The objectives of the Bill of Quantities are
(a) to provide sufficient information on the quantities of Works to be performed to
enable bids to be prepared efficiently and accurately; and
(b) when a Contract has been entered into, to provide a priced Bill of Quantities for use
in the periodic valuation of Works executed.
In order to attain these objectives, Works have been itemized in the Bill of Quantities in
sufficient detail to distinguish between the different classes of Works, or between Works
of the same nature carried out in differently or in other circumstances which may give
rise to different considerations of cost.
The Bills of Quantities for the Works comprise the following:

Individual boulders of size greater than 0.2m3 in volume shall be included in “rock” when
their nature and size are such that they cannot be removed without recourse to the
stated methods.Where their aggregate volume is 50% or more of the total volume of
material removed, the material shall be measured as rock throughout.
The Bills of Quantities shall be referenced and read in conjuction with clauses numbered
in the Specifications.
The Contractor’s unit rates in these bills are to cover supplying of materials, taking
delivery, transporting, loading and off loading inspection, storage, stacking, landing,
preparation, installation including provision of all labour, requirement false work,
temporary support, surface preparation and testing of the works. The rates shall include
all applicable taxes and duty. The cost of testing of the materials to be used in the works
unless otherwise provided is to be included in the rates of the respective Bill items.
Measurement for payment shall be for the complete installation and having passed all
necessary tests.
“Rock” is any material which, in the opinion of the Engineer, requires for its removal the
use of explosives, sledgehammers and wedges, breaking tools or which cannot be
removed by a 145 KW tractor with rear-mounted heavy duty ripper.
Work shall not be executed on a Day work basis unless ordered in writing by the
Consultant on approval by the Employer. The rates entered in the Day works Bill of
Quantities shall apply to any quantity of Day work instructed by the Consultant. Nominal
quantities have been indicated against each item to permit the extended total to be
carried forward to the Grand Summary.
Payments for labour under Day works shall be made against records of the time of arrival
of the labour at the site of the work to be executed to the time of departure but
excluding meal breaks and rest periods. Only the time of classes of labour directly doing
the work will be paid for; charge hands (working gangers) actually working with their
gangs will also be recorded for payment but the time of foremen or other supervisory
personnel will not be paid.
Payment for the classes of labour will be made at the rates entered in this Bill. These
rates shall cover all direct costs including, but not limited to, the amount of wages paid to
such labour, transportation time, overtime, subsistence allowances and such social
benefits as required by law.
The rates for labour shall also be deemed to cover the Contractor’s profit, overheads,
superintendence, administrative costs, liabilities, insurance and allowances to labour and
the use of consumable stores, water, lighting and power, workshop and stores, staging
and scaffolding, portable power tools, hand tools and equipment and any charges
incidental to the foregoing.

Bills of Quantities are to be read in conjunction with the Instructions to Bidders, the
Conditions of Contract Data, the Specifications and the Drawings. The quantities stated
against each item in the Bills of Quantities, with the exception of those items specifically
marked ‘sum’, are the estimated quantities of the Work to be executed by the Contractor
in fulfillment of his obligations under the Contract.
Payment for materials used in Day works shall be made at the rates entered in this Bill.
These rates shall include invoiced price, freight, insurance, handling charges, unavoidable
damage and delivery to store and / or site together with stockpiling as required. These
rates shall also include the Contractor’s profit and overheads.
Where materials other than those entered in this Bill are to be procured for use on the
Works, the basic rate shall be calculated on the invoiced purchase price plus the costs of
insurance, handling charges, unavoidable damage and delivery to store or site. Payment
will be made in the currency expended upon presentation of supporting documentation.
In addition, a percentage on the base rates will be allowed to cover the Contractor’s
overheads and profit: this percentage must be stated in this Bill.
The cost of hauling and handling materials for use on Day works from store or stockpile
to the place of usage will be paid in accordance with the labour and Contractor’s
equipment rates in this Bill.
Payment for equipment available at site in respect of Day works shall be made at the
rates entered in this Bill. These rates shall be deemed to include allowance for
depreciation, interest, indemnity and insurance, repair and maintenance, supplies, fuel,
lubricants and other consumables, overheads, profit and administrative costs related to
the use of such equipment.
The costs of drivers, plant operators and assistants in respect of plant and equipment
deployed on Day works shall be paid for separately under the appropriate items in the
labour section of the Day works.
Payment for the Equipment shall only be made against actual hours worked except that
where applicable, and with prior agreement of the Engineer, the traveling time to and
from the Day work location shall also be included for payment.
“Rates and prices shall be inserted in the rate and total columns of the Bill of Quantities
in Uganda Shillings
The Contractor is required to check the number of the pages and should any be found to
be missing or in duplicate he must inform the Engineer at once and have the same
rectified.
No liability whatever will be admitted or claim allowed in respect of errors in the
Contractor’s tender due to mistakes in the Bills of Quantities which should have been
rectified in the manner described above.

