TO: Omar Sims, Chair – Governmental Operations Committee FROM: David Leyton, Prosecuting Attorney DATE: February 4, 2013 Request: I respectfully request to appear before the Governmental Operations Committee on February 13, 2013 and to be placed on the meeting agenda for the purpose of requesting approval to accept a $1,000 grant/donation. Explanation: DaVita, Inc., a national dialysis company with a local presence, has a practice of providing grants to local institutions as part of its corporate responsibility outreaches. A local DaVita representative came into contact with one of our Crime Victim Advocates, Lisa Baker, when Ms. Baker was assisting an individual in obtaining a birth certificate. From that contact, DaVita Inc. offered to the Prosecutor’s Crime Victim division a $1,000.00 donation for the purpose of assisting us in purchasing a witness screen. This device allows a child or other vulnerable witness to testify in court without having to see a perpetrator-defendant whose presence may intimidate the witness into not testifying. Recent court decisions have held that, in appropriate circumstances, and in the discretion of the judge, witness screens may be used. The cost of a basic witness screen is about $1,500.00. This donation, in combination with about $500.00 from a small reserve fund in our Crime Victim budget, will allow us to make the purchase of the witness screen, thereby benefitting certain testifying victims with no other appropriation necessary. Action Requested: Approval to accept this grant/donation so that we may purchase the witness screen.
