At its simplest, both life and the law can be a never-ending round of “on the other hand”. Seemingly competing clichés can take us in one direction or the other. Is it “if it ain’t broke, don’t fix it”, or is it more like, “standing still is the fastest way of moving backwards in a rapidly changing world”? The very existence of an organization can become a struggle to find that balance of doing what has already worked well, while at the same time, recognizing where current actions no longer create the desired outcomes as times and methods and means change.
Our Association continues to benefit greatly from a committee structure that enables different needs to be met continuously, while not fully autonomously, but with enough independence to avoid the potential unwieldiness of taking everything through a centralized decision-making process. That structure ain’t broke, especially with the sure hand of our Executive Director providing us with institutional stability, along with the accumulated knowledge and energy of committee members. I have spoken to many of our colleagues in the last month. The positive responses showed an overwhelming commitment to service. No surprise there, but nevertheless still reaffirming. Some turn-over has occurred, and some minor tweaking, but the ship is steady and always in motion in the right direction. Thanks to all who have served, and who continue to serve, and to those accepting new responsibilities.
I have admired first-hand the work of recent SCBA Presidents in dealing with a myriad of unpleasant, to put it mildly, surprises,
from the effort, some might say treachery, of some of our fellow bar associations to take away our provision of notary public services to the Stark County community (and the associated revenues), to responding to the ongoing Covid-19 pandemic both as a small business, and as the primary ambassador between the Bar and our local courts. Tony Brown was the model of resolute leadership. It is not just how calm and thoughtful he approached each new dilemma; it was also just how pleasant and encouraging he remains no matter the level of stress. I welcome the boring monotony of a term with no such surprises, keeping in mind that the light is not yet visible at the end of this still very scary pandemic tunnel.
On the other hand, society does change. The way we practice changes. Innovation and technology keep moving whether individuals or organizations do. If as an association, we do not move with or better yet, ahead of the times, we will not remain relevant. With that as a motivating force, I would like to see the following occur with your help, in my twelve months of having the privilege of nominally heading your SCBA.
More use of technology across the board to respond faster and better to the needs of our constituencies (and to save money).
For decades, the SCBA had monthly luncheons. Members could briefly socialize with old acquaintances and new faces. Newer members had a chance to regularly see veteran lawyers and our judiciary. No, I don’t think our members will turn out in large numbers for this again. Many barely have time for lunch at all. But perhaps, we do have time every other month, or once a quarter, for a cup of coffee, a bagel or Danish, and some SCBA camaraderie. Committees could briefly report on recent activities, with the functions of a single committee highlighted so all members could better understand its purposes and procedures. All courts could report on new developments, again perhaps with one court given a few extra minutes to discuss its activities in more detail. We promise to keep to a strict agenda getting members out by 8:45 a.m. For those familiar with Pardon the Interruption, think that format, but about our organization, our legal system, and your practice. We would meet in a location with a large room for this semi-formal presentation, as well as a separate large room to allow break-out discussions between members who need to talk to each other about a case or a project. Covid-19 made this impossible now, but at the latest, we should start by January.
The SCBA already reaches out to area youth through several functions related to Law Day, as well as the Mock Trial competition, and Scout Law Day. Another avenue is sponsorship of a Law & Government Exploring Post (www.exploring.org/law-government/). With the assistance of the Buckeye Council, and local school systems, the post(s) would conduct monthly meetings for and by the Explorers, in conjunction with the various components of local courts, law enforcement, and

governments, in an effort to familiarize the youth with a system that they should understand and interface with productively. The times clearly show a need for better relations. C-19 slowed down this project, so if you are interested in participating, let us know and we will fi nd a place for you to contribute.
While I wish that I remembered more of the wonderful lessons from my Perry High Latin teacher, Mrs. McPeek, some words and phrases did stick. Mens sana in corpore sano. Translated as “a healthy mind in a healthy body.” I always thought of it as encouraging balance. While rarely achieving that as a lifelong goal, I have at least attempted it, with some occasional success. For over a decade, orienteering brings me a step or two closer. For those unfamiliar with this activity, please see the accompanying article, which will be a monthly addition to the Bar Journal. I hope that some of you, and your friends and family, may choose to come to an orienteering event to enjoy the outdoors, and to get in some physical and mental exercise.
Finally, it is often said that being president can age one even faster. While I hope that is not true, I intend to keep a close eye on any signs.
A GREATER RESPONSIBILITYSputnik. Almost sounds like a made-up word, a punchline.
While many still have actual memories of its launch, for most, it is a part of history, made even less important because we “won” both the Space Race, and the Cold War. Then SCBA president Richard B. Hardman, writing in the February 1958 edition of The Bar Reporter, only the third edition of what would become known as the Stark County Bar Journal, was not laughing when he noted that many Americans feared that a foreign power was “about to seize the nation and that all is lost.” He did not share their pessimism, if Americans held fast to our “beliefs”. He strongly recommended every lawyer take the time to read “Our Great Responsibility: We Must Lead The World to Freedom and Justice,” by Judge John J. Parker, January 1958 ABA Journal.
I heeded Hardman’s advice, albeit a few years later. The article is timeless, with applicable lessons then and now, and for as long as our Country remains the ideal beacon of democracy, freedom, and justice, and avoids losing its place as the shining city upon a hill. “…(D)emocracy is more than a form of government. It is a philosophy of life – a philosophy which believes that institutions exist for men, not men for institutions, and that the happiness of the poor and humble is of as much importance as the happiness of the great and proud.” “The Constitution gives us the framework of our Government but it does more – it lays down the basic principles essential to the preservation of liberty.” He identified three basic principles: (1) the government must rest upon law and not upon arbitrary will; (2) the government must rest upon consent of the governed; and, (3) that government must respect and protect the rights of the individual citizen.