The contractor shall not alter or otherwise qualify the text of these Bills of Quantities.
Any alteration or qualification made without authority will be ignored and the text of the
Bills of Quantities as printed will be adhered to.
Each item in the Bills of Quantities is to be priced. If any items are left un-priced it will be
assumed that the value of the work described there under is elsewhere allowed for. The
prices and rates to be inserted in the Bills of Quantities are to be fully inclusive of all
costs and expenses which may be required for the construction of the work described,
together with general risks, liabilities and obligations set forth or implied in these
documents.
In no case will any claim for expenses incurred by the Contractor in preparation of this
Tender be allowed.
The Contractor is solely responsible for the accurate ordering of materials in accordance
with the Specifications, Drawings and Engineer’s Instructions and no claim for any loss or
expense will be entertained for orders for materials based on the Bills of Quantities.
The quantities given in the Bills of Quantities are estimated and no claim by the
Contractor for the final quantities being larger or smaller than the quantities given in the
Bills of Quantities will be permitted except in accordance with Clause 38 of the
Conditions of Contract.
“Provisional Item” designated in the Bill of Quantities for the execution of any part of the
Works may be carried out in whole or in part, or not at all on the instruction of the
Engineer.
The dimensions given in the Drawings are generally in millimeters unless otherwise
indicated. Levels are given in meters.
The term ‘provide’ or ‘supply’ used for any item shall be deemed to include transport to
site, handling, storage and fixing complete, and the Bidder’s rate shall include for this.

Wherever in these Bills of Quantities the Contractor does not insert his
price against an item, the value of such work items shall be deemed to
be included in his rates for all other priced items in the Bills of Quantities.
Contractor. The term “Contractor” wherever used hereinafter and in all
contract documents shall be held to mean the successful bidder, i.e. the
person or persons , partnership, firm or corporate body whose bid for
this work (i.e. the work described in and or referred to in these Bills of
quantities) who has been accepted by the Employer and is named as
such in the agreement, and means provider as defined in the Public
Procurement and Disposal of Public Assets Act 2003

The Terms and Abbreviations used in these bidding Documents Shall be
deemed to have the following meaning wherever used herein after and
in all tender documents:
"Approved" (and words derived there from) shall mean approved in
writing by the Project Manager.
"As Described" or "As Specified" shall mean as shown on the drawings,
as described in the technical specifications or in the Bills of quantities or
as described elsewhere in the contract documents
Directed, "Selected", "As Required" or words of similar meaning
whenever used in the contract documents shall be understood to mean
the direction, selection or requirement of the Project Manager.
Employer. The term “Employer” wherever used hereinafter and in all
contract documents shall mean Ministry of Education and Sports
" In Writing" shall mean when its required to inform, instruct, agree,
confirm, obtain approval or obtain instructions; it must be done in
writing.
"Instructions" ( and words derived there from) shall mean the
instructions in writing of the Project Manager specified.
"Fix only" shall mean take delivery of materials or articles at the place
specified, pay all demurrage and transport charges, load and transport to
site, unload, store, unpack, check contents against orders and packing
list, assemble as necessary, distribute to position, hoist and fix only.

"Necessary","Proper" or words of similar meaning wherever used with
respect to the extent, conduct or character of the work described shall
mean the said work shall be executed to the extent, must be conducted
in a manner or be of character which is 'necessary' or 'proper' in the
opinion of the Project Manager
" Otherwise Described" or " Otherwise Specified" shall mean
information that may be in the drawings or in the particular specification
or contained in the written instructions of the Project Manager which
may override these Bills of quantities.
The Name “Project Manager” or “Architect” or “Engineer” or “Quantity
Surveyor” is the person named in the Particular Conditions of the
Contract(or any other competent person appointed by the Employer)
who is responsible for supervising the execution of the works and
administration of the contract.
"BSM" shall mean both sides measured

The Contractor shall be required to visit the site and he shall be deemed
to have acquainted himself therewith as to the nature and position and
means of access, etc. Claims arising from the Contractor's failure to
comply with above condition shall not be entertained
No claims will be allowed for travelling or other expenses, which may be
incurred by the Contractor in visiting the Site for the Bid of the Works.

Description
Contractor shall leave blank any cells referring to items he has priced or
included elsewhere within the respective work package.
If the Project manager is of the opinion that any item in this section has not
been fully attended by the Contractor, the Project manager may adjust
amounts quoted by the Contractor for the items concerned.
The Tenderer is required to visit the site of the proposed work, as it is their
responsibility to ascertain the conditions governing access to the site, the
external working space, storage area etc.,
Cost and expenses in connection with any other preliminary item which is
not listed below, but is necessary for the due completion of works, is
deemed to be included in the tender rates.
Total Carried to Collection
Mechanical plant and equipment which emits excessive noise, smoke,
fumes, obnoxious gases etc., will not be allowed to be used in the site,
without the prior approval of the Project manager
The contractor shall be responsible for any loss or damage to the works,
existing structures, adjoining structures and unfixed materials.
The Tenderer shall read, understand and acquaint himself with the
requirements in the conditions of contract , Technical Specification of Work,
Tender and Preamble Notes. It is the Tenderer's responsibility to see that
their price includes for compliance with all the above requirements whether
specifically referred to in the Bills of Quantities or otherwise.
The contractor shall be responsible for providing necessary lighting,
watchmen, and other suitable security measures during construction until
handing over.
Cost and expenses in connection with providing any protective netting,
fencing, screens, barricades, railing, walk-ways at site and any other safety
precautions to the required standard, is deemed to be included in the
tender rates unless otherwise measured and paid separately.
If no price has been stated against any item hereunder the Contractor will
not be entitled to claim any money for such items even though he is obliged
to execute the work or provide services described therein. Preliminary
items priced by the Tenderer are deem to include the cost of not-priced
items.

