02/28/2018 BUSINESS UPDATES SB 825 State prisons: preapprenticeship program SB 825, as amended, Beall. State prisons: preapprenticeship program. (1) Existing law establishes a system of state prisons under the jurisdiction of the Department of Corrections and Rehabilitation. Existing law authorizes the department to institute various programs for inmates, including programs for education and job training. This bill would state the intent of the Legislature to enact legislation that would create a preapprenticeship program in the California state prisons. require the department to develop guidelines for inmate participation in preapprenticeship training programs, as specified. The bill would also require the department to coordinate with local state-approved apprenticeship programs and local building trade councils so that inmates who complete an inmate preapprenticeship program have a pathway to employment upon release. (2) Existing law authorizes the Department of General Services, the Department of Corrections and Rehabilitation, and various local agencies to use the design-build procurement process for specified public works under different laws. This bill would authorize the Department of Corrections and Rehabilitation to award contracts for construction projects over $500,000 using the design-build contracting process or construction manager at-risk contracts, as defined, if, on or before September 30,b2019, the department enters into a 10-year community workforce agreement with the State Building and Construction Trades Council of California that applies to all construction contracts over $500,000. The bill would require the community workforce agreement to include provisions to encourage work opportunities for previously incarcerated individuals who have completed an inmate preapprenticeship program and that support hiring opportunities for women and military service veterans. The bill would authorize the Secretary of the Department of Corrections and Rehabilitation to renew or modify the agreement for 5-year terms. AB 3222 Public works: prevailing wages AB 3222, as introduced, O'Donnell. Public works: prevailing wages. Existing law defines “public works,” for the purposes of regulating public works contracts, as, among other things, construction, alteration, demolition, installation, or repair work done under contract and paid for, in whole or in part, out of public funds. Existing law further requires that, except as specified, not less than the general prevailing rate of per diem wages be paid to workers employed on public works and imposes misdemeanor penalties for a willful violation of this requirement. This bill would expand the definition of “public works,” for the purposes of provisions relating to the prevailing rate of per diem wages, to also include any construction, alteration, demolition, installation, or repair work done under private contract on a project for a charter school, as defined, when the project is paid for, in whole or in part, with the proceeds of conduit revenue bonds, as defined, that were issued on or after January 1, 2019. Because the willful violation of prevailing wage requirements when engaged in these public works projects would result in the imposition of misdemeanor penalties, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Employers have a legal obligation to establish an effective injury and illness prevention program to promote health and safety in the workplace. Complying with safe and healthful work practices, includes first aid kits easily accessible to each work area, and training of at least one employee on each shift currently qualified to render first aid. Contractors are required, by law, to have an employee certified in CPR/First Aid on each job site. Sessions have limited space so register early. This course is designed to provide skills in CPR, First Aid & Automated External Defibrillation (AED). Students will learn adult CPR, rescue breathing and choke saving. Upon successful completion, students will receive the American Red Cross CPR & First Aid Certificate. Both CPR & First Aid Certificates are valid for 2 Years.

The National Joint Powers Alliance® (NJPA) issues this Invitation For Bid (IFB) on behalf of, and to provide Indefinite Quantity Construction Contracting (IQCC) services to all current and potential NJPA Members including all government agencies, education agencies to include colleges and universities, and non-profit agencies in the Imperial, San Diego, Southland, Central Coast, Central Valley, and Bay Areas in the State of California. It is the intention of NJPA to award multiple contracts for general building, general engineering, electrical, mechanical, roofing, and painting construction services in these areas. Each contract has an estimated annual value of $4,700,000 and the maximum term of the contract is four years.
IQCC is a construction contracting procurement system that provides facility owners’ access to competitively bid “on-call” general contractors to provide immediate construction services over an extended period of time.
Intending bidders are required to attend a pre-bid seminar which shall be conducted for the purpose of discussing the IQCC procurement system, the contract documents, and bid forms. Attendance at one of the seminars is a mandatory condition of bidding.

