Council held this date at 8:00 p. m.
Present: Mayor Akerley, Councillors 'Crook,
Zatzman, Granfield, Beazley, Payzant, Guptill,' Dares and
Hollis.
Minutes of the June 3rd and 17th meetings of
Town Council,' ·copies of wHich had been: circul~ted to
members of Town Council, were adopted on mO,tion of
Councillors Hol~is and Guptill. '
On motion of Councillors Be~zley and Payzant
the following monthly reports, copies of which had been
circulated to me,mbers of Town Council, were received and
filed:
Medical Health Officer Victori~n Order, of Nurses Chief' of Police Fire Chief Building Inspector Town Clerk
Reports of the Town Solicitor re license~,
and Council's right to pass a by-'law refusing to license
automatic machines, copies of which had been circulat,ed
to members of Town'Council, were considered at this time. . ' It was moved by Councillors Payzant and Crook and carrieo
that the Town Solicitor be instructed to prepare legisla
tion to submit to the Nova Scotia Legislature giving Towr
Council control' over granting licenses for automat'ic
maehines. Councillor Beazley voting against.
Letter was read from the Board of School Com-
missioners recommending to 'rown Council that the heating
and ventilation system as re.commended at the June 17th

. to re-consider this matter. It was moved by Councillors
Guptill and Holiis and carried that·a joint meeting of
Council and School Board be held together with the
architect and a qualified heating engineer to discuss
the matter further. The architect to be asked to bring
a q'ualified heating ~ngineer to this meeting.
Report was read from the Town ,Planning Board
regarding a petition from residents of East Broo~-
West Brook Avenue area reques~ing r~zoning of that area
from an R-l to R-2. The Town Plann~ng Board recommended
that the matter of re-zoning this area from R-l to R-2.
be submitted to a public hearing in acc.ordance with the
Town Planning Act and that Town Council's decision
regarding re-zoning be made afte~ any objections are
received. It was moved by Councillors Granfield and
Guptill and carried that the r~port of the Town Planning.

It was moved by Councillors Hollis and Granfield
and carried that Monday, Aug~st 4th, be set as the date
for the public meeting to consider obj~ctions to this /

read advising that ambulance service was. available
in' the area although none are located within the
limits of the Tmm of Dartmouth. The Committee
recommended that they be autho~ized'to negotiate

lishment of an adequate ambulance service within

1. This by-la\'1 shall apply to Zones called H 1 Zones to be
Single Family Zones.
2. Definitions: Ip this by-law, I

Report of the Public Safety Committee was read
advising that the Committee had not given joint Con
sideration to the future use of the facilities in the
Dartmouth Fire ,Station by ~he Provincial Magistrate
as requested by the Fire 'Department. The Committee
will,' however, give due consideration to this request
,during the coming month. It was moved by Councillors
Hollis and Zatzman and carried that the report of the
Public Safety Committee be received and filed.
Report of the Finance Committee was read re the
use of the Town owned prope!'ty, known as the Adams House,
by the YMCA-YWCA. The Finance Committee recommend~d

Report of the Finance Committee was read advising
that the Committee had given consideration to a letter
from Morris Beverages Limited pertRining to the purchase
of a parcel of Town owned land, situated on Wyse Road,
North of the Plymouth Cordage Company property. The
Finance Committee recommended that this land be sold to
Morris,Beverages Limited for a price of $7,500. and
subject to Morris Beverages Limited giving an undertaking
that it will build upon this land within one year. It
was moved by Councillors Payzant, and Dares and carried 'I'
that the resolution, as annexed, authorizing the sale, of
this Town owned land be adopted. Coun'cillor Zatzman
voting against.
Report of the Finance Committee was read regarding
the establ,ishment of an ambulance service in the Town of
Dartmouth, -recommending that the C'ommittee be empowered
to continue negotiations with Walker Ambulance Service
with the possibtlity of providing a more adequate ambu
lance service in the Town of Dartmouth. It was moved by
Councillors Guptill and Payzant and carried that the
rep~rt of the Finance Committee be adopted.
'Letter was read from Mayor 1. Vi. Akerley regarding
the need for hospital facilities within the Town of
Dartmouth and area. ~fuyor Akerley'suggested that in
view of the Federal and Provincial assistance which is , I
available towards constructing hospitals, Council
authorize the appointment of a, C~l!III1ittee to further
explore this matter. It was moved by Councillors
Granfield and Payz,"nt ,and carried that the recommenda-
tion of Mayor Akerley be adopted 'and that the Mayor be

The Committee advised that the Chief of 'Police, ,in view-
" ing the photographs and visiting the site, is of the
opinion that such signs would constitute a hazard to
motor vehicle traffic. The Committee recommended that

rejected. It was moved by Councillors Guptill and Hollis

Petition was read from residents of Joffre
Street requesting the removal of the North-East corner
of· the intersection'of Joffre Street and Portland Street
as this area constitutes a traffic hazard at this inter

to eliminate this traffic hazard as soon as the Town can'

Minutes of the November 4th and 10th meetings
of Town Council, copies of which had been circulated
to members of Town Council, were ,adopted on motion of
Councillors Guptill and Hollis.
On motion of Councillors Beazley and Payzant
the following monthly reports, cO'pies of which had
been circulated to members of Town Council, were
received and filed: ,

Report of the Finance Company was read re
the offer bf Fader Agencies, Reg'd. to purchase from
the Town of Dartmouth two Town-owned water lots. The
Finance Comn'littee 'recommended that the Town Solicitor
be instructed to negotiate a ,lease for this land
,betwaen the Tpwn of Dartmouth'and Fader Agencies,
Reg'd. It was moved by Coun?illors Granfield a~d
Beazley and carried that the recommendation of the
Finance Cornniittee be adopted.