VISITING AND INSPECTION OF SITE
Site:
The site of the proposed works are located at KALONGO VOCATIONAL
TECHNICAL INSTITUTE IN AGAGO DISTRICT.
The Contractor shall be required to visit and inspect the site before
submitting his bid to ascertain and fully acquaint himself with the nature of
the site and works and adjoining property and other services that are
necessary for the smooth carrying out of the works.
Claims arising from the Contractor's failure to adhere with the above
conditions shall not be entertained
DRAWINGS
The drawings from which these Bills of quantities and the specifications
have been prepared are contained in Volume 3 of 5 of the bidding
document. However, some of the measurements were taken on site. The
said drawings form part of the contract documents. The Contractor is
deemed to have examined the drawings before bidding and to have
satisfied himself regarding their details and regarding the nature and extent
of the works and the method of construction involved. No claims arising out
of misapprehension in these respects will be allowed.
MATERIALS FOUND ON SITE AND ARISING OUT OF THE WORKS.
Materials of any kind arising from the works, found on site or during the
progress of the work, including debris arising from demolitions, are the
property of the Employer and shall not be used, or taken out by any means
whatsoever by the Contractor without express and written permission from
the Project Manager. Should such permission be given, the Contractor shall
pay the Employer for materials so used or taken out at a price to be
determined by the Employer. the Contractor shall take charge of such
materials and deliver the same to the Employer in good order.
DESCRIPTION OF WORKS
The works involve substructures, Concrete Structural Frame, Concrete Block
Walling, Steel structure, steel roof structure, roofing sheets, Timber or Steel
Casement doors, Steel casement Windows, Tiled or Terrazo or Screeded
floor finish, Tiled or Painting to Plastered Walls, Plastered Metal Lathe
Ceiling, Plumbing and Electrical Installations, Fittings and Fixtures and
Associated External Works include.

SUFFICIENCY OF BID
The Contractor shall be deemed to have satisfied himself before bidding as
to the correctness and sufficiency of his bid for the Works and of the rates
and prices stated in the Bills of Quantities which rates and prices shall cover
all his obligations under the Contract and all matters and things necessary
for the proper completion and maintenance of the works
GENERAL MATTERS
Plant, Tools and Vehicles.
The Contractor shall be responsible for the provision of all materials, tools,
plants, staging, access gangways, tackle, tarpaulins, tools, moulds,
templates, cranes, pulleys and transport required for the Works except
insofar as may be stated otherwise herein and he shall allow for the
provision of the foregoing except for such items specifically and only
required for the use of the Nominated Sub-Contractors as described herein.
Safety, Health and Welfare of Work ,People. (OHS Provisions)
Due precautions shall be taken by the Contractor at his own cost, for the
safety of his labour and personnel. In collaboration with and to the
requirements of the local health authorities he must ensure that healthy
and safety staff, first aid equipment and stores person are available at the:-
camps, housing and on the site at all times throughout the period of the
Contract. Suitable arrangements are to be made by the Contractor for anti-
malarial precautions and for preventation of epidemics and for all necessary
welfare and hygiene requirements. A warning sign to the effect that safety
gear such as helmets, safety boots/gum boots, overalls, reflectors, ear plugs
glooves, gogles, nose masks where necessary are to be worn should be
clearly displayed at the Works. The Contractor shall ensure that all
personnel working on site wear necessary safety gears.

iii) The Contractor shall allow for removing the said Water borne toilets and
abolutions, filling pits with hardcore and murram and leaving the ground
clean, free from pollution upon completion of the Works to the satisfaction
of the Health and Medical Authorities.

The Contractor shall provide a qualified health and safety officer to deal
with OHS, HIV/AIDS and Gender Awareness and provide all necessary
facilities including transport. HIV/AIDS and STD prevention and counselling
shall include information, education and counselling campaigns including
regular distribution of condoms. The Contractor shall provide, maintain and
operate a HIV/AIDS and STD clinic or make alternative arrangements with
an existing facility to the approval of the Project Manager. The Contractor
shall have a gender action plan and also carry out Gender sensitization and
awareness raising meetings and workshops and provide gender sensitive
monitoring and reporting.
The Contractor shall pay rates of wages and observe hours and conditions of
labour not less favourable than the minimum rates of remuneration and
minimum conditions of employment applicable in the district in which the
works is carried out. The relevant notice must be posted up and kept posted
upon the Site where it can conveniently be read by the employees
concerned.
Sanitation of the Works shall be arranged and maintained by the Contractor
to the satisfaction of the Government and Local Authorities, Labour
Department and the Project Manager.
The Contractor shall allow for providing the necessary waterborne toilets
and abolutions for the labour employed on the Works, including labour
employed by Sub-Contractors, to the satisfaction of the Local Health and
Medical Authorities and for maintaining the same in a thoroughly clean and
sanitary condition and paying all conservancy fees.

