 Glass Works
46.5.1 The edges of glass tops for tables wherever shown shall be bevelled asper approval of the Bank.
46.6 False Ceiling
46.6.1 Rates should include materials/materials required to suspend the falseceiling with dash fasteners from the reinforcement of the slab andrepairing the portion without affecting the structural strength of the slab,also with provision of strip hangers/MS flats and hinged through nuts andbolts of adequate size (Raw plug shall not be applied). The channelsand hangers shall be as per the instructions of the Bank.
46.6.2 Cutouts and openings as required by Bank for provision of lights,switches, AC grills and diffusers, sprinklers and providing of trap doorsetc. and other fittings in false ceilings and holes and cutouts as requiredfor running conduits in frame work of paneling including cutouts forswitches and fittings in the paneling will be made by the Contractor. Hewill also provide necessary frame work support for fixing of lights ACdiffusers grills and fixtures etc. All these above will be made/provided by

him at no extra cost and will be deemed to be included in the rates of theitems quoted by him.
46.7 Partitions and Paneling
46.7.1 Quoted rate shall include labour /materials required to fix the sub-frameto the wall with MS flats („L‟/ „U‟) shape clamp with adequate screws andrepairing the portion damaged while putting the gutties etc. and makinggood the same.
46.7.2 Quoted rate shall be inclusive of making provisions for electrical conduitsand switch boxes and time required while coordinating with other
