Renewable energy, such as biomass, wind, mini-hydro, and geothermal isreceiving greater attention rom governments, potential investors, andconsumers worldwide. In 2007, the European Union (EU) set a combinedmember country target that 20% o overall energy consumption will comerom renewable sources by 2020.
Serbia has signifcant renewable energy resources to meet this emergingdemand, and the Serbian Government has developed a strategy to leveragethis opportunity. To support sector growth and investment, and to meet theircommitment to the South East Europe Energy Community Treaty, the Serbiangovernment adopted several regulations by decree in November 2009,including:
Establishment of a Feed-in Tariff system whereby the Serbian governmentwill subsidize the cost o renewable electricity;
DenedtherequirementsofbecomingaPrivilegedElectricPowerProducer who uses renewable energy sources to generate electricity;
With the Serbian governments adoption o eed-in taris and other keyregulation, GTZ Project Strengthening o the Local Sel-Government(GTZ SLS) has been working with government ministries and the USAIDCompetitiveness Project private sector investors to encourage investment inrenewable energy projects.

A key activity has been to create defnitive guides to the renewable energylicensing process aimed at encouraging investors and other market actorsto become active in the sector. Representatives o the Ministry o Mining andEnergy, Ministry o Environment and Spatial Planning and Ministry oAgriculture, Forestry and Water Management together with the GTZ expertshave created our such roadmaps, which explain the licensing process or
developing projects in geothermal water, small hydro power, wind power andbiomass subsectors. The USAID Competitiveness Project has supportedGTZ SLS in the creation o investor roadmaps as part o its activities toencourage investment in the sector by providing technical assistance toprospective investors.
Each roadmap is created as a detailed document, which describes administrative procedures and identifes relevant institutions and necessary planning anddesign documents needed or investors. The roadmaps navigate the
legislative and regulatory ramework and should be utilized as a baseline orurther legislative and regulatory reorm. GTZ SLS has also prepared shortversions o roadmaps, which are executive summaries that investors can useor act fnding.
We hope that this eort will be a vehicle to acilitate dialogue between the pri-vate sector and the Government to identiy and address barriers to the growthand fnancial viability o the sector.

The necessary prerequisites that must be met by any party interested insigning the Assignment Agreement include the ollowing:

Obnovljiva energija iz biomase, vetra, malih hidroelektrana i geotermalnihizvora je u centru panje drava, potencijalnih investitora i potroaa u celomsvetu. U 2007. godini, Evropska Unija (EU) postavila je cilj zemljama lanicamada, do 2020. godine, 20% energije u svakoj od zemalja treba da potekne izobnovljivih izvora energije.
Srbija ima znaajne izvore obnovljive energije kojima bi mogla da zadovoljinovonastale zahteve. Vlada Srbije je razvila strategiju kako bi iskoristila ovupriliku. Da bi podstakla razvoj i investicije u ovaj sektor i ispunila obavezu poUgovoru o energetskoj zajednici Jugoistone Evrope, Vlada Srbije je usvojilanekoliko propisa po direktivi od novembra 2009, ukljuujui:

DenisanjezahtevazasticanjestatusaPovlaenogproizvoaa
elektrine energije koji koristi obnovljive izvore energije za proizvodnjustruje;

relevantnim ministarstvima, USAID Projektom za razvoj konkurentnosti iinvestitorima u privatni sektor, kako bi podstakao investicije u obnovljiveizvore energije.

Kljuna aktivnost je bila kreiranje konanih vodia za proces izdavanjadozvola za obnovljive izvore sa ciljem podsticanja investitora i drugih trinihuesnika da postanu aktivni u ovom sektoru. Predstavnici Ministarstvarudarstva i energetike, Ministarstva zatite ivotne sredine i prostornogplaniranja i Ministarstva poljoprivrede, umarstva i vodoprivrede zajedno sastrunjacima GTZ-a su kreirali etiri takva vodia, koji objanjavaju
proces dobijanja dozvola za razvijanje projekata za podsektore geotermalnevode, malih hidroelektrana, energije vetra i biomase. USAID Projekat zarazvoj konkurentnosti je podrao GTZ JLS u kreiranju vodia za investitore kaodeo svojih aktivnosti vezanih za podsticanje investicija u sektor kroz pruanjetehnike pomoi perspektivnim investitorima.
Svaki vodi je kreiran u vidu detaljnog dokumenta, koji opisuje administra-tivne procedure i identifkuje institucije od znaaja i dokumenta vezana zaplaniranje i izradu projekata koja su neophodna za investitore. Vodii
obuhvataju i zakonski i regulatorni okvir i treba da se koriste kao osnova zadaljezakonskeiregulatornereforme.GTZJLSjetakoepripremiokrauverziju vodia, koji predstavljaju saetke vodia koje investitori mogu dakoriste za nalaenje podataka.