Notices and Fees for local Authorities and Public undertaking
The Contractor shall give all notices in accordance with the Conditions of
Contract. The Contractor shall pay all fees and charges required in the
Conditions of Contract. The amount of all such fees and charges shall be
deemed to be included in the contract Sum. Those in respect of the
following items are included elsewhere in this Document if applicable to the
works; temporary telephones, Uganda Telecom Limited, water for the works
(National water and sewerage corporation) & Electricity (UMEME), Local
Authority, Ministry of Gender, Labor and Social Development and National
Environmental Management Authority (NEMA)
Setting out the Works
The Contractor shall set out the Works in accordance with the dimension
and levels shown on the Drawings and shall be responsible for the
correctness of all dimensions and levels so set out by him and will be
required to amend all errors arising from inaccurate setting out at his own
cost and expense. In the event of any error or discrepancy in the dimensions
or levels marked on the Drawings being discovered, such errors or
discrepancies shall be reported by the Contractor to the Project Manager for
his immediate attention.
No Work shall be commenced by the Contractor until he has received
written instruction from the Project Manager to adjust such discrepancies
which may be proved. Upon receipt of such instructions, the Contractor
shall thereupon be responsible for accurate setting out of the Works, giving
effect to the adjustments necessary to comply with such instructions, and
no claim for extra expense or relief from the provision based on any
discrepancy or error in the dimensions or levels shown on the Drawings may
be made thereafter.Before any Work is commenced by the Sub-Contractors or Specialized Firms,
dimensions must be checked on the Site and / or buildings and agreed with
the Contractor, irrespective of the comparative dimensions shown on the
Drawings. The Contractor shall be responsible for the accuracy of such
dimensions.
The Contractor shall permanently deploy the Project and Site Administrative
Staff as presented in their bid and approved by the Employer. These will
include a site Engineer, a contract Manager, General Foreman-in-charge and
other trades foremen properly qualified and fluent in English. The
Contractor shall submit to the Project Manager a Site Organization Structure
Chart within seven (7) days of commencement of the Contract. The
Contractor's attention is drawn to clause 9 of the Conditions of Contract.

The Contractor shall include in his prices for the transport of materials,
workmen and other inputs to and from the Site of the proposed Works, at
such hours and such routes as are permitted by the Project Manager and
the Authorities.
Working hours
No work shall be carried out at night or gazzetted holidays unless the
Project Manager shall so direct.
If the Contractor decides for purposes of expediting the works or any other
reason to permit the working of overtime or night work necessary so that
the works or any part shall be completed in the contract, then he will be
deemed to have included for the same in his bid as no extra payment will be
allowed for this in the settlement of accounts.
In the event the Project Manager directs the Contractor in writing to carry
out work outside working hours, the Contractor will be reimbursed the net
difference in cost between the operatives normal rate of pay and the
enhanced overtime rate.
PREVENTION OF ACCIDENTS, NUISANCE, DAMAGE OR LOSS
Labour regulations
The Contractor shall comply and ensure that all persons and organisations
involved in executing the works (including sub Contractors and those not
directly employed) comply with the relevant current Uganda government
labour regulations, acts and orders regarding emoluments, working hours
and working conditions.
Safety
The Contractor shall take all precautions necessary to ensure the safety of
all persons engaged upon or visiting the works and shall observe strictly the
safety regulations of government and /or local authorities.
Fire Precaution
The Contractor shall take all precautions necessary to prevent loss or
damage by fire to works or to the adjacent property.

Nuisance
The Contractor shall take any reasonable and practical precaution consistent
with good and expeditious work to prevent nuisance from noise, water,
smoke, dust, rubbish and other causes to the occupants of the existing and
adjacent buildings and to the public generally and shall meet the cost of
complying with the Project Manager's instructions to prevent such nuisance
in these respects.
Adjoining Property
The Contractor shall prevent any trespass on any adjoining buildings or
property and materials, plant, rubbish collecting on such adjoining buildings
or property as a result of his carrying out of the works.
Should the Contractor wish to make use of such adjoining buildings or
property, he shall obtain prior permission in writing of the owner and/ or
occupier and approval from the Project Manager, pay any charges in
connection therewith and clear away at completion or when directed by the
owner's/occupier's satisfaction and that of the Project Manager.
Existing public and Private Services

The Contractor shall notify all services authorities of the proposed works
before commencing operations on site. Prior to the commencement of any
Work, the Contractor is to ascertain from the relevant Authorities the exact
position, depth and levels of all existing telephone cables, electric cables,
water pipes or other services in the vicinity.
The Contractor shall not interfere with the operation of any service on or
within the vicinity of the site prior to consent or direction of the service
authority and the Project Manager. Should the service authorities so direct,
the Contractor shall make whatever provisions may be required by the
Authorities concerned for the support and protection of such services.Any damage or disturbance caused to any service shall be reported
immediately to the Project Manager and the relevant Authority and shall be
made good to their satisfaction at the Contractor's expense.
Maintenance of existing private and public roads
The Contractor shall keep the approaches to site clear of mud, pools, debris,
spoils and ensure that no damage is caused to the public or private roads
and foot paths
The Contractor will be required to make good, at his own expense, any
damage he may cause to the present road surfaces and pavements during
the period of the Works. In particular all the existing lawns, gardens, storm
water channels, hedges, fences etc., which may be destroyed or damaged
during the progress of the Works are to be made good by the Contractor to
the approval of the Project Manager.

