PUA is a new strategy being utilized to reduce the timeline by allowing the department to use the property for utility relocations and construction

Relocation

Uniform Relocation Assistance and Real Property Acquisition Polices Act of 1970

Federal law where rules and regulations are followed when it comes to providing relocation payments and advisory assistance for displacees who are displaced by highway construction

Displacees are given at least thirty (30) days to vacate property after possession

Displacees sign Release of Property relinquishing all right to property, real or personal left on the site and hand over keys to department

Department secures property

Department can post signs to notify public that property belongs to the State of Texas and violators will be prosecuted

Clearing Right of Way for Utility Relocations Memo

Purpose of Memo

TxDOT implemented business process improvements of acquiring right of way early enough to allow utilities a years’ time to relocate prior to letting.

This has resulted in the need for Districts to be able to clear brush and trees from the right of way so utilities can be timely relocated.

To support the action ROW procured 8 demolition and disposal contracts totaling $42 million to remove brush and trees from the ROW for utilities to help the project meet the ‘Ready to Let’ definition.

Benefit to TxDOT is for expediting the utility relocation for utilities in the ROW under a Utility Installation Request (UIR) or Permit.

If there is no benefit to TxDOT, cost of clearing the ROW is reimbursable to the utility company if the utility adjustment is eligible for reimbursement.