Za objekte koji se grade u skladu sa navedenim lanom 133.obavezna je izrada Generalnog projekta sa Prethodnom studijomopravdanosti i Idejnog projekta sa Studijom opravdanosti, kojipodleu pregledu od strane Revizione komisije.

- Graenje objekata, odnosno izvoenje radova moe da vri privredni subjekat
upisan u odgovarajui registar za graenje objekata, odnosno za izvoenje
radova (izvoa radova).
- Obaveze izvoaa radova su da: pre poetka radova potpie glavni projekat,
reenjem odredi odgovornog izvoaa radova, odgovornom izvoau radova
obezbedi ugovor o graenju i dokumentaciju na osnovu koje se gradi objekat,
obezbedi preventivne mere za bezbedan i zdrav rad u skladu sa zakonom, da
izvodi radove prema dokumentaciji na osnovu koje je izdata graevinska dozvo-
la, organizuje gradilite na nain kojim e obezbediti pristup lokaciji, obezbeuje
sigurnost objekta i lica na gradilitu i okoline, obezbeuje dokaz o kvalitetu
izvrenih radova, vodi graevinski dnevnik, graevinsku knjigu i obezbeuje
knjigu inspekcije, obezbeuje objekte i okolinu u sluaju prekida radova.
- Potrebno je da se na gradilitu stalno nalazi: ugovor o graenju, reenje o
odreivanju odgovornog izvoaa radova na gradilitu i glavni projekat, tj.
dokumentaciju na osnovu koje se projekat gradi.
- Investitor obezbeuje struni nadzor u toku graenja objekta, odnosno izvoenja
radova za koje je izdata graevinska dozvola.

Pribavljanje vodne dozvole obavlja se po izvrenom tehnikompregledu objekta.
Upotrebna dozvola se ne moe izdati bez prethodno dobijene vodne dozvole
Zahtev za dobijanje vodne dozvole
U prilogu:
1) Reenje o izdavanju vodne saglasnosti
2) Zapisnik Komisije za tehniki pregledizgraenog objekta
3) Zakljueni ugovori sa javnim vodnimpreduzeem,
4) Dokumente koji se zahtevaju u Reenjuo izdavanju vodne saglasnosti
Ukoliko je potrebno, Investitor e bitinaknadno obaveten da dopuni dokumen-taciju
Ministarstvo za poljoprivredu,umarstvo i vodoprivredu
Reenje o izdavanju vodne dozvoleIzdaje se na period od najdue

II-1Ugovor opoveravanju -sadraj
Neophodni uslovi koje treba da ispuni lice zainteresovano za zakljuenjeUgovora o poveravanju su:
a) adekvatna tehnika opremljenost (pravo vlasnitva ili pravo korienja
vetroelektrane, koja je izgraena u skladu sa zakonom, tehnikim i drugim
propisima);
b) kadrovska osposobljenost (da lica koja rade u vetroelektrani imaju
neophodnu strunu spremu i druga propisana znanja);
c) sprovoenje propisane zatite na radu;
d) ostvarivanje propisanih uslova i naina zatite i unapreenja ivotnesredine.
Ugovor o poveravanju sadri odredbe o:
1) radu i poslovanju privrednog subjekta kome se poverava ova delatnost;
2) pravima i obavezama u pogledu korienja sredstava u dravnoj svojini
za obavljanje delatnosti od opteg interesa, u skladu sa zakonom;3) obavezama privrednog subjekta u pogledu obezbeivanja uslova za
kontinuirano, uredno i kvalitetno zadovoljavanje potreba korisnika
proizvoda i usluga;
4) meusobnim pravima i obavezama ugovornih strana u sluaju kada nisu
obezbeeni ekonomski i drugi uslovi za obavljanje delatnosti od opteg
interesa;
5) pravima i obavezama u sluaju poremeaja u poslovanju privrednog
subjekta;
6) drugim pravima i obavezama i pitanjima koja su od znaaja za
ostvarivanje i zatitu opteg interesa.

Za izgraene objekte se podnosi i graevinska dozvola, kao i dokaz o pravu svojine naobjektu ili pravu korienja objekta
Nadleni energetski subjekat na iji sistem se objekat prikljuuje (EPS, EMS)