Prior to the commencement of any Work, the Contractor shall protect all
existing structures, fences, gates, walls, services, cables and other features
on site which are to remain in position during and after the execution of the
works unless directed otherwise by the Project Manager.
Security Regulations
The Contractor shall be entirely responsible for the security of all the Works,
stores, materials, plant, personnel, Take all reasonable precaution to
prevent unauthorized access to the site and the works. Both of his own and
Sub-Contractors’, and shall provide all necessary watching, lighting and
other precautions as necessary as to ensure the security and the protection
of the public. The Contractor shall therefore provide and maintain qualified
technical and administrative personnel on site, fluent in English with
suitable and relevant office equipment like computers and furniture and he
shall provide and maintain appropriate armed security for proper protection
of the Works, Materials and plant at the site in conformity to any security
regulations of the Project Manager
OBLIGATIONS IMPOSED BY THE EMPLOYER
Materials and Workmanship generally
Scope: Where work shown on the drawings or required by the Project
manger or the particular specification is not identified by any single heading
or clause in the technical specifications, all relevant clauses for similar work
will be applicable. External works are not separately specified, and are to be
executed in accordance with the relevant trades or sub trades.
Alterations, Additions and Extensions: Where the works include alterations
or extensions to the existing buildings and/or external works, new work is to
match up in all respects to the existing works unless otherwise specified,
shown on the drawings or approved forehand by the Project Manager.
Quality, Samples, Testing and Approval
Materials, goods, components and equipment shall be new and unused
unless specified.Manufacturer's Recommendations: the Contractor shall handle, store, fix
every material , good or component strictly in accordance with the printed
or written recommendations of the manufacturer and or supplier. The
Contractor shall supply the Project Manager with copies of the
manufacturer's recommendations. The Contractor shall notify the Project
Manager if the manufacturer's recommendations conflict with any specified
requirements, and obtain the Project Manager's instructions before
proceeding.

Evidence of Compliance with the Standards
Where specified or required by the Project Manager, the Contractor shall
obtain and produce invoices, delivery notes, certificates and the like
providing evidence of compliance with the specifications and standards
referred to herein.Suitability with local conditions
All materials, goods and components shall be for suitable use in tropical.
Sources: Where a choice of manufacturer is allowed for any particular
materials or goods or component, the Contractor shall obtain the quantity
required to complete the works from a single manufacturer after obtaining
the consent of the Project Manager to any change in the source of supply.
The Contractor shall produce written evidence of the source of supply when
requested by the Project Manager.
The Contractor shall furnish at the earliest possible opportunity before work
commences at his own cost, any samples of materials of workmanship that
may be called for by the Project Manager for his approval or rejection and
any further samples in the case of rejection until such samples are approved
by the Project Manager and such samples when approved shall be the
minimum standard for the work to which they apply.
TestingAllow for Testing of materials, goods components and workmanship and shall
be done at the discretion of the Project Manager in order to satisfy himself that
the materials, goods components and workmanship are in accordance with the
specifications. The testing of materials will unless otherwise stated , be carried
out either by the chief Materials Engineer at the central materials laboratory in
Kireka, Kampala, or by the Project Manager's representative on site when
facilities for such site tests exist. The procedure for submitting samples of
materials for testing and the method of making for identification of materials
for testing shall be as laid down by the Project Manager.
The Project Manager may, whenever he considers it desirable, test any
materials before they leave the maker's premises as well as after delivery on
the site and the Project Manager shall be at liberty to reject any materials after
delivery should he consider them unsatisfactory, notwithstanding the
preliminary test and approval of the materials at the maker's premises. The
costs of these tests are to be borne by the Contractor.The Contractor shall, whenever so instructed by the Project Manager, cut
out sections of work executed or samples of materials incorporated therein
and shall deliver them where directed for the purpose of testing.
All work disturbed shall be made good forth with by the Contractor. All costs
incurred in cutting out, making good and delivering as aforesaid, shall be
borne by the Contractor unless the result of the test shows that the
materials etc., are in accordance with this contract.