and to many others: no person is above the law. The separation of powers provides the ingenious checks and balances meant to ensure that no branch of our government becomes too powerful.
To him, the second principle was fulfilled not only by the rule of the majority, but also through the dual sovereignty of a federal system that allowed for national laws to meet national needs, and state and local laws to meet state and local needs.
The third principle is the most important. “What really makes America great…is that in her heart of hearts, she believes in the sovereignty of the individual soul and the open door of opportunity for every man without regard to race or creed or color or any other circumstance.” In our Constitution, “the judiciary is the very keystone of the arch of the system”, protecting those individual freedoms, against tyranny by the government, or by the majority. “Final authority to do this is vested in the Supreme Court, whose duty it is to apply the great general principles of government which the Constitution embodies to the changing conditions of the time, with power on its part to overrule even its own prior decisions, when in the light of better understanding or changed conditions, they are deemed by it to be erroneous.”
He recognized the critical importance of protecting our institutions.
“Freedom of speech and of the press must be maintained; …and no man must be prejudiced by reason of race or color or creed in his standing before the law or in his enjoyment of benefits conferred by the state.” “Unless constitutional rights are preserved for everybody, they are preserved for nobody.”
“It is not enough for the defense of freedom, however, that we preserve it in this country. Liberty is endangered throughout the world and we cannot preserve it here without securing its foundations on a world basis.” “An economic and sociological revolution on a world wide scale is in progress and underprivileged people all over the world are looking for guidance and we are the only one of the free nations in position to furnish them the leadership that they need.” Written while the Cold War raged on, thirteen years removed from World War II, those words may seem quaint to some now, but not when viewed in the context of authoritarian governments currently seeking to expand their power, or at least check the movement of democracy, either through the introduction of chaos wherever possible, including within our country; or the use of terror to cause freedom seeking people to fear for their lives more than the loss of access to such freedom; or through the economic might of centralized national wealth that can curry favor through well-placed financial favors.
Judge Parker concluded with this message to, well, you: “Upon the principles of our Constitution, therefore, depends the preservation of freedom not only in this country but throughout the free world; and no greater responsibility ever rested upon any group of people than rested upon the lawyers of America who are in a peculiar sense the guardians of our constitutional structure.”

Local Rules of Court: Adoption of Model Mediation Rule
Effective January 1, 2020, the Ohio Supreme Court adopted several mediation rule changes to incorporate the state’s Uniform Mediation Act. The new Rule of Superintendence 16 instructs Courts to review their local rules to ensure consistency with the new state rule.
The Judges of the General Division have adopted the language of the model rule. It is very similar to the prior Local Mediation Rule 16. The Ohio Sup. R. 16 model rule provides the option of maintaining confidentiality of mediations. The Judges have maintained the confidentiality provisions in the Local Rule. And the Judges have retained the Local Rule requirement that mediation summaries be submitted at least five (5) days prior to the scheduled mediation.