What’s better than getting a new driver’s license you can renew by mail? How about getting a waiver on testing to add new opportunity to your contractor license! These contractors learned that sometimes you can, and sometimes you can’t… Q: We currently have a “C-10” (Electrical) license. I am aware that we can do low voltage work with our current license, however some of our customer’s request that we have a “C-7” (Low Voltage) license in order to do telecommunications work. How difficult would it be to add that classification to our license? Would I have to take the test?
A: B&P Code section 7065.3 allows for Contractors to request a Waiver of the Trade Exam for some additional classifications - if the classification is closely related to your current license and is a significant portion of the work you perform. These Waiver requests are reviewed on a case-by-case basis and is dependent on your work experience and project background, but I believe you would have a pretty good chance of being approved to Waive the exam based on your “C-10” experience. Waiver requests need to be done in writing.
Q: I currently have an “A” (General Engineering) license in CA. While I know I can do concrete work with my “A” license, sometimes in order to do a foundation or a sidewalk, people want to see that we have the “C-8” (Concrete) classification on our license. How do I go about sitting for the exam and adding it to our license?
A: You will need to complete and submit the Application for Additional Classification. You will be required to show at least four years of full time work experience doing concrete work specifically. With regards to the exam, B&P Code Section 7065.3 allows the CSLB to consider a Waiver of the Trade exam for someone holding a closely related classification, if you can prove that concrete is a significant portion of your General Engineering work. Sweet! Waiver requests however are reviewed on a case-by-case basis and there is no assurance the CSLB will approve the request.
Q: In 2014 you helped one of our Officers replace the former owner of the company when he retired and he was able to Waive the exam based on his years of experience with the company. Now he wants to obtain his own license and so I have been designated to be the new Responsible Managing Officer (RMO). I have been with my company for over 15 years with various positions; Foreman, Supervisor, Project Manager, Estimator, and now hold the title of Vice President. Can you assist me with process of replacing the current RMO and asking for a Waiver of the Exams like you did for the current Qualifier a couple of years ago?
A: Yes and no. Let me clarify. We would be happy to assist you with the process of replacing your current Qualifier. It sounds like you have the requisite experience. Your current RMO requested a Waiver based on B&P Code Section 7065.1c, which allows for a Waiver of the Exam if you have worked for the company in a supervisory capacity for five out of the last seven years. Unfortunately, you will not qualify for the same Waiver of the Exams because 7065.1c further states that a company cannot make this request if they have requested a Waiver under that subdivision within the past five years.

Safety Tip of the WeekACCIDENT FACTORS
Accidents on construction projects cause too many painful injuries and claim far too many lives. Our primary concern when we discuss the factors or causes behind an accident is to find a way to prevent a recurrence. The cause of an accident can be found in two areas -- Unsafe Acts and Unsafe Conditions.
As a construction worker you control the first cause, Unsafe Acts. For example: a worker uses equipment that is defective or damaged, or they may use good equipment in a careless or other unsafe manner. Other examples of unsafe acts include disregarding posted warning signs, failure to wear a hard hat, smoking near flammables or explosives, working too close to power lines, handling chemicals or other hazardous materials improperly, putting your body or any part of it onto or into shafts or openings and lifting material incorrectly. (Just a short reminder -- always lift with your legs while keeping your back straight.)
The second accident factor or cause is Unsafe Conditions which can be found on many construction sites. Examples include inadequate or improperly installed guard rails or a lack of any guarding at all which most certainly will lead to an accident. Insufficient illumination, poor ventilation, electrical grounding requirements not observed, too few fire extinguishers available, containers that are not labeled, careless disposal of waste or excess material -- these are just a few of many unsafe conditions that may be caused by co-workers, subcontractors, or the general contractor.
You can make a difference by taking the time to perform your work safely and reporting any unsafe condition you discover to your supervisor immediately.
When the cause behind the accident is found, you'll find that safety on the job plays a major part in preventing that accident from occurring again. If everyone on the job cooperates, injury and death statistics will be reduced and it will be much safer for you to do your job.