Ordering of materialsThe Contractor shall be solely responsible for the early, timely and accurate
ordering of all the materials. The Contractor shall be responsible for
organization of the plant and labour for utilisation of the materials in
accordance with technical specifications and the Project Manager's
instructions.
The Contractor shall take his own measurements and make his own
calculations of quantities for ordering of materials. No reasonability or claim
will be accepted by the Employer for surplus, shortage, loss, or expense if
the goods are wrongly ordered or ordered based upon the Bills of
quantities. The Contractor shall replace or make good at his own expense
any materials lost or damaged, no matter how arising.
The Contractor shall enter into a binding contract with his suppliers
Imported Material and Special Items
When imported materials or special items of materials, goods or
components form part of the contract, the Contractor shall be entirely
responsible for making all necessary arrangements and placing all necessary
orders to ensure their prompt and timely arrival on site to suit the building
operations. No claim for an extension of time will be entertained by the
Project Manager unless the Contractor can produce reasonable proof that
the delay is beyond his control. The Contractor shall allow for costs and
expenses arising out of government or Uganda Revenue Authority
regulations governing imported goods.
Legally Demandable taxes and duties
The Contractor shall unless expressly specified otherwise in the contract
documents, be responsible for and shall pay all customs and excise duties,
tariffs, value added tax, and other taxes or duty legally demandable and
imposed by any statute, rule or ordinance as may be or may become
applicable during the course of the works.
Compliance to NEMA regulations and recommendations
The Contractor shall comply with the regulations set out by National
Environmental Management Authority (NEMA). The Contractor should
familiarize himself with the recommendations in the certificate of approval
of the ESIA/project brief and comply with them during the excecution of the
works. In addition the contractor should ensure that all the
recommendations/mitigation measures in the Environmental and Social
management Plan (ESMP) are complied with during the implementation.

TEMPORARY WORKS AND SERVICES
The Contractor shall allow for providing all temporary water supplies
required for the works, including Sub-Contract Works, together with all
necessary storage tanks and distribution systems for the same and must
allow for bearing all expenses incurred and paying for all water consumed
without charge to any Sub-Contractor. Expenses in connection with
Nominated Sub-Contractors should be allowed for in the attendance items
under the relevant P.C. Sums.No guarantee or warranty is given as to the availability or suitability of
water at the site. The contractor shall further ensure that their temporary
water connection and supply doesnot in any way affect the existing
connections and water resources.
The Contractor shall allow for providing all temporary lighting and power
supplies required for the works, including Sub-Contract works, together
with all necessary distribution systems for the same and must allow for
bearing all expenses incurred and paying for all current consumed without
charge to any Sub-Contractor. Expenses in connection with Nominated Sub-
Contractors should be allowed for in the attendance items under the
relevant P.C. Sums.
No guarantee or warranty is given as to the availability or suitability of
power at the site. The contractor shall further ensure that their temporary
power connection and supply doesnot in any way affect the existing
connections and power resources.
The Contractor shall provide, install and maintain temporary telephone and
similar facilities for his use, Clerk of Works, project manager's
representative and for other personnel engaged in the implementation of
the Project from the commencement to the completion of the Contract and
shall pay all charges in connection therewith.
Roads
The Contractor shall provide and maintain as necessary all temporary roads,
ramps, hard standings, tracks, crossings and the like for the efficient running
of the works for all vehicles entering and on site, including those of sub-
Contractors and afterwards remove and reinstate the ground to its original
condition if so directed by the Project Manager.
Upon the completion of the Works, the Contractor shall remove such
temporary roads, culverts, bridges, etc., and make good and reinstate all
Works and services disturbed to the satisfaction of the Project Manager and
local authority.

The Contractor shall at his own cost, supply and erect all temporary
buildings, sheds, mess rooms and stores with floors at least 150mm above
ground level. No office, stores or other temporary buildings shall be erected
on Site without first obtaining the consent from the Project Manager as to
the type of temporary building to be supplied and the position in which
they are to be erected and shall remove the same on completion and make
good all surfaces disturbed.
The Contractor shall provide, erect and maintain on the site, in such
positions as may be directed, ample temporary watertight lock-up sheds or
buildings which are necessary for himself and his Sub-Contractors for the
proper storage and protection of materials liable to damage and shall
remove the same on completion and make good all surfaces disturbed.
Due to limited space on the site, the Contractor may make other
arrangements for the safe storage of materials off-site and shall pay all
charges of transport, handling, insurance, security and rentals of the stores /
buildings so rented.
The Contractor shall provide and erect where directed and maintain during
the whole period of building operations and remove at completion, 3No.
approved temporary two faced signboard to the Project Manager’s standard
design and giving the title of the Works and showing the names of the
Employer, Project Manager, Contractor, Nominated Sub-Contractors and
Suppliers, on both sides. The lettering concerning the Project Manager is
not to be more than 75mm high. No other industrial names will be
permitted whatsoever , nor will any advertisement be allowed.
Signboard shall also include the HIV log & Artistic impression of one of the
major building as approved by the Project Manager.
Temporary Hoardings, Fencing and the like
Area to be occupied by the Contractor
The area of the Site which may be occupied by the Contractor for use as
storage and for the purpose of erecting workshops, etc., shall be defined on
the Site by the Project Manager.
The Contractor shall allow for providing and erecting all necessary
protective hoarding construction in new gauge 30 precoated non reflective
iron sheets on treated timber framework with lockable gates to approval of
the Project Manager and Local Authority.
The Contractor shall allow for thoroughly maintaining all such protective
and other devices throughout the Contract and clearing away and making
good disturbed ground on completion.