Settlement WeekThe General Division of the Stark County Court of Common Pleas is pleased to announce a Settlement Week
scheduled for August 24-28, 2020. Resolution of pending civil disputes has been significantly hampered by the ongoing public health crisis. And the Court’s regular mediation schedule has a significant backlog of cases. So the Judges are encouraging parties interested in moving their cases forward to sign-up for one of up to forty-five Settlement Week mediation slots.
Assisting the Court with Settlement Week are the Honorable John Haas, retired Judge, and the Honorable Richard Reinbold, retired Judge. Experienced Court Mediators Paul Mastriacovo and Doug Godshall will also be working daily during Settlement Week. Mediations already on the calendar for Settlement Week will go forward as previously scheduled.
If you are interested in reserving a Settlement Week time slot, you may schedule now with the Court’s Mediation Coordinator at 330-451-7703. Please indicate to the Coordinator if you would like to conduct the mediation remotely. A packet of Settlement Week materials will soon be available on the Court’s website. You may also request that a packet be emailed to you by contacting the Court’s Mediation Coordinator by phone or jlschneider@starkcountyohio.gov. CLE Update Make the most of the time that you are confined at home!
SUPREME COURT CLE ORDER:The Commission on Continuing Legal Education has waived the self-study caps for judges and attorneys to complete their CLE requirements for the 2019-2020 compliance period ending December 31, 2020. Accordingly, attorneys and judges with the last names beginning with M-Z may complete all CLE requirements through approved self-study courses, including live interactive webinars, for the compliance period ending December 31, 2020.
This waiver has not been granted to attorneys and judges with the last names beginning with A-L for the 2020/2021 compliance period, which will not end until December 31, 2021. However, as part of your 12 hours of “live credit” you can meet the requirement by watching live interactive webinars rather than attending in person.

Why did you join the Stark County Bar Association? Working for Community Legal Aid, I practice in several counties, but my offi ce is in Canton, so most often I am in Stark County courts. I appreciate that the Stark County Bar Association is active in the community and keeps its members updated and informed.
What practice areas interest you the most?I started my legal career as a prosecutor and now work at Community Legal Aid, so I have handled both criminal and civil cases. I enjoy helping people and making them feel empowered.
What groups or activities are you involved in outside of work? This spring I started a garden. I will soon have many, many vegetables that I may actually eat. I also enjoy traveling (although not recently!) and just hanging out.
What motto will shape/ has shaped your legal career? Be the change you wish to see in the world.
What is your favorite legally-related movie or book?There are many, but the most recent include, for fi ction, “Bosch.” It is a novel series and a TV show. And for non-fi ction, the book “Evicted: Poverty and Profi t in the American City” by Matthew Desmond. It is a wonderfully written book that tells the stories of several families living in poverty.
Are you a Stark County native? What brought you to Stark County?No, I grew up in Columbus and moved to Akron to be
closer to family and go to graduate school (biology); somehow, I ended up in law school 10 years later. I still live in Akron but work in Canton.
If you could represent any client today, who would it be and why?There are many answers to this question, but since I just recently watched “Making a Murderer,” I am going to say Steven Avery and Brandon Dassey. As an attorney, so much that went on in those cases was shocking.

Legal Avenues: Your Road to Solutions
Are you considering changing your practice area focus from an area that is seeing a drop in activity to one that is undergoing an uptick in demand? Increased activity in the areas of labor and employ-ment law, products liability law, and estate planning is expected during the current health crisis.1 It is like-ly that there will be fewer real estate transactions and small business matters.2 A small Ohio firm, Rittgers & Rittgers has begun making this type of transition. It has an office in Ox-ford that worked primarily with university students, who are no longer on campus. That office’s attorneys will be switching their focus to serving clients going through bankruptcy, which is a practice area that is seeing an increase in filings.3
Attorneys who switched their practice focus during the Great Recession are sharing their experiences with attorneys considering change in today’s envi-ronment. Attorney Rebecca Glatzer describes how she transitioned from dealing with primarily real estate transactions to domestic relations issues. When real estate work evaporated a decade ago, she looked for a practice area that she was interested in that still had significant activity. She took CLEs to update her skills in domestic rela-tions and joined the local family bar group. She rec-ommends these types of activities to ease the transi-tion. During these times of social distancing, that may mean participating in virtual networking events or posting on social media. She also suggests taking pro bono cases in the new practice area to develop relevant skills.4
Another option to increase business is to adapt your practice to focus on serving a specific business sec-tor. For example, providing labor and employment services to hotels. Some things to take into consider-ation when looking for a niche are whether there are other practitioners in the area providing services in the specialized area, is there the potential for future growth, and are there potential conflicts? Evaluate your existing clients and the industries they represent to see if there is a distinct service you can offer to them. Are those clients then willing to help you make additional contacts in the industry? Are there local and national organizations you can join to make additional connections in the industry? Be sure to include your industry specific focus in your bio-graphical information on your web site and on LinkedIn.5
When changing practice areas, attention to ethics issues is essential. ABA Model Rule 1.1 requires that “A lawyer shall provide competent representation to a client. Competent representation requires the legal knowledge, skill, thoroughness and preparation rea-sonably necessary for representation.” When moving into a new practice area, sometimes attorneys will work with a co-counsel with significant experience in a particular area. That relationship brings up the ne-cessity to have the client consent to that arrangement. Care must also be taken when advertising services in the practice concentration. To avoid the appearance of any false or misleading communication as prohib-ited by ABA Model Rule 7.1.6