Report of the Finance Committee was read
regarding the request of Reverend D. B. Lennerton
to purchase certain Town-owned land bordering on
Rodney Road and Hastings Drive. The Finance Committee
recommended that in view of the possible future need
of this land for school and recreational purposes
the property be retained by the Town. It was ~oved
by Councillors Guptill and Payzant and, carr'ied 'that·
the report of the Finance Committee be. adopted .. ,
Report of the Public Works Committee was ,
read r~commending that tenders be called for the
purchase of a new cab and chassis to replace the one
, presently in use in connection with thega~bage'
disposal body; further reco~mending that the 1954
Fargo cab and. chassis presently in use in this con-
nection!?e offered in trade. It was moved by Coun
cillors Dares and Payzant and carried' that the report
of the Works Committee b.e adopt ed.
Councillo~ Dare~ having tabled an amendment
to the by-law entitled 1IEarly Closing of Shops1l at the
October 4th meeting of Town Council, moved the adoption
of this by-law. The motion was seconded by Councillor
Guptill. On motions, regularly moved, seconded and'
carried, Mr. R. S. Huestis, representing the Dartmouth
Merchants I Association and l\Ilr. G. L. S. Hart, represent
ing t:he Dartmouth Shdpping Cent~e Tenants j Association,
were granted permission to address Town Council, regard
ing this proposed by-law amendment. Councillors Granfiel
'and Beazley moved an amendment that no action be·taken
on this request for an amendment to the by-law entitled . I
"Early Closing of Shops1l. Mayor Akerley ruled the
amendment out of order on the basis·that it was a

'Department· (Volunteer) informing Town Council that
the Dartmouth ~ire Department (Volunteer) intepdto
resign as members of the Dartmouth Fire ·Department
in a. body at midnight, November 30th, if at, that time
tl;le Magistrate' ~ Office and Court Room are still·
housed in the Dartmouth Fire Station. It was moved

Club.
,Letter was read from the Special Zoning
Co~ittee recommending that a Planning Engineer be
engaged immediately for the purpose of establishing
, a master plan and over-all zoning regulations for the , .
Town of Dartmouth. It was moved by Councillors Granfield
and Guptill and earried ',that this letter be tabled for
one month and that copies of the report entitle~,"Report
on Results of Questionnaire on Zoning to Can'adian Towns
and Cities" which was prepared for the members of 'this , '. .

of this by-law is annexed,hereto.

proposal to have all members of Town Council serve
on Standing Committees for the forthdoming year.
The matter was debated at some length by members of
Town Council •. It was moved py Councillors Granfield,
and Guptill and carried that for the year 1959 all
members of Town Counc·:i,l serve on Standing Committees,
and that the Nominating Committ.ee recommend a .Chairman
for each of these Standing Committees.
On motion of Councillors. Grarifield and Zatzman
,the following resolution was unanimously adopted:
IIRESOLVED'that the- Town enter into an agreement with Dartmouth Fer~y Commission for-the trahsfer and conveyance to the'· Town of all the assets of Dartmouth Ferry Commission in consideration of the Tovm assuming all the liabilities of the Commission; . FURTHER RESOLVED 'that the Mayor and Town Clerk b~ and they are hereby authorized to execute said agreement on behalf of the Town when the same has been approved by the Town Solicitor; FURTHER RESOLVED that a Committee'be appointed to administ~r the affairs of the Dartmouth Ferry. 11

ment (yolunteer) informing ToWn Co,uncil that all members
of the Volunteer Fire Department have signified their ,
willingness to and have rejoined the Department, Council
may therefore be assured of the continued services of
the Volunteer Firemen. It was moved by Councillors
Guptill and Dares and carried that the letter from the . . . ", , .

Letter was read from the Nova Scotia Board of
Fire Underwriters acknowledging a letter from May~r Akerley,
dated D'ecember 8th, advising that the ihformation given
is 'satisfactory to the Board and that th~ Board appreciates
the manner in which the situation .with the Dartmouth Volun
teer Fire Department has been' remedied. It was moved by
Councillors Holl'is and Payzant 'and carried that this letter
be received and filed.

Munic:ipal maintenance and construction,programs carried
out during winter months. On motion of Councillors
Granfield and' Hollis the following re'solution was adopted:
"RESOLVED that the Town Council of the Town ' (48) of Dartmouth authorize the submission of an
application to Provincial and Federal Government authorities for a Winter Works and Maintenance' Program, as submitted to this meeting,and/or such work as the Mayor, Town Clerk and Town Engineer feel can be efficiently carried out during the winter months.

alterations in the basement of the Town Hall to provide
a court room and '~gistrate's office, two washrooms and
a lawyers' room. The total cost of the work as outlined