A Office for the Project Manager and his staff
The office and the closets shall be completed before the Contractor is
permitted to commence the Works.
The Contractor shall provide, erect and maintain where directed on site an
approved weather proof office for the use of the Clerk of Works. The office
shall be not less than 40 Sm and shall be of construction similar to the office
of the consultants. The office shall be furnished with 5 No. desk with
lockable drawers, 5 No. A0 Size drawing chest with four lockable drawers, 5
No. lockable metal filing cabinet. The office shall have 5 office swivel chairs
for the occupants. The office shall also have all power and lighting points as
necessary. The Contractor shall allow for regular cleaning of the office.

The Contractor shall provide, erect and maintain where directed on Site
approved weatherproof lockup office for the sole use of the Project
Manager with a floor area not less than 60 square metres. The office shall
be constructed with concrete floor and the walls and ceiling internally are to
be lined with fibreboard. Atleast 4 Glazed windows shall be provided of not
less than 1(one) squaremetre area each and the door shall have a strong
lock or fastening. The office shall be provided with sufficient artificial
lighting and electric power. The office is to be furnished with a table of
sufficient size to carry the drawings, complete with lockable drawers, and
also stools and chairs. The table should be adequate to sit at least 50 (Fifty)
people. The Contractor shall also provide Five (5 No) working desks and
furniture for the Project Manager. The Contractor shall allow for regular
cleaning of the office. The Contractor shall keep on the Site and maintain in good condition, one
dumpy or quickset level, leveling staff, two 7.5meters steel tapes and one
100 meters steel tape for the use of the Consultant. The Contractor shall
also provide stationery for use by the Project Manager.
He shall provide, erect and maintain a two lockup pedestal type water
closets for the sole use of the Consultant including making temporary
connection to drain where applicable to the satisfaction of the Government
and Medical officers of Health and shall provide the services of a cleaner
and pay all conservancy charges and keep both office and closets clean and
in sanitary condition from the commencement to the completion of the
Works and dismantle and make good disturbed surfaces to the satisfaction
of the Project Manager on completion of the Works.

PROCEDURES
Programme and progress chart
The Contractor shall submit to the Project Manager within 30 days from the
date for possession of the site, for approval and display in the site offices
(5No. A3 and 5No. A1 hard copies and 1No. soft copy) showing the general
methods, arrangements, order, and timing for all the activities in the Works
including the works of sub Contractors and other concurrent with the
contract. An update of the Program shall be a program showing the actual
progress achieved on each activity against the planned progress and the
effect of the progress achieved on the timing of the remaining work,
including any changes to the sequence of the activities .The Contractor shall
keep this chart up to date at all times.
If required by the Project Manager, this chart shall be generated and up-
dated by an approved computer program.
Approval by the Project Manager of the programme shall not relieve the
Contractor of any of his obligations under this Contract.

Site Meetings will be held at the Site meeting room set up on site by the
Contractor at monthly intervals or as directed otherwise by the Project
Manager, and the Contractor will be required to summon the attendance of
sub Contractors and specialists and generally arrange for all necessary
provisions and facilities required for the meetings. The Project Manager will
take and distribute minutes of the site meetings.
The Contractor is required to provide Lunch and refreshments to all persons
attending the regular scheduled site meetings for all the construction period
whose menus are to be decided by the Project Manager.
Works, Diary and Visitors Book
If the Project Manager ascertains that work progress does not match the
programme, he may order the Contractor to revise the programme. The
Contractor shall thereafter revise the programme to show the modifications
necessary to ensure completion of the works by the Date of Practical
Completion.
The Project Manager shall notify the Contractor if the Project Manager
ascertains that the rate of progress of the works or any section, is too slow
to meet the Date for Practical Completion and that this is not due to a
circumstance for which the Contractor is entitled to an extension of time
under the Contract.
Following receipt of such a notice, the Contractor shall take such steps as
may be necessary, and as the Project Manager may approve, to remedy or
mitigate the likely delay, including revision of the programme. The
Contractor shall not be entitled to any additional payment for taking such
steps.
Site progress photographs
The Contractor shall provide and keep an accurate site diary in which he
shall record all happenings and events which might affect the progress and
quality of the works, including weather conditions, number of artisans,
labourers and others employed, deliveries of materials, consignment,
dayworks, overtime, work of sub Contractors and visits to the site of
supervisory and other staff of the Employer.
Entries made in the works diary by the Project manager or his authorised
representatives shall be deemed to be written instructions issued in
accordance with the conditions of contract.

Day works shall only be executed with the prior permission of the Project
Manager. Where its authority is given day-work sheets giving the fullest
particulars of hours worked, names of craftsmen and labourers, descriptions
of work executed, quantities of materials and type and number of plant
used in the items shall be prepared, signed by the Contractor counter signed
by the Project Manager supervising officer and forwarded to the Project
Manager not later than seven days after the end of the week in which the
work was carried out. Late submission of the foregoing record will not be
permitted.Signed day sheets received as above by the Project Manager shall be taken
as certifying that time, materials and plant are correct and shall not be held
to justify a claim that the works shall be so charged, or that it cannot be
measured at the rates given in the day works schedules, if any, or the Bills.
Day sheets received by the Project Manager will be dealt with at the
completion of the contract but the receipt of the same by the engineer is
not to be taken as confirmation of an addition to the contract.Provisional Work

WORKS BY NOMINATED SUB-CONTRACTORS
Unloading and hoisting shall include for providing, erecting and dismantling
scaffolding or the equivalent beyond that required for the Contractor’s own
use to enable Sub-Contractors to execute their work. Special scaffolding
shall be provided only where Sub-Contractors may require scaffolding in
locations where there is no contiguous work by the Contractor for which
scaffolding would generally be used.
GOODS AND MATERIALS FROM NOMINATED SUPPLIERS
The Contractor shall allow for checking Nominated Suppliers' invoices and
quotations before placing orders and will be held solely responsible for
insuring that all materials so ordered are correct in quantity, quality and
contain due allowance for waste.
The Contractor shall allow for checking at time of receipt, all Nominated
suppliers' materials and taking necessary action for the re-ordering of any
broken or damaged items where items described as "FIX" the Contractor
shall include in his rates for hoisting, unloading, storing, unpacking,
assembling as necessary getting into position and fixing as described and
return empty cases and packing material carriage paid to the firm supplying
the items.
PROTECTING AND CLEANING THE WORKS
The Contractor shall under no circumstances execute work or incur any
expense upon items of the work for which the provisional sums are stated
without the written approval of the Project Manager. Where the Contractor
wishes to do such works he shall first submit a quotation for approval.
WORKS BY PUBLIC BODIES
The Contractor shall allow for all costs arising from the items of special
attendance which have been included where required after the items of
general attendance following the P.C. Sum to which it applies.
The Contractor shall cover up and protect all finished works liable to
damage including provision of temporary roofs, gutters, drains, etc., until
the completion of the Works.
In the event of any damage occurring to the Works, materials, sewers,
drains, gullies, paths or other Works on the Site temporarily in the
possession of the Contractor, for the purpose of this Contract, either from
the weather, want of proper protection, defects or insufficiency of the
Works, the Contractor alone shall be responsible and shall without extra
charges, make good all damages and pay all costs which may be levied.

Works to be delivered clean
On completion of the Contract, the site and the Works shall be cleared of all
temporary buildings, plant, rubbish and unused materials and shall be
delivered up clean and in perfect condition in every respect to the
satisfaction of the Project Manager. Particular attention is to be paid to
leave all windows, doors, floors, walls and fittings clean and removing all
paint and cement stains, including unblocking gutters, drains and channels.
Painted surfaces: touch up minor faults, carefully match colour and brush
out edges. Repaint badly marked areas back to suitable breaks or junctions
approved by the Project Manager.
Remove all work blemishes, stains and defects from joinery, fittings and
decorated surfaces generally. Polish door furniture and bright parts of metal
work.
Glass: Clean both sides. Remove all paint, cement, or other splashes ;
replace scratched or broken glass.
Moving Parts: adjust , ease and lubricate all doors, windows, appliances,
control and other moving parts as necessary to ensure efficient operation.
Allowance for providing, adapting from time to time as may be necessary,
maintaining and subsequent removal of all scaffolding boards and
temporary shuttering necessary for the execution of the works. No wood
pole scaffolding shall be allowed. The Contractor must allow here or in his
rates for providing all special scaffolding required by his Sub-Contractors
and Nominated Sub-Contractors carrying out works for which P.C. sums are
included in these Bills of Quantities.
The Contractor shall as work progresses, remove and clear away all ,debris
and unused material, and shall all the time have the Site of the Works in a
clean and tidy state to the satisfaction of the Project Manager. He shall also
remove all rubbish and dirt from the Site at weekly intervals or as directed
by the Project Manager.
Secure the building by locking all accesses. Account for all keys and
handover to the Project Manager with itemised schedule of keys.
Before final inspection and handing over date, the Contractor shall leave the
whole building weather tight, clean, perfect, disinfected, sterile and fit for
occupation to the approval of the Project Manager.

All the Works in this Contract is liable to adjustment, and no excavation or
foundation work or other works shall be filled in or covered up until all
measurement needed for the Adjustments of Variations have been made
by the Quantity Surveyor.
The rates set out by the Contractor against each item shall, unless otherwise
expressly provided to the contrary, or unless there is a separate item for
extra labour, cutting or waste, be held to include for waste on materials,

Materials
A Payment of materials authorised by the Project
Manager to be used in dayworks will be the net
cost of supply and delivery to site of such
materials, in accordanc with the rates to be
inserted below by the Contractor plus the
percentage addition also to be inserted by the
Contractor.
B The net cost of supply and delivery of site of
materials shal mean the cost, including delivery
to site, or in the case of materials supplied form
the Contractor's Stock, current prices plus
justifiable charges for handling and delivery to
site. Where materials are not left in the work,
50% only of such cost will be allowed for use and
waste.
C The percentage addition on net cost of materials
as defined above will be deemed to cover
Insurances, Overheads, Head Office, Site Staff
and Establishment Charges, Profit and all other
liabilities and obligations whatsoever.
